का.आ. 3893(अ).—भारतीय मानक ब् यूरो अजधजनयम, 2016 (2016 का 11) की धारा 25 की उप-धारा (3)
के साथ परित धारा 16 द्वारा प्रदत् त िजियों का प्रयोग करते हुए, केंद्र सरकार का ब् यूरो के साथ परामिध करने के बाद यह
म त है दक यह िनजहत में आवश् यक अथवा जहतकर है, अत: एतद्द्वारा सभी रबड़ और सभी पॉलीमर सामग्री से बने फुटजवयर
और इसके घटक (गुणवत् ता जनयंत्रण) आदेि, 2022 में जनम् नजलजखत संिोधन करती है, नामत:-
1. (1) इस आदेि को सभी रबड़ और सभी पॉलीमर सामग्री से बने फुटजवयर और इसके घटक (गुणवत् ता
जनयंत्रण) संिोधन आदेि, 2023 कहा िाए।
(2) यह िासकीय रािपत्र में इसके प्रकािन की तारीख से प्रभावी होगा।
2. सभी रबड़ और सभी पॉलीमर सामग्री से बने फुटजवयर और इसके घटक (गुणवत् ता जनयंत्रण) संिोधन आदेि,
2022 में पैरा 2 में दूसरे परंतुक के बाद जनम् नजलजखत परंतुक िोड़ा िाए, नामत: -

आदेि, 2023 की िुरुआत के बाद, जनयाधत के जलए भारत में फुटजवयर के जवजनमाधण में प्रयुक् त जनम् नजलजखत ताजलका में
जवजनर्दधष् ट वस्ट् तुओं अथवा सामान आयात पर इस आदेि में से कुछ भी लागू नहीं होगा।”

बिते यह भी दक आयातक आयात मंिूरी वाले फुटजवयर सोल की आयात खेप के आने से पहले सीमा िुल् क में जनम् नजलजखत
तारीके से चमड़ा जनयाधत पररर्द् द्वारा सत् याजपत स्ट् व-घोर्णा प्रस्ट् तुत करेगा, नामत: -
i. आयातक द्वारा यह स्ट् व-घोर्णा दक आयाजतत फुटजवयर सोल का इस्ट् तेमाल जनयाधत के जलए फुटजवयर के उत् पादन
अथवा फुटजवयर के जहस्ट् सों को िोड़ने में दकया िाएगा तथा भारत के घरेलू बािार में बेचने के जलए नहीं दकया
िाएगा।
ii. स्ट् व-घोर्णा, आयातक के पत्रिीर्ध (लेटर हेड) पर दी िाएगी जिसमें इनवॉइस नंबर और आयात खेप के अन् य संगत
ब् यौरे जवजधवत् रूप से उजल्लजखत होंगे तथा यह उल् लेख होगा दक आयाजतत मद जनयाधत के प्रयोिन के जलए
फुटजवयर के जवजनमाधण के अलावा घरेलू बािार में दकसी अन् य कायध के जलए अथवा बेचने के जलए इस्ट् तेमाल नहीं
की िाएगी तथा कंपनी संबंजधत प्राजधकरणों द्वारा प्रमाणन अथवा भजवष् य में लेखा परीक्षा के जलए अपने आंतररक
ररकॉडध का रखरखाव करेगी।
iii. चमड़ा जनयाधत पररर्द् द्वारा सत् यापन दक आयातक पररर्द् में पंिीकृत एक जवजनमाधता जनयाधत है जिसमें (क)
वतधमान में वैध पंिीकरण-सह-सदस्ट् यता प्रमाण पत्र संख् या और िारी करने की तारीख, (ख) उद्यम पंिीकरण
प्रमाण पत्र संख् या और तारीख अथवा औद्योजगक उद्यजमता ज्ञापन संख् या और तारीख, (ग) गृह उपभोग संख् या के
जलए प्रवेि का जबल और तारीख जिसे आयात मंिूरी हेतु भारतीय सीमा िुल् क इलेक् रॉजनक डाटा इंटरचेंि जसस्ट् टम
में दायर दकया गया है, का उल् लेख हो; और
iv. फुटजवयर सोल की सुगम सीमा िुल् क मंिूरी के जलए, आयातक को भारतीय सीमा िुल् क इलेक् रॉजनक डाटा
इंटरचेंि पोटधल पर उपयुधक् त दस्ट् तावेि और अन् य संगत दस्ट् तावेि अपलोड करने होंगे।”

ORDER
New Delhi, the 1st September, 2023
S.O. 3893(E).—In exercise of the powers conferred by section 16 read with sub-section (3) of section 25 of
the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau of Indian
Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following
order to amend the Footwear Made from all Rubber and all Polymeric Material and its Components (Quality Control)
order, 2022, namely:-
1. (1) This Order may be called the Footwear Made from all Rubber and all Polymeric Material and its
Components (Quality Control) Amendment Order, 2023.
(2) It shall come into force from the date of its publication in the official Gazette.
2. In the Footwear Made from all Rubber and all Polymeric Material and its Components (Quality Control)
Amendment Order, 2022, in paragraph 2 after the second proviso, the following proviso shall be inserted namely: -
“Provided further that nothing in this Order shall apply, after the commencement of the Footwear Made from
all Rubber and all Polymeric Material and its components (Quality Control) Amendment Order, 2023, to import of
goods or articles specified in the Table below used in manufacturing of footwear in India for export only, namely: -

Provided also that the importer shall furnish a self declaration certified by the Council for Leather Exports before the
import consignments of footwear soles given import clearance at the customs in the following manner, namely:-
i.
self-declaration by the importer that the footwear soles imported are meant for production or assembly of
footwear for exports and not for sale in the domestic market of India;
ii. the self-declaration will be in the Letter Head of the importer duly mentioning the Invoice Number and other
relevant details of the import consignment and mentioning that the imported items shall not be put to any
other use or sold in the domestic market except in the manufacture of footwear for the purpose of exports and
the company will maintain its internal records for any future verification or audit by concerned authorities;
iii. certification by the Council for Leather Exports that the importer is a manufacturer exporter registered with
the Council by quoting (a) currently valid Registration-cum-Membership Certificate number and date of
issue; (b) Udyam Registration Certificate Number and date; (c) Bill of Entry for home consumption number
and date which is filed in the Indian Customs Electronic Data Interchange system for import clearance; and
iv. the importers must upload the above documents along with other relevant documents in the Indian Customs
Electronic Data Interchange portal, for smooth customs clearance of the footwear soles.
