L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY भारतीय प्रजतस्ट् पधाा आयोग अजधसूचना नई दिल् ली, 12 िनवरी, 2024 भारतीय प्रजतस्ट् पधाा आयोग (साधारण) संिोधन जवजनयम, 2024 (2024 की सं. 01) सं. एल-3(2)/जवजनयम-साधारण(संिो.)/2024/सीसीआई—भारतीय प्रजतस्ट् पधाा आयोग, प्रजतस्ट् पधाा अजधजनयम, 2002 (2003 का 12) के खंड 36 और 64 द्वारा प्रित् त िजियों का प्रयोग करते हुए, भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 में और संिोधन करने के जलए एतद्द्वारा जनम् नजलजखत जवजनयम बनाता है अर्ाात्: 1. संजिप् त नाम एवं आरंभ.- (1) इन जवजनयमों का संजिप् त नाम भारतीय प्रजतस्ट् पधाा आयोग (साधारण) संिोधन जवजनयम, 2024 है। (2) ये रािपत्र में इनके प्रकािन की तारीख से प्रवृत् त होंगे। 2. भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 में, जवजनयम 2 में, उप जवजनयम (1) में खंड (च) के पश् चात जनम् नजलजखत खंड अंत:स्ट् र्ाजपत दकया िाएगा:- सं. 34] नई दिल्ली, िुक्रवार, िनवरी 12, 2024/पौष 22, 1945 No. 34] NEW DELHI, FRIDAY, JANUARY 12, 2024/PAUSHA 22, 1945 सी.जी.-डी.एल.-अ.-13012024-251332 CG-DL-E-13012024-251332 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (चक) ‘’अंतवती आवेिन’’ से आयोग के समि िाजखल उन मामलों के जसवाय, िो आयोग के कोई आिेि या जनिेि के अनुपालन में िाजखल दकये गये हैं, अजधजनयम की धारा 19 के अधीन संजस्ट्र्त मामले में िाजखल आवेिन अजभप्रेत है; 3. भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 में, जवजनयम 15 में, उप जवजनयम (5) के पश् चात जनम् नजलजखत उप जवजनयम अंत:स्ट् र्ाजपत दकया िाएगा, अर्ाात्: मामले में िाजखल प्रत्येक अंतवाती आवेिन पंिीकृत और संख् यादकत दकया िाएगा। ऐसे सभी आवेिनों की 7 दिनों के भीतर संवीिा की िाएगी और उनमें त्रुटियां, यदि कोई हो, की संसूचना पिकार को िी िाएगी। आवेिन करने वाला पिकार उन त्रुटियों को हिाकर उसे संसूचना प्राप्त होने के 5 दिनों के भीतर प्रस्ट् तुत करेगा, ऐसा न करने पर आवेिन अजवजधमान्य माना िाएगा। भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 में, जवजनयम 49 में, उप जवजनयम (1) के पश् चात जनम् नजलजखत उप जवजनयम अंत:स्ट् र्ाजपत दकया िाएगा, अर्ाात्: ‘’(1क) जवजनयम 15 के उप जवजनयम (6) के अधीन प्राप् त प्रत् येक अंतवती आवेिन के सार् संित् त िुल् क का साक्ष् य संलग् न होगा यर्ा,- (क) व् यजि या जहन्िू अजवभक् त पटरवार (एचयूएफ) के मामले में 500 (पााँच सौ) रुपए, या (ख) गैर सरकारी संगठन (एनिीओ) या उपभोिा संघ, या सहकारी सजमजत अर्वा न् यास के मामले में 1000 (एक हिार) रुपए, या (ग) ऐसी फमा (इसमें प्रोराइिरजिप, पािानरजिप अर्वा जलजमिेड लाइजबजलिी पािानरजिप फमा भी िाजमल है) या कंपनी (इसमें एकल व्यजि कंपनी भी िाजमल है) पूवावती वषा में जिनका कारबार िो करोड़ रुपये का रहा हो, के मामले में 1000 (एक हिार) रुपए, (घ) अन् य सभी मामलों में 5000 (पांच हिार) रुपए।‘’ अनुपमा आनंि, सजचव [जवज्ञापन-III/4/असा./692/2023-24] टिप् पण:- मूल जवजनयमों को भारत का रािपत्र, असाधारण, भाग III, खण्ड 4 में अजधसूचना सं.आर- 40007/6/जवजन-साधारण/अजध/04/सीसीआई तारीख 21 मई, 2009 द्वारा प्रकाजित दकया गया र्ा और तत् पश् चात इन् हें संिोजधत करके भारत का रािपत्र, असाधारण, भाग III, खण्ड 4 में तारीख 20 अगस्ट् त, 2009 की अजधसूचना सं. एल-3 (2)/जवजन-साधारण(संिो.)/2009-10/सीसीआई, तारीख 20 अक् तूबर, 2010 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2009-10/सीसीआई, तारीख 31 माचा, 2011 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2009- 10/सीसीआई, तारीख 8 नवंबर, 2011 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2011/सीसीआई, तारीख 7 अक् तूबर, 2013 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2013/सीसीआई, तारीख 6 दिसंबर, 2018 की सं. एल-3 (2)/जवजन- साधा.(संिो.)/2018/सीसीआई, तारीख 20 नवंबर, 2019 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2019/सीसीआई, तारीख 6 फरवरी, 2020 की सं. एल-3 (2)/जवजन-साधा.(संिो.)/2022 /सीसीआई, तारीख 6 जसतंबर, 2021 की सं. एल- 3 (2)/जवजन-साधा.(संिो.)/2021/सीसीआई और तारीख 8 अप्रैल, 2022 की सं. जवजन-साधा.(संिो.)/2022/सीसीआई द्वारा प्रकाजित दकया गया र्ा। [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 THE COMPETITION COMMISSION OF INDIA NOTIFICATION New Delhi, the 12th January, 2024 The Competition Commission of India (General) Amendment Regulations, 2024 (No. 01 of 2024) No. L-3(2)/Regl. -Gen. (Amdt.)/2024/ CCI — In exercise of the powers conferred by Sections 36 and 64 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations further to amend the Competition Commission of India (General) Regulations, 2009, namely:- 1. Short title and commencement. - (1) These regulations may be called the Competition Commission of India (General) Amendment Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Commission of India (General) Regulations, 2009, in regulation 2, in sub- regulation (1) after clause (f), the following clause shall be inserted, namely: (fa) "Interlocutory Application" means an application filed before the Commission in a case instituted under section 19 of the Act, except those filed in compliance of any order or direction of the Commission; 3. In the Competition Commission of India (General) Regulations, 2009, in regulation 15, after sub- regulation (5), the following sub-regulation shall be inserted, namely: (6) Every Interlocutory Application filed in a case shall be registered and numbered. All such applications shall be scrutinized within 7 days and defects, if any, shall be communicated to the party. The party making application shall remove the defects and submit the same within 5 days from the receipt of communication failing which the application shall be treated as invalid. In the Competition Commission of India (General) Regulations, 2009, regulation 49, after sub- regulation (1), the following sub-regulation shall be inserted, namely: "(1A) Each Interlocutory Application received under sub-regulation (6) of regulation 15 shall be accompanied by proof of having paid the fee as under, - (a) Rupees 500 (five hundred) in case of individual or Hindu Undivided Family (HUF), or (b) Rupees 1000 (one thousand) in case of Non-Government Organisation (NGO), or Consumer Association, or Co-operative Society, or Trust or (c) Rupees 1000 (one thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one person company) having turnover in the preceding year upto rupees two crore, or (d) Rupees 5000 (five thousand) in all other cases.” ANUPAMA ANAND, Secy.
