L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY कारपोरेट कार्य मंत्रालर् अजधसूचना नई दिल्ली, 18 िुलाई, 2023 सा.का.जन. 518(अ).—केंद्रीर् सरकार, प्रजतस्ट्पधाय अजधजनर्म, 2002 (2003 का 12) की धारा 16 की उप-धारा (4) के साथ पठित धारा 63 की उप-धारा (2) के खंड (च) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, भारतीर् प्रजतस्ट्पधाय आर्ोग (महाजनिेिक) भती जनर्म, 2009 में संिोधन करने के जलए जनम्नजलजखत जनर्म बनाती है, अथायत्:- 1. (1) इन जनर्मों का संजिप्त नाम भारतीर् प्रजतस्ट्पधाय आर्ोग (महाजनिेिक) भती संिोधन जनर्म, 2023 है। (2) र्े रािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे। 2. भारतीर् प्रजतस्ट्पधाय आर्ोग (महाजनिेिक) भती जनर्म, 2009 (जिसे इसमें इसके पश्चात उि जनर्म कहा गर्ा है) में, जनर्म 3 के पश्चात, जनम्नजलजखत जनर्म अंतःस्ट्थाजपत दकर्ा िाएगा, अथायत् :- “3क चर्न सजमजत और इसकी प्रदिर्ा.- (1) महाजनिेिक का चर्न छानबीन-सह-चर्न सजमजत के माध्र्म से दकर्ा िाएगा िो जनम्नजलजखत से जमलकर बनेगी - (क) अध्र्ि, भारतीर् प्रजतस्ट्पधाय आर्ोग - अध्र्ि; सं. 412] नई दिल्ली, मंगलवार, िुलाई 18, 2023/आषाढ़ 27, 1945 No. 412] NEW DELHI, TUESDAY, JULY 18, 2023/ASHADHA 27, 1945 सी.जी.-डी.एल.-अ.-18072023-247428 CG-DL-E-18072023-247428 सी.जी.-डी.एल.-अ.-18072023-247428 CG-DL-E-18072023-247428 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) कारपोरेट कार्य मंत्रालर् में, एक अजधकारी िो भारत सरकार के संर्ुि सजचव के रैंक से नीचे न हों - सिस्ट्र्; (ग) केंद्रीर् सरकार द्वारा नाजमत एक जविेषज्ञ-प्रजतजित व्यजि - सिस्ट्र् (2) महाजनिेिक के चर्न के प्रर्ोिनाथय, छानबीन-सह-चर्न सजमजत- (क) अपनी स्ट्वर्ं की प्रदिर्ा तैर्ार करेगी; और (ख) तीन नामों के पैनल की जसफाठरि करेगी। (3) महाजनिेिक की जनर्ुजि भारतीर् प्रजतस्ट्पधाय आर्ोग द्वारा छानबीन-सह-चर्न सजमजत द्वारा जसफाठरि दकए गए पैनल में से केन्द्द्रीर् सरकार का पूवय अनुमोिन प्राप्त करने के पश्चात की िाएगी।” 3. उि जनर्मों की अनुसूची में, - (क) स्ट्तंभ (4) और उससे संबंजधत प्रजवजिर्ों के स्ट्थान पर, जनम्नजलजखत स्ट्तंभ और प्रजवजिर्ां रखी िाएंगी, अथायत्: - "वेतन मैठरक्स में स्ट्तर (4) लेवल 15 (1,82,200-2,24,100 रुपर्े)।”; (ख) स्ट्तंभ (10) में, "िो वषय" िब्िों के स्ट्थान पर , "लागू नहीं" िब्ि रखे िाएंगे; (ग) स्ट्तंभ (12) में, प्रजवजिर्ों के स्ट्थान पर, जनम्नजलजखत प्रजवजिर्ां रखी िाएंगी, अथायत्:- "केंद्रीर् सरकार र्ा राज्र् सरकार के अजधकारी,- (क) (i) जनर्जमत आधार पर समतुल्र् पि धारण दकए गए हों; र्ा (ii) वेतन मैठरक्स के वेतन स्ट्तर-14 (1,44,200-2,18,200रुपर्े) र्ा समतुल्र् में पि पर तीन वषय की जनर्जमत सेवा के साथ; और (ख) सत्र्जनिा और उत्कृि िमता वाले व्यजि होने चाजहए और जिनके पास अन्द्वेषण के अनुभव और लेखा, प्रबंधन, कारबार, लोक प्रिासन, अंतरायष्ट्रीर् व्यापार, जवजध र्ा अथयिास्त्र का ज्ञान होना चाजहए।"। (घ) स्ट्तंभ (13) में, जवद्यमान प्रजवजिर्ों के स्ट्थान पर, "लागू नहीं" प्रजवजि रखी िाएगी। [फा.सं. कॉम्प-01/1/2023-कॉम्प-एमसीए] मनोि पाण्डेर्, संर्ुक् त सजचव ठटप्पण: मूल जनर्म भारत के रािपत्र, असाधारण, भाग-II, धारा 3, उप-खण्ड (i) में सा.का.जन. 563 (अ) तारीख 04 अगस्ट्त, 2009 द्वारा प्रकाजित दकए गए थे। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF CORPORATE AFFAIRS NOTIFICATION New Delhi, the 18th July, 2023 G.S.R. 518(E).—In exercise of the powers conferred by clause (f) of sub-section (2) of section 63 read with sub-section (4) of section 16 of the Competition Act, 2002 (12 of 2003), the Central Government hereby makes the following rules to amend the Competition Commission of India (Director General) Recruitment Rules, 2009, namely:- 1. (1) These rules may be called the Competition Commission of India (Director General) Recruitment Amendment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Commission of India (Director General) Recruitment Rules, 2009 (hereinafter referred to as the said rules), after rule 3, the following rule shall be inserted, namely :– “3A. Selection Committee and its procedure. –(1) Selection of the Director General shall be made through the Search-cum-Selection Committee consisting of – (a) the Chairperson, Competition Commission of India - Chairperson; (b) an officer not below the rank of Joint Secretary to the Government of India in the Ministry of Corporate Affairs - Member; (c) an expert-person of eminence nominated by the - Member. Central Government (2) For the purpose of selection of the Director General, the Search-cum-Selection Committee shall- (a) devise its own procedure; and (b) recommend a panel of upto three names. (3) The Director General shall be appointed by the Competition Commission of India out of the panel recommended by the Search-cum-Selection Committee, after obtaining prior approval of the Central Government.”. 3. In the Schedule to the said rules, - (a) for column (4) and the entries relating thereto, the following column and entries shall be substituted, namely: - “Level in the pay matrix (4) Level 15 (Rs. 1,82,200-2,24,100).”; (b) in column (10), for the words “Two years”, the words “Not applicable” shall be substituted; (c) in column (12), for the entries, the following entries shall be substituted, namely: - “Officers of the Central Government or State Government,- (a) (i) holding analogous post on regular basis; or (ii) with three years regular service in the post in pay level -14 (Rs. 1,44,200-2,18,200) in the pay matrix or equivalent; and (b) should be persons of integrity and outstanding ability and who have experience in investigation, and knowledge of accountancy, management, business, public administration, international trade, law or economics.”.
