का.आ. 501(अ).— भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 16 द्वारा प्रदत्त िजियों
का प्रयोग करते हुए, केंद्र सरकार का, भारतीय मानक ब्यूरो से परामिध करने के बाद यह म त है दक यह िनजहत में आवश्यक
अथवा जहतकर है, अत: एतद्वारा जनम्नजलजखत आदेि करती है, नामत:-
1. संजिप्त िीर्धक और प्रारंभ - (1) इस आदेि को फ्लैिलाइट (गुणवत्ता जनयंत्रण) आदेि, 2025 कहा िाएगा।
(2) यह आदेि िासकीय रािपत्र में इसके प्रकािन की तारीख से लागू होगा।
2. मानक जिह्न का अजनवायध प्रयोग – ताजलका के कॉलम (2) में जवजनर्दधष्ट वस्ट्तुएं या सामान, ताजलका के कॉलम (4) के
तहत तदनुरूपी प्रजवजष्ट में जवजनर्दधष्ट तारीख से ताजलका के कॉलम (3) में उजल्लजखत तदनुरूपी भारतीय मानक के अनुरूप
होंगे तथा उन पर ताजलका के कॉलम (5) के तहत तदनुरूपी प्रजवजष्ट में जवजनर्दधष्ट तारीख से भारतीय मानक ब्यूरो (अनुपालन
मूल्यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट्कीम -1 के अनुसार भारतीय मानक ब्यूरो के लाइसेंस के तहत मानक जिह्न
लगा होगााः

बिते दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत यथापररभाजर्त सूक्ष्म
और लघु उद्यम ताजलका के क्रमिाः कॉलम (6) और (7) के अंतगधत तदनुरूपी प्रजवजष्ट में जवजनर्दधष्ट तारीख से ऐसे भारतीय
मानकों का अनुपालन करेंगेाः
बिते दक इस आदेि में से कुछ भी जनयाधत की िाने वाली स्ट्वदेि में जवजनर्मधत वस्ट्तुओं या सामान पर लागू नहीं
होगा।
बिते दक इस आदेि में कुछ भी प्रजत वर्ध फ्लैिलाइट के जवजनमाधताओं द्वारा अनुसंधान और जवकास के उद्देश्य से 50
संख्या तक आयाजतत सामान या वस्ट्तुओं पर लागू नहीं होगा, इस ितध के अधीन दक ऐसे आयाजतत सामान और वस्ट्तुएं
वाजणजज्यक रूप से नहीं बेिी िाएंगी और स्ट्क्रैप के रूप में जनपटाया िा सकता है तथा जवजनमाधता माल या वस्ट्तुओं का वर्धवार
ररकाडध रखेंगे और यदद केन्द्द्रीय सरकार ऐसा िाहे तो उसे प्रस्ट्तुत करेंगे।
3. प्रमाणन और प्रवतधन प्राजधकरण – भारतीय मानक ब्यूरो, उि ताजलका के कॉलम (2) में जवजनर्दधष्ट वस्ट्तुओं या
सामान के जलए प्रमाणन और प्रवतधन प्राजधकरण होगा।
4. उल्लंघन के जलए पेनल्टी – इस आदेि के प्रावधानों का उल्लंघन करने वाले व्यजि को भारतीय मानक ब्यूरो
अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा।

नोट- इस ताजलका के प्रयोिन के जलए, भारतीय मानकों के संबंध में िारी संिोधनों सजहत उनके नवीनतम संस्ट्करण ,िैसा
दक भारतीय मानक द्वारा समय-समय पर अजधसूजित दकए गए हैं, लागू होंगे।

ORDER
New Delhi, the 21st January, 2025
S.O. 501(E).— In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016
(11 of 2016), the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is
necessary or expedient so to do in the public interest, hereby makes the following order, namely: -
1. Short title and commencement. - (1) This order may be called Flashlight (Quality Control) Order, 2025.
(2) It shall come into force from the date of its publication in the Official Gazette.
2. Compulsory use of Standard Mark. - Goods or articles specified in column (2) of the Table shall confirm to the
corresponding Indian Standard mentioned under column (3) from the date specified in the corresponding entry under
column (4) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-
II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 from the date specified in the
corresponding entry under column (5) of the Table:
Provided that micro enterprises and small enterprise, as defined under the Micro, Small and Medium
Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the
corresponding entry under columns (6) and (7) of the Table respectively:
Provided further that nothing in this order shall apply to goods or articles manufactured domestically for
export.
Provided also that nothing in this order shall apply for fifty number of goods or articles imported for the purpose
of research and development by manufacturers of Flashlights per year with the condition that such imported goods or
articles shall not be sold commercially and can be disposed of as a scrap and the manufacturers shall maintain a year-
wise record of the goods or articles and furnish the same, if so desired by the Central Government.
3. Certification and enforcement authority. - The Bureau shall be the certifying and enforcing authority for the goods
or articles specified in column (2) of the Table.
4. Penalty for contravention. — Any person who contravenes the provisions of this order shall be punishable under
the provisions of the Bureau of Indian Standards Act, 2016.
