फाइल ं◌ः - A-24014/1/2022-MED-VI (ई4936-)   िदनांक - __.12.2025 OFFICE MEMORANDUM / कायालय ापन Subject: Seeking Options from absorbed employees in nursing cadre regarding Institutional or All India Seniority and service liability – Regarding. िवषय: संथागत या अखल भारतीय वर ता के संबंध म% अ&धकारय' से िवक(प मांगना ।   Consequent upon notification of amended recruitment regulations in nursing cadres vide notification dated 05.12.2020, respective regional seniorities in nursing cadres need to be merged into an all India common Seniority List for each of the nursing cadre. It is observed that there are court cases filed by absorbed nursing employees in some of the regions in regard to institutional seniority. All such regional seniority lists shall carry a caveat rendering a revision of the seniority list subject to outcome of these court cases. Wherever any of the regional seniority lists has been challenged and the matter is pending in any court of law, such regional seniority lists as well as the consolidated list shall carry a caveat of revision subject to outcome of the case   Further, in order to resolve the long pending issue relating to institutional seniority in the affected Regions, it has been decided to allow the officials who had earlier opted for institutional seniority an opportunity to exercise and choose from one of the following two options : a. to continue in the institutional seniority, which will debar them from any further promotion, rendering such post as an isolated post, since there are no more institutional vacancies subsequent to reclassification in Group 'B' & 'A', OR b. To opt for the reclassified post with an all India seniority, service and transfer liability, which shall entitle the official to regular promotions and transfers in accordance with the extant Transfer policy of ESIC. A-24014/1/2022-MED-VI I/3359088/2025 In this regard, all Regional Directors, ESIC are directed to obtain the options from each affected official within their jurisdiction and forward the consolidated response to Headquarters Office within next 07 days from the date of issue of this memorandum, clearly indicating the option exercised by each official. Failure to submit the option within the stipulated time shall be treated as deemed acceptance of Option (b), i.e., opting for the reclassified post.
