(i) All Dy.CLC(C) are advised to take necessary action in -compliance of the above 'notificaiion ,nd accordingly examine the Failure of Conciliation repofi submitted by RLC/ALCILEOs post 17.03.2023 i.e, date of notification properly and if the same is found to be fit for adjudicatibn then such disputes should be referred to the lndustrial Tribunal/ Labour court having .iurisdiction by issuing a statutory order and tlre copy of the order shall be submitted to Cf_Ctii as weil. The format of reference order is attached as Annexure l' (ii) in' ""u" the dispute is for..rnd not fit for reference for adjudication, the bV.Cf-CtCl shall record and communicate to the parties concerned' its reasons therefore and a copy of the said communication along with all relevant docurnents should be sent to the CLC(C)' 3. '..,1 r.l":', 2 ./' ir (' o) F.No. 25(08y2023-lR Government of lndia Ministry of Labour & Employment Office of the Chief Labour Commissione(C) Shramev Jayate Bhawan, G{, Sector-10, Dwarka, New Delhi Datedt+06.2025 To All Regional Heads Sub: Regarding handling of Failure of Conciliation (FoC) Reports- Clarifications MadamlSir, Since the power to take decision on FoC was delegated to the CLC(C)/Dy.CLC(C) vide Notification No. SO 1263(E) dated 17.03.2A23, this office vide letterof even number (i) dated 05.07.2024, and (ii) dated 04.04.2025 has directed all Dy.CLC(C) about the mechanisms to be followed while handling FoC reports. Since the issue of above notifications, it has however been observed in this office that in several instances where authorities handling FoCs have deviated from the legal provisions. Keeping such deviations in mind, the following are once again clarified to all the Dy.CLC(C)s: (i) As per the above mentioned notifications, the power to take decisions on FoCs is with Dy.CLC(C) of the jurisdiction. The RLC(C), Regional Office of that Region, even if authorized to act as HOO in the absence of the Dy.CLC(C), shall not be competent to take decision on the FoCs submitted to the Dy.CLC(C) by conciliation Officers of that Region. lt is a statutory authority which is delegated to the Dy.CLC(C)s, and not to HOOs, by the Central Government and therefore HOOs can't exercise this vested power. Any such reference/declination order issued by RLC(C) Regional Office shall be unlawful and ultra vires. (ii) lf on consideration of the FOC Reports, the authority i.e. the CLC(C) or the Dy.CLC(C) concerned, as the case may be, is of the opinion that the lndustrial Dispute is not fit for reference, the authority must record and communicate to lhe parties concerned its reasons therefore. in accordance with Section 12(5) of the lndustrial Disputes Act 1947.
