फा.सं. एसटीडी/एसपी-21/ए-1.2024/एन-01.—खाद्य सुरक्षा और मानक (अल्कोहलिक पेय) संशोधन विनियम, 2024 का प्रारूप, खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का संख्यांक 34) की धारा 92 की उप-धारा (1) की अपेक्षानुसार, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण की अधिसूचना संख्या फाइल संख्या: एसटीडी/एसपी-21/ए-1.2024/एन-01, तारीख 13 जून, 2024 द्वारा भारत के राजपत्र, असाधारण, भाग 3, खंड 4 में प्रकाशित किया गया था, जिसमें प्रभावित होने वाले संभावित सभी व्यक्तियों से उस तारीख से साठ दिनों की अवधि के अंदर आपत्तियां और सुझाव आमंत्रित किए गए थे, जिस तारीख को उक्त अधिसूचना को प्रकाशित करने वाली राजपत्र की प्रतियां जनता को उपलब्ध कराई गई थीं;

और उक्त राजपत्र की प्रतियां 21 जून, 2024 को जनता के लिए उपलब्ध करा दी गई थीं;

और उक्त प्रारूप विनियमों के संबंध में जनता से प्राप्त आपत्तियों और सुझावों पर भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा विचार कर लिया गया है;

अतः अब, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, उक्त अधिनियम की धारा 92 की उप-धारा (2) के खंड (v) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए खाद्य सुरक्षा और मानक (अल्कोहलिक पेय) विनियम, 2018 में और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात: -

विनियम

1. इन विनियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (अल्कोहलिक पेय) दूसरा संशोधन विनियम, 2025 है।

2. ये तारीख 1 जून, 2026 को प्रवृत होंगे।

3. खाद्य सुरक्षा और मानक (अल्कोहलिक पेय) विनियम, 2018 में, सारणी 2 में, “एस्टर एथिल एसीटेट (पूर्ण अल्कोहल का जी/ली) के रूप में व्यक्त किया गया है, अधिकतम” से संबंधित क्रम संख्या 7 के सामने, स्तम्भ (7) के अधीन प्रविष्टि “0.2” अंकों के स्थान पर “3.0” अंक रखे जाएंगे।

टिप्पण: मूल विनियम भारत के राजपत्र, असाधारण, भाग III, खंड 4 में अधिसूचना संख्या फा.सं. 2/एसए-24/2009(1)/एफएसएसएआई, तारीख 19 मार्च, 2018 द्वारा प्रकाशित किए गए थे और तत्पश्चात निम्नलिखित अधिसूचना संख्याओं द्वारा संशोधित किए गए:

1. फा.सं. एसटीडीएस/एसपी (जल और पेय)/अधिसूचना(1)/एफएसएसएआई-2019, तारीख 18 दिसंबर, 2020;
2. फा.सं. एसटीडी/एसपी-21/टी(अल्कोहल-5), तारीख 10 जून, 2022।
3. फा.सं. एसटीडी/एसपी-21/टी(अल्कोहल-4), तारीख 21 अगस्त, 2023 और
4. फा.सं. एसटीडी/एसपी-21/टी(अल्कोहल-6), तारीख 20 जून, 2025.

NOTIFICATION

Mumbai, the 19th November, 2025

F. No. Std/SP-21/A-1.2024/N-01.—Whereas the draft of the Food Safety and Standards (Alcoholic Beverages) Amendment Regulations, 2024, were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide the notification of the Food Safety and Standards Authority of India, number File No.:Std/SP-21/A-1.2024/N-01, dated the 13th June, 2024, in the Gazette of India, Extraordinary, Part III, Section 4, for inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Gazette were made available to the public on the 21st June, 2024;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India.

Now, therefore, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India, hereby makes the following regulations further to amend the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, namely: -

Regulations

1. These regulations may be called the Food Safety and Standards (Alcoholic Beverages) Second Amendment Regulations, 2025.

2. They shall come into force on 01st June, 2026.

3. In the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, in Table 2, against S.No 7 relating to “Esters expressed as ethyl acetate (g/l of absolute alcohol), Max” in the entry under column (7), for the figures “0.2” the figures “3.0” shall be substituted.
