का.आ. 1365(अ)—भारतीय मानक ब् यूरयोग अजधजनयम, 2016 (2016 का 11) की धारा 25 की उप-धारा (3)
रर धारा 17 के साथ परित धारा 16 की उप-धाराओं (1) रर (2) द्वारा प्रदत् त िजतियय का प्रययोगग करते ुएए तथा कककवेयर
रर यूटेंजसल् स (गकणवत् ता जनयं्ण) आदेि, 2023 के अजधक्रमण में, जसवाय ऐसे कायों के ियोग अजधक्रमण से पहले दकए गए
अथवा दकए िाने से छूट गए, केंद्र सरकार का ब् यूरयोग के साथ परामिध करने के बाद यह म त ह दक यह िनजहत में आव् यक
अथवा जहतकर ह , अत: एतद्द्वारा जनम् नजलजखत आदेि करती ह , नामत: -
1. संजिप् त िी्धक रर प्रारंभ – (1) इस आदेि कयोग खा् रर पेय पदाथों के जलए कककवेयर, यूटेंजसल् स रर के् स (गकणवत् ता
जनयं्ण) आदेि, 2024 कहा िाएगा।
(2) इस आदेि में अ् यथा की गई व् यवस्ट् था कयोग छयोगककर, यह आदेि 1 जसतंबर, 2024 से प्रभावी हयोगगा।
2. मानक जर्ह्न का अजनवायध प्रययोगग- ताजलका के कॉलम (1) में जवजनर्ददष् ट वस्ट् तकएं या सामान उ त ताजलका के कॉलम (2)
में उजल्लजखत तद्नकरूपी भारतीय मानक के अनकरूप ह गे तथा उनमें भारतीय मानक ब् यूरयोग (अनकपालन मूल् यांकन) जवजनयम,
2018 की अनकसूर्ी-II की स्ट् कीम-I के अनकसार ब् यूरयोग के लाइसेंस के तहत मानक जर्ह्न लगा हयोगगा:
बिते दक जनयाधत की िाने वाली स्ट् वदेि में जवजनर्ममत वस्ट् तकओं या सामान पर इस आदेि में से ककछ भी लागू नहह हयोगगा:

बिते इसके अलावा दक सूक्ष् म, लघक रर मध् यम उ्म जवकास अजधजनयम, 2006 (2006 का 27) के तहत यथा पररभाज्त
लघक उ्म के संबंध में यह आदेि 1 ददसंबर, 2024 से प्रभावी हयोगगा:
बिते इसके अलावा दक सूक्ष् म, लघक रर मध् यम उ्म जवकास अजधजनयम, 2006 (2006 का 27) के तहत यथा पररभाज्त
सूक्ष् म उ्म के संबंध में यह आदेि 1 मार्ध, 2025 से प्रभावी हयोगगा:
बिते इसके अलावा दक इस आदेि में से ककछ भी सूक्ष् म, लघक रर मध् यम उ्म मं्ालय के ‘उ्म पयोगटधल’ के तहत पंिीकृत
उ्म द्वारा स्ट् वदेिी रूप से जवजनर्ममत वस्ट् तकओं अथवा सामान पर लागू नहह हयोगगा, जिसमें मूल लागत पर संयं् एवं
मिीनरी अथवा उपकरण में जनवेि पच् र्ीस लाख रूपए से अजधक नहह ह तथा र्ाटधडध अकाउंटेंट द्वारा यथा सत् याजपत
उत् पादन जपछले जवत् तीय व्ध में दयोग करयोगक रूपए से अजधक नहह ह ।

प्रमाणन रर प्रवतधन प्राजधकरण.- यह ब् यूरयोग उ त ताजलका के कॉलम (1) में जवजनर्ददष् ट वस्ट् तकओं या सामान के जलए
प्रमाणन रर प्रवतधन प्राजधकरण हयोगगा।

ORDER
New Delhi, the 14th March, 2024
S.O. 1365(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with
section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in
supersession of the Cookware and Utensils (Quality Control) Order, 2023, except as respects things done or omitted
to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of
the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:-
1. Short title and commencement. – (1) This Order may be called the Cookware, Utensils and Cans for foods and
beverages (Quality Control) Order 2024.
(2) Save as otherwise provided in this order, it shall come into force on the 1st September, 2024.
2. Compulsory use of Standard Mark.- Goods or articles specified in the Column (1) of the Table shall conform to
the corresponding Indian Standard specified in Column (2) of the said Table and shall bear the Standard Mark under a
license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment)
Regulations, 2018:

Provided that nothing in this order shall apply to goods or articles manufactured domestically for export:
Provided further that in relation to Small Enterprises as defined under the Micro, Small and Medium Enterprises
Development Act, 2006 (27 of 2006), it shall come into force with effect from the 1st December, 2024:
Provided also that in relation to Micro Enterprises as defined under the Micro, Small and Medium Enterprises
Development Act, 2006 (27 of 2006), it shall come into force with effect from the 1st March, 2025:
Provided also that nothing in this Order shall apply to goods or articles manufactured domestically by an enterprise,
registered under "Udyam portal" of the Ministry of Micro, Small and Medium Enterprises, wherein the investment in
plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not
exceed two crore rupees for the previous financial year as certified by a Chartered Accountant.
3.
Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for
the goods or articles specified in the Column (1) of the said Table.
