(1) इन जवजनयम में, िन तक दक संिभा से अन् यथा अपेजित न ैो, – (क) ‘‘अजधजनयम’’ से प्रजतस्ट् पधाा अजधजनयम, 2002 (2003 का 12) अजभप्रेत ै ; (ख) ‘‘स्ट् वीकृजत’’ से पिकार द्वारा दकया गया यै कथन या प्रस्ट् तुजतकरण अजभप्रेत ै दक वै अजधजनयम की धारा 3 के उपनंध के अजभकजथत उल्लंघन में संजलप् त ै ; (ग) ‘‘आवेिक’’ से अजधजनयम की धारा 2 के खंड (ि) में यथा यथापठरभाजषत ऐसा कोई उद्यम अजभप्रेत ै िो उत् पािक संघ का सिस्ट् य ै या था और इसमें कोई ऐसा ्‍ यजि सजम्मजलत ै िो दकसी उद्यम की रर से उत् पािक संघ में अंतवाजलत रैा ै ; और कोई ऐसा उद्यम या उद्यम का संगम या ्‍ यजतिय या ्‍ यजतियय का संगम, भले ैी वै एकसमान या समान ्‍ यापार में संपृतिय नैह ै , भी सजम्मजलत ै यदि वै ऐसे उत् पािक संघ को अग्रसर करने में भाग लेता ै या भाग लेने का आिय रखता ै और िो आयोग को जनम् नतर िाजस्ट्त और/या जनम् नतर िाजस्ट्त में वृजधि के जलए आवेिन प्रस्ट् तुत करता ै ; (घ) ‘‘उत् पािक संघ’’ से अजधजनयम की धारा 2 के खंड (ग) में यथापठरभाजषत उत् पाि संघ अजभप्रेत ै ; (ङ) ‘‘आयोग’’ से अजधजनयम की धारा 7 की उपधारा (1) के अधीन स्ट् थाजपत भारतीय प्रजतस्ट् पधाा आयोग अजभप्रेत ै ; (च) ‘पिाजभजैत प्राजधकारी’’ से आयोग का ऐसा अजधकारी अजभप्रेत ै िो इन जवजनयम के प्रयोिना के जलए इस प्रकार कृत् य करने के जलए अ्‍ यि द्वारा प्राजधकृत ै ; (छ) ‘मैाजनिेिक’’ से अजधजनयम की धारा के खंड (छ) में यथापठरभाजषत मैाजनिेिक अजभप्रेत ै ; (ि) ‘‘नव प्रकटीकृत उत् पािक संघ’’ से आवेिक द्वारा इन जवजनयम की अनुसूची I और अनुसूची II में उपनंजधत प्रकटन , इसमें आयोग या मैाजनिेिक के पास उपलब् ध सामग्री भी सजम्मजलत ै , िो आयोग को अजधजनयम की धारा 26 की उपधारा (1) के अधीन प्रथम िृष् टया राय ननाने में समथा ननाता ै , के संनंध में आयोग द्वारा अवधाठरत उत् पािक संघ, अजभप्रेत ै ; (झ) ‘‘पिकार’’ में क्रमि: अजधजनयम की धारा 2 के खंड (च) और (1) में पठरभाजषत कोई उद्यम या ्‍ यजतिय सजम्मजलत ै जिसके जवरुधि कोई िांच या कायावाैी संजस्ट्थत की गई ै और केन् रीय सरकार, कोई राज् य सरकार या कोई सांजवजधक प्राजधकारी सजम्मजलत ैोगा और इसमें कायावाजैय में भाग लेने के जलए अनुमजत प्राप् त कोई ्‍ यजतिय भी सजम्मजलत ैोगा; (ञ) ‘‘पूर्वाक् ता जस्ट्थजत’’ से आवेिक के कतार में जनम् नतर या जनम् नतर िाजस्ट्त में वृजधि का फायिा िेने के जलए जचजन्ैत आवेिक की जस्ट्थजत अजभप्रेत ै ; (ट) ‘‘मैत् वपूणा प्रकटन’’ से आवेिक द्वारा आयोग को सूचना या साक्ष् य द्वारा ऐसा पूणा और सत् य प्रकटन अजभप्रेत ै िो आयोग को दकसी उत् पािक संघ के अजस्ट्तत् व के नारे में प्रथम िृष् टया राय ननाने में सिम ननाता ै या अजधजनयम की धारा 3 के उपनंध के उल् लंघन को स्ट् थाजपत करने में सैायता करता ै । (2) इन जवजनयम में प्रयुक् त ऐसे िब् ि और पि का, िो पठरभाजषत नैह ैैं, क्रमि: वैी अथा ैोगा, िो उनका, अजधजनयम या जनयम या तिधीन ननाये गये जवजनयम या कंपनी अजधजनयम, 2013 (2013 का 18) में ै । [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 जनम् नतर िाजस्ट्त या जनम् नतर िाजस्ट्त में वृजधि के जलए ितत 3. (1) अजधजनयम की धारा 46 के अधीन जनम् नतर िाजस्ट्त या जनम् नतर िाजस्ट्त में वृजधि के फायिे के जलए आवेिन करने वाला कोई आवेिक, - (क) िन तक दक आयोग द्वारा जनर्िाष् ट न दकया िाए, अपने प्रकटन के समय से उत् पािक संघ में आगे और भागीिारी समाप् त कर िेगा; (ख) अजधजनयम की धारा 3 के उपनंध के अजभकजथत उल् लंघन के संनंध में मैत् वपूणा प्रकटन उपलब् ध कराएगा; (ग) ऐसी सभी सुसंगत सूचना, िस्ट् तावेि और साक्ष् य उपलब् ध कराएगा िो आयोग द्वारा अपेजित ैो; (घ) पूणा अन् वेषण और आयोग के समि अन् य कायावाजैय के िररान वास्ट् तजवक ूप प से, पूणातया, जनरंतर और िीघ्रता के साथ सैायता उपलब् ध कराएगा; (ङ) दकसी भी रीजत में ऐसे संगत िस्ट् तावेि को िो उत् पािक संघ की स्ट् थापना के संनंध में सैयोग कर सकेंगे, नैह जछपाएगा, नष् ट, छलयोजित नैह करेगा या नैह ैटाएगा; और (ट) कोई झूिा साक्ष् य नैह िेगा या कोई सरवान सूचना का यै िानते ुए लोप नैह करेगा दक यै सरवान ै । (2) आवेिक उन ्‍ यजि य के नाम उपलब् ध कराएगा िो उसकी रर से उत् पािक संघ में अंतवाजलत रैे ैैं और जिनके जलए आवेिक द्वारा, यथाजस्ट्थजत, जनम् नतर िाजस्ट्त या जनम् नतर िाजस्ट्त में वृजधि का आवेिन दकया गया ै । (3) िैां कोई आवेिक या उसका प्राजधकृत प्रजतजनजध, यथाजस्ट्थजत, जनम् नतर िाजस्ट्त या जनम् नतर िाजस्ट्त में वृजधि का आवेिन िाजखल करते समय, अनुसूची I या अनुसूची II में या िोन में जनर्िाष् ट और वर्णात या आयोग द्वारा समय-समय पर यथापेजित सूचना और साक्ष्य का पूणा और सैी प्रकटन उपलब् ध कराने में जवफल रैता ै तो आयोग उसका आवेिन नामंिूर कर सकेगा। (4) उपजवजनयम में दकसी नात पर प्रजतकूल प्रभाव डाले जनना, आयोग मामले के तथ् य और पठरजस्ट्थजतय पर जवचार करने के पश् चात, आविेक को ऐसे जननाधन और ितों के अ्‍ यधीन कर सकेगा, जिन् ैें वै उजचत समझे। (5) िैां कोई आवेिक या उसका प्राजधकृत प्रजतजनजध, अन् वेषण ठरपोटा प्रात ह ैोने के पश् चात, मैाजनिेिक या आयोग के समि उपजवजनयम (1) और (4) में उजल्लजखत ितों का पालन करने में जवफल रैता ै तो आयोग उसका आवेिन नामंिूर कर सकेगा। (6) इस जवजनयमन के अधीन आवेिक के जनम् नतर िाजस्ट्त या जनम् नतर िाजस्ट्त में वृजधि का आवेिन नामंिूर करने से पूवा, आयोग ऐसे आवेिक को सुनवाई का अवसर उपलब् ध कराएगा। (7) उपयुाक् त उपजवजनयम (3) या (5) के जननंधन के अनुसार, आवेिन नामंिूर ैोते ुए भी, आयोग या मैाजनिेिक, चल रैे जवषय में, अजधजनयम की धारा 46 के प्रावधान के अनुसार, आवेिक द्वारा प्रस्ट्तुत सूचना, िस्ट्तावेि और साक्ष्य का उपयोग करने के जलए स्ट्वतंत्र ै गे। (8) उपरोतिय उपजवजनयम (3) या (5) के जननंधन के अनुसार, आवेिन नामंिूर ैोने पर, आवेिक उल्लंघन के जलए पूछताछ के अ्‍ यधीन दकया िा सकेगा। (9) इन जवजनयम के अधीन धनीय िाजस्ट्त में कमी करने के संनंध में आयोग के जववेकाजधकार का प्रयोग जनम् नजलजखत को ्‍ यान में रखते ुए दकया िाएगा, – (क) वै प्रक्रम जिस पर आवेिक प्रकटन के साथ आता ै ; (ख) आयेाग के कब् िे में पैले से जवद्यमान साक्ष् य; (ग) आवेिक द्वारा उपलब् ध कराई िाने वाली सूचना की गुणवत् ता; (घ) उपयुाक् त उपजवजनयम (1) और (4) में जवजनर्िाष् ट ितों की पूर्ता; और 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ङ) मामले के पूणा तथ् य और पठरजस्ट्थजतयां। जनम् नतर िाजस्ट्त मंिूर दकया िाना 4. जवजनयम 3 में अजधकजथत ितों के अधीन रैते ुए, जनम् नजलजखत रीजत में, िो आयोग जवजनश् चय करे, जवजनयम 3 के उपजवजनयम में उजल्लजखत आवेिक और ्‍ यजि (य ) को अजधजनयम की धारा 27 के खंड (ख) और धारा 48 के अधीन उिग्रैणीय िाजस्ट्त से जनम् नतर िा जस्ट्त का फायिा मंिूर दकया िा सकेगा, अथाात:— (क) यदि आवेिक दकसी उत् पाि संघ का ऐसा साक्ष् य प्रस्ट् तुत करे, िो आयोग को दकसी ऐसे उत् पािक संघ की, जिसमें अजभकजथत ूपप से अजधजनयम की धारा 3 का उललंघन दकया ै , जवद्यमानता के संनंध में प्रथम िृष् टया राय ननाने में समथा ननाता ै , मैत् वपूणा प्रकटन करने वाला पैला ्‍ यजतिय ै और आवेिन के समय पर आयोग के पास ऐसी कोई राय ननाने के जलए पयााप् त साक्ष् य नैह था, तो जवजनयम 3 के उपजवजनयम में उजल्लजखत आवेिक और ्‍ यजि (य ) को िाजस्ट्त के सर प्रजतित तक या उसके समतुल् य कमी का फायिा मंिूर दकया िा सकेगा: परंतु यै दक यदि जवजनयम 3 के उपजवजनयम में उजल्लजखत आवेिक और व् यजि (गण) ऐसा साक्ष् य प्रस्ट् तुत करें, िो दकसी अन् वेषणाधीन जवषय में अजधजनयम की धारा 3 के उल् लंघन को स्ट् थाजपत करता ै , मैत् वपूणा प्रकटन करने वाला पैला ्‍ यजतिय ै और आवेिन के समय पर आयोग या मैाजनिेिक के पास ऐसे उल् लंघन को स्ट् थाजपत करने के जलए पयााप् त साक्ष् य नैह था, तो आविेक को िाजस्ट्त के सर प्रजतित तक या उसके समतुल् य कमी का फायिा मंिूर दकया िा सकेगा। (ख) पैले आवेिक के पश् वातवतआ आवेिक(क ) एवं ्‍ यजि (य ) को भी ऐसा साक्ष् य, िो आयोग की राय में, यथाजस्ट्थजत, आयोग या मैाजनिेिक के पास दकसी ऐसे उत् पािक संघ की, जिसने अजभकजथत ूप प से अजधजनयम की धारा 3 का उल् लंघन दकया ै , जवद्यमानता को स्ट् थाजपत करने के जलए पैले से मरिूि साक्ष् य को सटीक ननाने में मैत् वपूणा योगिान िे सकेगा, प्रस्ट् तुत करके प्रकटन करने पर िाजस्ट्त में कमी का फायिा मंिूर दकया िा सकेगा। स्ट् पष् टीकरण — इन जवजनयम के प्रयोिन के जलए ‘‘सटीक ननाने में मैत् वपूणा योगिान’’ से वै जवस्ट् तार अजभप्रेत ै , जिस तक उपलब् ध कराया गया साक्ष् य, यथाजस्ट्थजत, आयोग या मैाजनिेिक के, दकसी ऐसे उत् पािक संघ की, जिसने अजभकजथत ूप प से अजधजनयम की धारा 3 का उल् लंघन दकया ै , जवद्यमानता को स्ट् थाजपत करने के जलए सामथ् या में वृजधि करता ै । (ग) खंड (ख) में जनर्िाष् ट धनीय िाजस्ट्त में कमी जनम् नजलजखत क्रम में ैोगी — (i) पूर्वाकता जस्ट्थजत में िूसरे के ूप प में जचन् ैाकिंकंत जवजनयम 3 के उपजवजनयम (2) में उजलजल् खत आवेिक और ्‍ यजि (य ) को उिग्रैणीय पूणा िाजस्ट्त के पचास प्रजतित तक या उसके समतुल् य कमी मंिूर की िा सकेगी; और (ii) पूर्वाकता जस्ट्थजत में तीसरे के ूप प में जचन् ैाकिंकंत जवजनयम 3 के उपजवजनयम (2) में उजलजल् खत आवेिक और ्‍ यजि (य ) को उिग्रैणीय पूणा िाजस्ट्त के तीस प्रजतित तक या उसके समतुल् य कमी मंिूर की िा सकेगी। जनम् नतर िाजस्ट्त में वृजधि मंिूर दकया िाना 5. (1) अजधजनयम की धारा 46 की उपधारा (4) के जननंधन के अनुसार और जवजनयम 3 और 4 में अजधकजथत ितों के अ्‍ यधीन, कोई आवेिक, जिसने जवजनयमन 6 (पैला उत् पाि संघ) के अधीन, अजधजनयम की धारा 3, उपनंध के अजभकजथत उल्लंघन के संनंध में पूणा, सैी और मैत्वपूणा प्रकटन दकया था, एक और उत् पाि संघ जिसमें वै अजधजनयम की धारा 3 का उल् लंघन करने में अजभकजथत ै , जवद्यमानता के संनंध में पूणा, सैी और मैत् वपूणा प्रकटन करता ै , िो आयोग को अजधजनयम की धारा 26 की उपधारा (1) के अधीन नव प्रकटीकृत उत् पाि संघ की जवद्यमानता के संनंध में प्रथम [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 िृष् टया राय नानने में समथा ननाता ै , अजधजनयम की धारा 46 की उपधारा (1) के जननंधन के अनुसार नव प्रकटीकृत उत् पाि संघ के संनंध में िाजस्ट्त के सर प्रजतित तक या उसके समतुल् य कमी का फायिा अजभप्राप् त करने के अलावा पैले उत् पाि संघ के संनंध में, धनीय िाजस्ट्त में, िाजस्ट्त के तीस प्रजतित तक या उसके समतुल् य अजतठरक् त कमी का फायिा मंिूर दकया िा सकेगा। िृष् टांत: उत् पाि संघ ए, एक् स और वाई, िाजस्ट्त में उपलब् ध, सर प्रजतित तक या उसके समतुल् य और पचास प्रजतित की कमी के साथ क्रमि: पैले और िूसरे माकार वाले जनम् नतर िाजस्ट्त के आवेिक ैैं। वाई उत् पाि संघ नी की िानकारी ैोने पर, उसकी जवजनयम 7 के अधीन ठरपोटा करता ै । उत् पाि संघ नी की ठरपोटिंट ग के जलए, अपेजित ितों की पूणाता के अ्‍ यधीन, वाई को उत् पाि संघ नी के संनंध में पैले माकार की जस्ट्थजत अजभप्रात ह करने के अलावा, उत् पाि संघ ए के संनंध में िाजस्ट्त के तीस प्रजतित तक या उसके समतुल् य अजतठरतिय कमी ग्रा्य ैोगी। परंतु यै दक ऐसे आवेिक के ्‍ यजि (गण), िो पैले उत् पाि संघ में उसकी जनम् नतर िाजस्ट्त के आवेिन का जैस्ट्सा थे, यदि ऐसे ्‍ यजि (गण) भी नव प्रकटीकृत उत् पाि संघ और उस संनंध में िाजखल जनम् नतर िाजस्ट्त में वृजधि के आवेिन िोन का जैस्ट्सा ैैं तो उन्ैें भी आवेिक पर प्रयोज् य जनम् नतर िाजस्ट्त में वृजधि का फायिा मंिूर दकया िा सकेगा। (2) अजधजनयम की धारा 46 की उपधारा (4) के जननंधन के अनुसार, नव प्रकटीकृत उत् पािक संघ का अवधारण करते समय, आयोग उन सभी सुसंगत कारक पर सम् यक ्‍ यान िेगा िो नव प्रकटीकृत उत् पािक संघ को मरिूिा काट ल से भेि करते ैैं। (3) जवजनयमन 5 के अधीन धनीय िाजस्ट्त में कमी करने के संनंध में आयोग के जववेकाजधकार का प्रयोग जनम् नजलजखत को ्‍ यान में रखते ुए दकया िाएगा – क) जनना जनम् नतर िाजस्ट्त में वृजधि के आवेिन के आयोग या मैाजनिेिक द्वारा नव प्रकटीकृत उत् पािक संघ का पता लगाए िाने की संभावना, और ख) आयोग द्वारा सुसंगत समझा गया कोई अन्य कारक। जनम् नतर िाजस्ट्त की मंिूरी के जलए प्रदक्रया 6. (1) जनम् नतर िाजस्ट्त की मंिूरी के प्रयोिन के जलए, आवेिक या उसका प्राजधकृत प्रजतजनजध अनुसूची में इन जवजनयम की अनुसूची I में यथाजवजनर्िाष् ट सभी सारवान सूचना अंतर्वाष् ट करने वाला कोई आवेिन कर सकेगा या वै दकसी उत् पािक संघ की जवद्यमानता के संनंध में सूचना और साक्ष् य प्रस्ट् तुत करने के जलए पिाजभजैत प्राजधकारी को स्ट् वत: आकर या ई-मेल या फ क् स के मा्‍ यम से सूजचत कर सकेगा। तत् पश् चात, पिाजभजैत प्राजधकारी िस काया दिवस के भीतर जवषय को जवचाराथा आयोग के समि रखेगा। परंतु यै दक जनम् नतर िाजस्ट्त की मंिूरी के जलए जवजनयम 6 के उपजवजनयम (1) के अधीन आवेिन, पूछताछ के िररान दकसी भी समय पर, परंतु अजधजनयम की धारा 26 के अधीन जनिेजित अन् वेषण ठरपोटा आयोग को प्रात ह ैोने के अपश् चात, दकया िा सकेगा। (2) आयोग द्वारा आवेिन की प्राजत ह की तारीख और समय वै तारीख और समय ै गे जिन् ैें पिाजभजैत प्राजधकारी द्वारा अजभजलजखत दकया िाए या िो पिाजभजैत प्राजधकारी के सरवर या फ जक्समाइल प्रेषण मिीन पर अजभजलजखत ैो। (3) आयोग उस पर आवेिक की पूर्वाकता जस्ट्थजत को जचजन्ैत करेगा और पिाजभजैत प्राजधकारी उसकी संसूचना डॉक या ई-मेल या फ क् स के मा्‍ यम से आवेिक को प्रेजषत करेगा दक ‘समुजचत पूर्वाकता जस्ट्थजत जचजन्ैत कर ली गई ै ’, और यै दक वै मात्र उस आधार पर जनम् नतर िाजस्ट्त की मंिूरी िेने के जलए ैकिार नैह ैोगा। (4) उपजवजनयम (1) के अधीन, उत् पािक संघ की जवद्यमानता के अजस्ट्तत्व के संनंध में सूचना और साक्ष्य प्रस्ट्तुत करने के जलए यदि केवल प्रज्ञापन प्रात ह ैोता ै वैां आयोग आवेिक को पन् रै दिवस से अनजधक की अवजध के भीतर इन जवजनयम की अनुसूची I में यथाजवजनर्िाष् ट सभी सारवान सूचना अंतर्वाष् ट करने वाला जलजखत आवेिन प्रस्ट् तुत करने का जनिेि िेगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (5) िैां आवश् यक िस्ट् तावेि के साथ आवेिन, उपजवजनयम (4) के अधीन जनिेिन की संसूचना की तारीख से पन् रै दिवस के भीतर या आयोग द्वारा जवस्ट् ताठरत की िाने वाली और अवजध के िररान प्राप् त नैह ैोता ै वैां आवेिक की जनम् नतर िाजस्ट्त की मंिूरी के जलए पूर्वाकता जस्ट्थजत और उसके पठरणामी फायिे का समपैरण ैो िाएगा। (6) िन तक दक पैले आवेिक द्वारा प्रस्ट् तुत साक्ष् य का मूल् यांकन न कर जलया िाए, तन तक आयोग द्वारा अगले आवेिन पर जवचार नैह दकया िाएगा। (7) िैां पैले आवेिक को पूर्वाकता जस्ट्थजत का फायिा मंिूर नैह दकया िाता ै , वैां पश् चातवतआ आवेिक आयोग द्वारा पूर्वाकता जस्ट्थजत की मंिूरी के जलए पूर्वाकता के अनुक्रम में ऊपर आ िाएंगे और पैले आवेिक के मामले में दिये गये अनुसार ऊपर जवजैत प्रदक्रया यथावश् यक पठरवतान सजैत लागू ैोगी। (8) जनम् नतर िाजस्ट्त के आवेिन को मंिूर या नामंिूर करने वाले आयोग के जवजनश् चय को आविेक को संसूजचत दकया िाएगा। जनम् नतर िाजस्ट्त में वृजधि की मंिूरी के जलए प्रदक्रया 7. (1) जनम् नतर िाजस्ट्त में वृजधि की मंिूरी के प्रयोिन के जलए, आवेिक या उसका प्राजधकृत प्रजतजनजध अनुसूची में इन जवजनयम की अनुसूची II में यथाजवजनर्िाष् ट सभी सारवान सूचना अंतर्वाष् ट करने वाला कोई आवेिन कर सकेगा या वै दकसी नव प्रकटीकृत उत् पािक संघ की जवद्यमानता के संनंध में सूचना और साक्ष् य प्रस्ट् तुत करने के जलए पिाजभजैत प्राजधकारी को स्ट् वत: आकर या ई-मेल या फ क् स के मा्‍ यम से सूजचत कर सकेगा। तत् पश् चात, पिाजभजैत प्राजधकारी िस काया दिवस के भीतर जवषय को जवचाराथा आयोग के समि रखेगा। परंतु यै दक जनम् नतर िाजस्ट्त में वृजधि की मंिूरी के जलए जवजनयम 7 के उपजवजनयम (1) के अधीन आवेिन, आयोग द्वारा पैले उत् पािक संघ में अजधजनयम की धारा 26 के अधीन मैाजनिेिक की अन् वेषण ठरपोटा प्रात ह ैोने से पूवा दकसी भी समय पर दकया िा सकेगा। परंतु यै भी दक नव प्रकटीकृत उत् पािक संघ के संनंध में जनम् नतर िाजस्ट्त में वृजधि के एक से अजधक मामले में, आयोग जनम् नतर िाजस्ट्त में वृजधि की मंिूरी के जलए अगले या पश् चातवतआ आविेक(क ) के आवेिन का तन तक परीिण नैह करेगा जलए अगले या नाि के आवेिक के आवेिन की िांच नैह करेगा, िन तक जनम् नतर िाजस्ट्त में वृजधि के पैले आवेिक का आवेिन, आयोग द्वारा नामंिूर न कर दिया गया ैो। (2) आयोग द्वारा आवेिन की प्राजत ह की तारीख और समय वै तारीख और समय ै गे जिन् ैें पिाजभजैत प्राजधकारी द्वारा अजभजलजखत दकया िाए या िो पिाजभजैत प्राजधकारी के सरवर या फ जक्समाइल प्रेषण मिीन पर अजभजलजखत ैो। (3) आयोग पैले उत् पािक संघ के संनंध में जनम् नतर िाजस्ट्त में वृजधि , एवं साथ-साथ नव प्रकटीकृत उत् पािक संघ के संनंध में जनम् नतर िाजस्ट्त के जलए उस पर आवेिक की पूर्वाकता जस्ट्थजत को जचजन्ैत करेगा और पिाजभजैत प्राजधकारी उसकी संसूचना डॉक या ई-मेल या फ क् स के मा्‍ यम से आवेिक को प्रेजषत करेगा दक ‘समुजचत पूर्वाकता जस्ट्थजत जचजन्ैत कर ली गई ै ’, और यै दक वै मात्र उस आधार पर जनम् नतर िाजस्ट्त में वृजधि और/या जनम् नतर िाजस्ट्त की मंिूरी िेने के जलए ैकिार नैह ैोगा। (4) उपजवजनयम (1) के अधीन, नव प्रकटीकृत उत् पािक संघ की जवद्यमानता के अजस्ट्तत्व के संनंध में सूचना और साक्ष्य प्रस्ट्तुत करने के जलए यदि केवल प्रज्ञापन प्रात ह ैोता ै वैां आयोग, आवेिक को पन् रै दिवस से अनजधक की अवजध के भीतर इन जवजनयम की अनुसूची II में यथाजवजनर्िाष् ट सभी सारवान सूचना अंतर्वाष् ट करने वाला जलजखत आवेिन प्रस्ट् तुत करने का जनिेि िेगा। (5) िैां आवश् यक िस्ट् तावेि के साथ आवेिन, उपजवजनयम (4) के अधीन जनिेिन की संसूचना की तारीख से पन् रै दिवस के भीतर या आयोग द्वारा जवस्ट् ताठरत की िाने वाली और अवजध के िररान प्राप् त नैह ैोता ै वैां पैले उत् पािक संघ के संनंध में जनम् नतर िाजस्ट्त में वृजधि एवं नव प्रकटीकृत उत् पािक संघ के संनंध में जनम् नतर िाजस्ट्त िोन के जलए आवेिक की पूर्वाकता जस्ट्थजत के साथ उनके संनंजधत पठरणामी फायिे का समपैरण ैो िाएगा। (6) िैां आयोग द्वारा पैले आवेिक को ‘जनम् नतर िाजस्ट्त में वृजधि ’ का फायिा मंिूर नैह दकया िाता ै , वैां पश् चातवतआ आवेिक(गण), यदि कोई ैो/ै , आयोग द्वारा पैले उत् पािक संघ के संनंध में ‘जनम् नतर िाजस्ट्त में वृजधि ’ जस्ट्थजत की [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 मंिूरी के जलए पूर्वाकता जस्ट्थजत के अनुक्रम में िांच की िाएगी और पैले आवेिक के मामले में दिये गये अनुसार ऊपर जवजैत प्रदक्रया यथावश् यक पठरवतान सजैत लागू ैोगी। (7) जनम् नतर िाजस्ट्त में वृजधि के आवेिन को मंिूर या नामंिूर करने वाले आयोग के जवजनश् चय को आविेक को संसूजचत दकया िाएगा। गोपनीयता 8. (1) भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 में अंतर्वाष् ट दकसी नात के ैोते ुए भी, आयोग या मैाजनिेिक आवेिक की पैचान या उससे प्राप् त सूचना को गोपनीय मानेगा और तन तक ऐसी पैचान या सूचना को प्रकट नैह करेगा िन तक दक,— (क) आविेक की पैचान; और (ख) आविेक द्वारा जवजनयम 6 और/या जवजनयम 7 के अधीन िी गई सूचना, िस्ट् तावेि और साक्ष् य: परंतु यै दक आवेिक की पैचान या ऐसी सूचना या िस्ट् तावेि या साक्ष् य का प्रकटन दकया िा सकेगा यदि,— (i) प्रकटन जवजध द्वारा अपेजित ैो; या (ii) आवेिक ने जलजखत में ऐसे प्रकटन के प्रजत सैमजत िी ैो; या (iii) आवेिक द्वारा कोई लोक प्रकटन दकया गया ैो। परंतु यै भी दक िैां मैाजनिेिक अन् वेषण के प्रयोिन के जलए दकसी पि को, यथाजस्ट्थजत, जवजनयम 6 या जवजनयम 7 के अधीन प्रस्ट् तुत सूचना, िस्ट्तावेि और साक्ष्य का प्रकटन करना आवश्यक समझता ै और आवेिक ने ऐसे प्रकटन के जलए सैजम त नैह िी ै , वैां मैाजनिेिक जलजखत में कारण को लेखनधि करके और आयोग का पूवा अनुमोिन करने के पश् चात, ऐसे पिकार को ऐसी सूचना, िस्ट्तावेि और साक्ष् य का प्रकटन कर सकेगा। (2) उपयुाक् त जवजनयम 6 और 7 के अधीन, पंरै दिवस की अवजध के भीतर या आयोग द्वारा जवस्ट् ताठरत की िाने वाली और अवजध के िररान आयोग के समि दकये गये प्रस्ट्तुतीकरण जसवाय, जनम् नतर िाजस्ट्त और/या जनम् नतर िाजस्ट्त में वृजधि के आविेक द्वारा मैाजनिेिक के समि दकये गये और सभी प्रस्ट् तुजतकरण की गोपनीयता, भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जवजनयम, 2009 के जवजनयम 35 के उपनंध के जननधन के अनुसार िाजसत ैोगी। िस्ट्तावेि का जनरीिण और प्रमाजणत प्रजतयां 9.(1) जवजनयम 8 के अधीन गोपनीयता में दकसी नात के ैोत ुए भी, भारतीय प्रजतस्ट्पधाा आयोग (साधारण) जवजनयम, 2009 के जवजनयम 37 के उपजवजनयम (1), (3) और (4) के उपनंध और जवजनयम 50 के उपनंध, उस सीमा तक जिस तक उनका प्रमाजणत प्रजतय के जनरीिण और प्रिान करने का संनंध ै , मैाजनिेिक के जनष्कषों से अंतर्वाष् ट करने वाली ठरपोटा की प्रजत को आयोग द्वारा संनधि पिकार को अग्रेजषत करने के पश् चात जवजनयम 6 के अधीन आवेिक द्वारा प्रस्ट् तुत सूचना, िस्ट्तावेि और साक्ष्य के ग र-गोपनीय पाि को लागू ैो िाएंगे। (2) जवजनयम 8 के अधीन गोपनीयता में दकसी नात के ैोत ुए भी, भारतीय प्रजतस्ट्पधाा आयोग (साधारण) जवजनयम, 2009 के जवजनयम 37 के उपजवजनयम (1), (3) और (4) के उपनंध और जवजनयम 50 के उपनंध, उस सीमा तक जिस तक उनका प्रमाजणत प्रजतय के जनरीिण और प्रिान करने का संनंध ै , मैाजनिेिक के जनष्कषों से अंतर्वाष् ट करने वाली ठरपोटा की प्रजत को आयोग द्वारा िूसरे उत् पािक संघ में संनधि पिकार को अग्रेजषत करने के पश् चात जवजनयम 7 के अधीन आवेिक द्वारा प्रस्ट् तुत सूचना, िस्ट्तावेि और साक्ष्य के ग र-गोपनीय पाि को लागू ैो िाएंगे। (3) इस जवजनयम के अधीन प्रमाजणत प्रजतय का जनरीिण करने या अजभप्रात ह करने वाला कोई पिकार, ऐसी सूचना, िस्ट् तावेि और साक्ष् य का प्रकटन नैह करेगा िो अजधजनयम के अधीन कायावाजैय से जभन् न इस तरै अजभप्रात ह दकये गये ै । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] प्रत्याैरण 10.(1) आवेिक आयोग द्वारा संनंजधत मामले में अजधजनयम की धारा 26 के अधीन अन् वेषण ठरपोटा की प्राजत ह से पूवा, दकसी भी समय पर, यथाजस्ट्थजत, जवजनयम 6 और/या जवजनयम 7 के अधीन आवेिन का प्रत् याैरण कर सकेगा। (2) िैां आवेिक, यथाजस्ट्थजत, जवजनयम 6 और/या जवजनयम 7 के अधीन आवेिन का प्रत् याैरण करता ै वैां मैाजनिेिक या आयोग आवेिक द्वारा प्रस्ट्तुत कोई सूचना या साक्ष् य या िस्ट्तावेि का, उसकी स्ट् वीकृजत के जसवाय, अजधजनयम के प्रयोिन के जलए उपयोग करने के जलए स्ट्वतंत्र ैोगा। कठिनाई का जनवारण 11. इन जवजनयम के जनवाचन या कायाान् वयन के जवषय में यदि कोई संिेै या कठिनाई उिभूत ैोती ै तो उसे आयोग के समि रखा िाएगा और उस पर आयोग का जवजनश् चय आनधि कर ैोगा। जनरसन और ्‍ यावृजायां 12. (1) भारतीय प्रजतस्ट्पधाा आयोग (जनम् नतर िाजस्ट्त) जवजनयम, 2009, उस तारीख से जनरस्ट्त ैो िाएंगे जिस तारीख को ये प्रवृत् त ै गे। (2) ऐसे जनरसन दकसी नात के ैोते ुए भी – (क) ऐसे जनरसन से पूवा, जनरजसत दकये गये जवजनयम के अधीन, दकया गया कुछ भी या की गई या दकया िाना या की गई तात् पर्यात कोई कारावाई, या कोई कायावाैी या जवजनश् चय, आरंभ की गई िांच या आरंभ दकया गया अन् वेषण, इन जवजनयम के तत् स्ट् थानी उपनंध के अधीन दकया िाना या दकया गया समझा िाएगा; (ख) जनरजसत जवजनयम का प्रवतान या तिधीन जवजधवत दकया गया या भुक् त कुछ भी, तिधीन अर्िात, प्रोद्भूत या उपगत कोई अजधकार, जविेषाजधकार, ना्‍ यता या िाजयत्व, या तिधीन घठटत कोई अन् वेषण, जवजधक कायावाैी या उपचार अप्रभाजवत रैेंगे मानो जनरजसत जवजनयम कभी जनरजसत ैी न दकए गए ै ; (ग) भारतीय प्रजतस्ट्पधाा आयोग (जनम् नतर िाजस्ट्त) जवजनयम, 2009 के जनरसन के पश् चात, आयोग द्वारा िारी कोई जवजनयम, जनिेि या जवजनश् चय में सजैत कोई प्रजतजनि ि, इन जवजनयम के तत् स्ट् थानी उपनंध का प्रजतजनि ि ै ोना समझा िाएगा। अनुसूची I आवेिन की अंतवास्ट् तु [जवजनयम 6 के उपजवजनयम (1) और (4) िेखें] जनम् नतर िाजस्ट्त के जलए आविेन में, अन् य नात के साथ-साथ जनम् नजलजखत सजम्मजलत ै गे, अथाात्: - (क) आवेिक या उसके प्राजधकृत प्रजतजनजध और साथ ैी उत् पािक संघ के अन् य सभी उद्यम का नाम और पता; (ख) उस ििा में िैां आवेिक भातर से नाैर रैता ै यैां संसूचना के जलए भारत में पता जिसके अंतगात टेलीफोन नंनर और ई-मेल पता आदि ै ; (ग) अजभकजथत उत् पािक संघ ्‍ यवस्ट् था का एक ब् यररेवार वणान, जिसमें इसके लक्ष् य और उ्ेश् य तथा ऐसे लक्ष् य और उ्ेश् य की पूर्ता के जलए दकये गये दक्रयाकलाप और कृत् य के ब् यररे सजम्मजलत ै गे; (घ) उत् पािक संघ में आवेिक की भूजमका और जवजनयम 2 के उपजवजनयम (1)(ख) के जननंधन के अनुसार उसकी स्ट् वीकृजत; (ङ) अंतवाजलत माल या सेवाएं; (च) सजम्मजलत ैोने वाले भरगोजलक नािार; (छ) उत् पािक संघ का प्रारंभ और उसकी समायावजध; [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9 (ि) अजभकजथत उत् पािक संघ से प्रभाजवत कारनार की प्राक् कजलत मात्रा; (झ) ऐसे सभी ्‍ यजतियय के, िो आवेिक की िानकारी में अजभकजथत उत् पािक संघ से सैनधि ैैं या रैे ैें और इसके अंतगात ऐसे ्‍ यजि भी ैैं िो आवेिक की रर से उसमें सजम्मजलत रैे ैैं, नाम, ै जसयत, कायाालय के अवस्ट् थान और िैां कैह आवश् यक ैो घर के पते; (ञ) ऐसे अन् य प्रजतस्ट् पधाा अजधकारी, मंच या न् यायालय के, यदि कोई ै , ब् यररे जिनसे अजभकजथत उत् पािक संघ के संनंध में संपका दकया गया ै या संपका करने का आिय ै ; (ट) आवेिक द्वारा अजधजनयम के उपनंध के कोई पूवावतआ उल्लंघन या अजधजनयम के उपनंध के अजभकजथत उल्लंघन के जलए आयोग के समि आवेिक के जवरुधि अजनणआत कोई कायावाैी के ब् यररे; (ि) जनम् नतर िाजस्ट्त के जलए आविेन के समथान में उपलब् ध कराए िाने वाले साक्ष् य की प्रकृजत और अंतवास्ट् तु के संनंध में साक्ष् य की ब् यररेवार सूची; और (ड) ऐसी कोई अन् य सारवान िानकारी जिसके संनंध में आयोग द्वारा जनिेि दिया िाए। अनुसूची II आवेिन की अंतवास्ट् तु [जवजनयम 7 के उपजवजनयम (1) और (4) िेखें] जनम् नतर िाजस्ट्त में वजधि के जलए आविेन में, अन् य नात के साथ-साथ जनम् नजलजखत सजम्मजलत ै गे, अथाात्: - क. आवेिक या उसके प्राजधकृत प्रजतजनजध का नाम, ईमेल, संपका सूत्र और पता; ख. चल रैे जवषय या मामला(मामले) के ब् यररे जिसमें आवेिकन ने पैले ैी कोई पूर्वाकता जस्ट्थजत अजभप्राप् त की ै ; ग. अनुसूची I में मांगे गए ब् यररे के अनुसार नव प्रकटीकृत उत् पािक संघ से संनंजधत प्रकटन (िो मूल प्रजतयां); घ. क्या उपयुाक् त (ख) और (ग) में जनर्िाष् ट आचरण या उत्पाि या सेवा या पिकार या जवषय के नीच कोई समानता जवद्यमान ै , तत् संनंधी ब् यररे के साथ; ङ. उपयुाक् त जवषय-बनंिु (ख) और (ग) में दकए गए प्रकटन के िृजि गत यै औजचत् य दक नव प्रकटीकृत उत् पािक संघ क से नया ै या पैले के उत् पािक संघ क से अलग उत् पािक संघ यवसवस्ट्था ै ; और ग. कोई अन्य सरवान िानकारी। अनुपमा आनंि, सजचव [जवज्ञापन-III/4/असा./759/2023-24] THE COMPETITION COMMISSION OF INDIA NOTIFICATION New Delhi, the 20th February, 2024 THE COMPETITION COMMISSION OF INDIA (LESSER PENALTY) REGULATIONS, 2024 (NO.02 OF 2024) No. L-3(4)/Reg-L.P./2023-24.—In exercise of the powers conferred by sub- section (1) and clauses (ga), (gb) and (gc) of sub-section (2) of section 64, read with section 46 and clause (b) of section 27 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations, namely: - SHORT TITLE AND COMMENCEMENT 1. (1) These regulations may be called the Competition Commission of India (Lesser Penalty) Regulations, 2024. 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) They shall come into force on the date of their publication in the Official Gazette. DEFINITIONS 2. (1) In these regulations, unless the context otherwise requires, – (a) “Act” means the Competition Act, 2002 (12 of 2003) as amended from time to time; (b) “admission” means statement or submission by a party that it has indulged in the alleged violation of the provisions of Section 3 of the Act; (c) “applicant” means an enterprise, as defined in clause (h) of section 2 of the Act, who is or was a member of a cartel and includes an individual who has been involved in the cartel on behalf of an enterprise; and further includes an enterprise or association of enterprises or a person or association of persons, though not engaged in identical or similar trade if it participates or intends to participate in furtherance of such cartel and submits an application for lesser penalty and/or lesser penalty plus to the Commission; (d) “cartel” means a cartel as defined in clause (c) of section 2 of the Act; (e) “Commission” means the Competition Commission of India established under sub-section (1) of section 7 of the Act; (f) “designated authority” means an officer of the Commission who is authorized by the Chairperson to function as such, for the purpose of these regulations; (g) “Director General” means the Director General as defined in clause (g) of section 2 of the Act; (h) “newly disclosed cartel” means a cartel as determined by the Commission having regard to the disclosures provided by the applicant in Schedule I and Schedule II of these regulations, including the material available with the Commission or the Director General, which enables the Commission to form a prima facie opinion under sub section (1) of section 26 of the Act; (i) “party” includes an enterprise or person defined in clauses (h) and (l) of section 2 of the Act, respectively, against whom inquiry or proceeding is instituted and shall include the Central Government, any State Government or any statutory authority and shall also include any person permitted to join the proceedings; (j) “priority status” means the position of the applicant marked for giving the benefit of lesser penalty or lesser penalty plus in the queue of the applicants; (k) “vital disclosure” means full and true disclosure of information or evidence by the applicant to the Commission, which is sufficient to enable the Commission to form a prima facie opinion about the existence of a cartel or which helps to establish the contravention of the provisions of section 3 of the Act. (2) Words and expressions used but not defined in these regulations shall have the same meanings respectively as assigned to them in the Act or the rules or regulations framed thereunder or in the Companies Act, 2013 (18 of 2013). CONDITIONS FOR LESSER PENALTY OR LESSER PENALTY PLUS 3. (1) An applicant, seeking the benefit of lesser penalty or lesser penalty plus under section 46 of the Act, shall- (a) cease to have further participation in the cartel from the time of its disclosure unless otherwise directed by the Commission; (b) provide vital disclosure in respect of alleged contravention of the provisions of section 3 of the Act; (c) provide all relevant information, documents and evidence as may be required by the Commission; (d) co-operate genuinely, fully, continuously and expeditiously throughout the investigation and other proceedings before the Commission; (e) not conceal, destroy, manipulate or remove the relevant documents in any manner that may contribute to the establishment of a cartel; and (f) not give any false evidence or omit to submit any material information knowing it to be material. (2) The applicant shall provide the names of the individuals who have been involved in the cartel on its behalf and for whom lesser penalty or lesser penalty plus, as the case may be, is sought by the applicant. (3) Where an applicant or its authorized representative, at the time of filing of application for lesser penalty or lesser penalty plus, as the case may be, fails to provide full and true disclosure of the information and evidence as referred and described in Schedule I or Schedule II or both or as required by the Commission from time to time, [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 the Commission may reject its application. (4) Without prejudice to sub-regulation (1), the Commission may subject the applicant to further restrictions or conditions, as it may deem fit, after considering the facts and circumstances of the case. (5) Where an applicant or its authorized representative fails to comply with the conditions mentioned in sub- regulations (1) and (4), either before the Director General or before the Commission after receipt of the investigation report, the Commission may reject its application. (6) Before rejecting the lesser penalty or lesser penalty plus application of the applicant under this regulation, the Commission shall provide an opportunity of being heard to such applicant. (7) Notwithstanding rejection of application in terms of sub-regulations (3) or (5) above, the Commission or the Director General shall be free to use the information, documents and evidence submitted by the applicant, in the ongoing matter, in accordance with the provisions of section 46 of the Act. (8) Upon rejection of application in terms of sub-regulations (3) or (5) above, the applicant may be subjected to inquiry for the contravention. (9) The discretion of the Commission, in regard to reduction in monetary penalty under these regulations, shall be exercised having due regard to – (a) the stage at which the applicant comes forward with the disclosure; (b) the evidence already in possession of the Commission; (c) the quality of the information provided by the applicant; (d) fulfilment of conditions specified in sub-regulation (1) and (4) above; and (e) the entire facts and circumstances of the case. GRANT OF LESSER PENALTY 4. Subject to the conditions laid down in regulation 3, the applicant and individual(s) mentioned in sub-regulation 2 of regulation 3 shall be granted benefit of lesser penalty on the amount leviable under clause (b) of section 27 and section 48 of the Act, as the Commission may decide, in the following manner, namely:— (a) The applicant and individual(s) mentioned in sub-regulation (2) of regulation 3 may be granted benefit of reduction in penalty upto or equal to one hundred percent, if the applicant is the first to make a vital disclosure by submitting evidence of a cartel, enabling the Commission to form a prima facie opinion regarding the existence of a cartel which is alleged to have contravened the provisions of section 3 of the Act and the Commission did not, at the time of application, have sufficient evidence to form such an opinion: Provided that the Commission may also grant benefit of reduction in penalty up to or equal to one hundred per cent, to the applicant and individual(s) mentioned in sub-regulation (2) of regulation 3, if the applicant is the first to make a vital disclosure by submitting such evidence which establishes the contravention of the provisions of section 3 of the Act, by a cartel, in a matter under investigation and the Commission, or the Director General did not, at the time of application, have sufficient evidence to establish such a contravention. (b) The applicant(s) and individual(s) who are subsequent to the first applicant may also be granted benefit of reduction in penalty on making a disclosure by submitting evidence, which in the opinion of the Commission, provides significant added value to the evidence already in possession of the Commission or the Director General, as the case may be, to establish the existence of the cartel, which is alleged to have contravened the provisions of section 3 of the Act. Explanation — For the purposes of these regulations, ‘significant added value’ means the extent to which the evidence provided enhances the ability of the Commission or the Director General, as the case may be, to establish the existence of a cartel, which is alleged to have contravened the provisions of section 3 of the Act. (c) The reduction in monetary penalty referred to in clause (b) shall be in the following order— (i) the applicant and individual(s) mentioned in sub-regulation (2) of regulation 3 marked as second in the priority status may be granted reduction of monetary penalty up to or equal to fifty percent of the penalty imposed; and (ii) the applicant and individual(s) mentioned in sub-regulation (2) of regulation 3 marked as third or subsequent in the priority status may be granted reduction of penalty up to or equal to thirty percent of the penalty imposed. 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] GRANT OF LESSER PENALTY PLUS 5. (1) In terms of sub-section (4) of section 46 of the Act and subject to the conditions laid down in regulations 3 and 4, an applicant, who had earlier made a full, true and vital disclosure in respect of alleged contravention of provisions of section 3 of the Act under regulation 6 (first cartel), makes a full, true and vital disclosure in respect of existence of another cartel (second cartel) in which it is alleged to have violated section 3 of the Act, which enables the Commission to form a prima facie opinion regarding the existence of newly disclosed cartel under sub-section (1) of section 26 of the Act, may be granted an additional reduction in monetary penalty up to or equal to thirty per cent of the penalty imposed with regard to the first cartel besides obtaining benefit of reduction in penalty up to or equal to one hundred percent in respect of newly disclosed cartel in terms of sub-section (1) of section 46 of the Act. Illustration: In respect of Cartel A, X and Y are lesser penalty applicants having first and second marker status with reduction in penalty available of up to or equal to one hundred percent and fifty percent, respectively. Y, being aware of Cartel B, reports about it under regulation 7. Subject to fulfilment of requisite conditions, for reporting Cartel B, Y shall be eligible for additional reduction in penalty of up to or equal to thirty percent in respect of Cartel A, besides obtaining first marker status in respect of Cartel B. Provided that the individual(s) of such applicant who were part of its lesser penalty application in the first cartel may also be granted the benefit of lesser penalty plus as applicable to the applicant, if such individual(s) are also a part of both the newly disclosed cartel and the lesser penalty plus application filed in that regard. (2) While determining the newly disclosed cartel in terms of sub-section (4) of section 46 of the Act, the Commission may have due regard to all relevant factors that distinguish the newly disclosed cartel from the existing cartel. (3) The discretion of the Commission, in regard to reduction in monetary penalty under regulation 5, shall be exercised having due regard to- a) likelihood of the newly disclosed cartel being detected by the Commission or the Director General without lesser penalty plus application, and b) any other factor deemed relevant by the Commission. PROCEDURE FOR GRANT OF LESSER PENALTY 6. (1) For the purpose of grant of lesser penalty, the applicant or its authorized representative may make an application containing all the material information as specified in the Schedule I of these regulations, or may intimate in writing either in person or through e-mail or fax, to the designated authority, for furnishing the information and evidence relating to the existence of a cartel. The designated authority shall, thereafter, within ten working days, put up the matter before the Commission for its consideration. Provided that an application under sub regulation (1) of regulation 6 for grant of lesser penalty can be made at any time during inquiry but not after the report of investigation directed under section 26 of the Act has been received by the Commission. (2) The date and time of receipt of the application by the Commission shall be the date and time as recorded by the designated authority or as recorded on the server or the facsimile transmission machine of the designated authority. (3) The Commission shall thereupon mark the priority status of the applicant and the designated authority shall convey to the applicant through post or e-mail or fax that the ‘appropriate priority status has been marked’, and that it shall not entitle the applicant for grant of lesser penalty merely on that basis. (4) If only an intimation is received under sub-regulation (1) for furnishing the information and evidence relating to existence of a cartel, the Commission shall direct the applicant to submit a written application containing all the material information as specified in the Schedule I of these regulations within a period not exceeding fifteen days. (5) Where the application, along with the necessary documents, is not received within a period of fifteen days from the date of communication of direction under sub-regulation (4) or during the further period as may be extended by the Commission, the priority status of the applicant and consequent benefit of grant of lesser penalty shall stand forfeited. (6) Unless the evidence submitted by the first applicant has been evaluated, the next applicant shall not be evaluated by the Commission. (7) Where the benefit of the priority status is not granted to the first applicant, the subsequent applicants shall move up in order of priority for grant of priority status by the Commission and the procedure prescribed above, as [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 in the case of first applicant, shall apply mutatis mutandis. (8) The decision of the Commission of granting or rejecting the application for lesser penalty shall be communicated to the applicant. PROCEDURE FOR GRANT OF LESSER PENALTY PLUS 7. (1) For the purpose of grant of lesser penalty plus, the applicant or its authorized representative may make an application containing all the material information as specified in the Schedule II to these regulations, or may intimate in writing either in person or through e-mail or fax, to the designated authority for furnishing the information and evidence relating to the existence of a newly disclosed cartel. The designated authority shall, thereafter, within ten working days, put up the matter before the Commission for its consideration. Provided that an application under sub regulation (1) of regulation 7 for grant of lesser penalty plus can be made at any time before the receipt of investigation report of the Director General under section 26 of the Act in the first cartel by the Commission. Provided further that in case of more than one applicant for lesser penalty plus in respect of a newly disclosed cartel, the Commission shall not examine the application of the next or subsequent applicant(s) for grant of the lesser penalty plus, unless the application of the first lesser penalty plus applicant has been rejected by the Commission. (2) The date and time of receipt of the application by the Commission shall be the date and time as recorded by the designated authority or as recorded on the server or the facsimile transmission machine of the designated authority. (3) The Commission shall thereupon mark the priority status of the applicant, for lesser penalty plus in respect of the first cartel, and simultaneously for lesser penalty in respect of the newly disclosed cartel, and the designated authority shall convey to the applicant through post or e-mail or fax that the ‘appropriate priority status has been marked’, and that it shall not entitle the applicant for grant of lesser penalty plus and/or lesser penalty merely on that basis. (4) If only an intimation is received under sub-regulation (1) for furnishing the information and evidence relating to the existence of a newly disclosed cartel, the Commission shall direct the applicant to submit a written application containing all the material information as specified in the Schedule II to these regulations within a period not exceeding fifteen days. (5) Where the application, along with the necessary documents, is not received within a period of fifteen days from the date of communication of direction under sub-regulation (4) or during the further period as may be extended by the Commission, the priority status of the applicant both for lesser penalty plus in respect of the first cartel and for lesser penalty in respect of the newly disclosed cartel along with their respective consequent benefits, shall stand forfeited. (6) Where the benefit of the ‘lesser penalty plus’ is not granted to the first applicant by the Commission, the subsequent applicant(s), if any, shall be examined by the Commission in order of their priority status for grant of ‘lesser penalty plus’ status in respect of the first cartel and the procedure prescribed above, as in the case of first applicant, shall apply mutatis mutandis. (7) The decision of the Commission of granting or rejecting the application for lesser penalty plus shall be communicated to the applicant. CONFIDENTIALITY 8. (1) Notwithstanding anything contained in the Competition Commission of India (General) Regulations, 2009, the Commission or the Director General shall treat as confidential,— (a) the identity of the applicant; and (b) the information, documents and evidence furnished by the applicant under regulation 6 and/or regulation 7: Provided that the identity of the applicant or such information or documents or evidence may be disclosed if,— (i) the disclosure is required by law; or (ii) the applicant has agreed to such disclosure in writing; or (iii) there has been a public disclosure by the applicant Provided further that where the Director General deems it necessary to disclose the information, documents and evidence furnished under regulation 6 or regulation 7, as the case may be, to any party for the purposes of investigation and the applicant has not agreed to such disclosure, the Director General may disclose such information, documents and evidence to such party for reasons to be recorded in writing and after taking prior approval of the Commission. 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) Except submissions made before the Commission under regulations 6 and 7 above within a period of fifteen days or during the further period as may be extended by the Commission, confidentiality of all further submissions made by the lesser penalty and/ or lesser penalty plus applicant before the Director General shall be governed in terms of provisions of regulation 35 of Competition Commission of India (General) Regulations, 2009. INSPECTION AND CERTIFIED COPIES OF DOCUMENTS 9. (1) Notwithstanding the confidentiality under regulation 8, the provisions of sub- regulations (1), (3) and (4) of regulation 37 and the provisions of regulation 50 of the Competition Commission of India (General) Regulations, 2009, to the extent it relates to inspection and grant of certified copies, shall become applicable to the non-confidential version of the information, documents and evidence furnished by the applicant under regulation 6, after the Commission forwards a copy of the report containing the findings of the Director General to the party concerned. (2) Notwithstanding the confidentiality under regulation 8, the provisions of sub- regulations (1), (3) and (4) of regulation 37 and the provisions of regulation 50 of the Competition Commission of India (General) Regulations, 2009, to the extent it relates to inspection and grant of certified copies, shall become applicable to the non- confidential version of the information, documents and evidence furnished by the applicant under regulation 7 in the second cartel, after the Commission forwards a copy of the report containing the findings of the Director General to the party concerned in the second cartel. (3) Any party conducting inspection or obtaining certified copies under this regulation shall not disclose such information, documents and evidence so obtained other than for the proceedings under the Act. WITHDRAWAL 10. (1) The applicant may withdraw the application under regulation 6 and/or regulation 7, as the case may be, any time prior to the receipt of the report of investigation, under section 26 of the Act in the concerned matter, by the Commission. (2) Where the applicant withdraws application under regulation 6 and/or regulation 7, as the case may be, the Director General or the Commission shall be at liberty to use for the purposes of the Act any information or evidence or document submitted by the applicant except its admission. REMOVAL OF DIFFICULTY 11. In the matter of interpretation or implementation of the provisions of these regulations, if any doubt or difficulty arises, the same shall be placed before the Commission and the decision of the Commission thereon, shall be binding. REPEAL AND SAVINGS 12. (1) The Competition Commission of India (Lesser Penalty) Regulations, 2009, stand repealed from the date on which these regulations come into force. (2) Notwithstanding such repeal – (a) anything done or any action taken or purported to have been done or taken, or any proceedings or decision, inquiry or investigation commenced under the repealed regulations, prior to such repeal, shall be deemed to have been done or taken under the corresponding provisions of these regulations; (b) the operation of the repealed regulations or anything duly done or suffered thereunder, any right, privilege, obligation or liability acquired, accrued or incurred thereunder, or any investigation, legal proceeding or remedy ensued thereunder, shall remain unaffected as if the repealed regulations have never been repealed; (c) after the repeal of the Competition Commission of India (Lesser Penalty) Regulations, 2009, any reference thereto including in any regulations, direction or decision issued by the Commission shall be deemed to be a reference to the corresponding provisions of these regulations. SCHEDULE I CONTENTS OF THE APPLICATION [See sub-regulations (1) and (4) of regulation 6] The application for lesser penalty shall, inter alia, include the following, namely: - (a) name, email, contact number and address of the applicant or its authorized representative as well as of all other enterprises in the cartel; [भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 (b) in case the applicant is based outside India, the address of the applicant in India for communication including the telephone numbers and the e- mail address, etc.; (c) a detailed description of the alleged cartel arrangement, including its aims and objectives and the details of activities and functions carried out for securing such aims and objectives; (d) the role of the applicant in the cartel and admission in terms of sub-regulation (1)(b) to regulation 2; (e) the goods or services involved; (f) the geographic market covered; (g) the commencement and duration of the cartel; (h) the estimated volume of business affected in India by the alleged cartel; (i) the names, positions, office locations and, wherever necessary, home addresses of all individuals who, in the knowledge of the applicant, are or have been associated with the alleged cartel, including those individuals which have been involved on behalf of the applicant; (j) the details of other Competition Authorities, forums or courts, if any, which have been approached or are intended to be approached in relation to the alleged cartel; (k) details of any previous contravention of the provisions of the Act by the applicant or any proceeding pending against the applicant before the Commission for alleged violation of provisions of the Act; (l) a descriptive list of evidence regarding the nature and content of evidence provided in support of the application for lesser penalty; and (m) any other material information as may be directed by the Commission. SCHEDULE II CONTENTS OF THE APPLICATION [See sub-regulations (1) and (4) of regulation 7] The application for lesser penalty plus shall, inter alia, include the following, namely:- (a) name, email, contact number and address of the applicant or its authorized representative; (b) details of the ongoing matter or case(s) in which the applicant has already obtained any priority status; (c) disclosures pertaining to newly disclosed cartel as per the details sought in Schedule I (two original copies); (d) whether there exists any similarity between the conduct or product or service or parties or matter referred to in (B) and (C) above, along with details thereof; (e) justification as to how the newly disclosed cartel is new or separate cartel arrangement from the first cartel in view of disclosure made in point (B) and (C) above; and (f) any other material information.
