L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण अजधसूचना गांधीनगर, 5 िुलाई, 2021 अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बुजलयन एक्सचेंि) (संिोधन) जिजनयम, 2021 आई.एफ.एस.सी.ए./2021-22/िी.एन./रेग्यु.014.—अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण, अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण अजधजनयम, 2019 की धारा 12 की उपधारा (1) और धारा 13 की उपधारा (1) के साथ पठित धारा 28 की उपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बुजलयन एक्सचेंि) जिजनयम, 2020 का संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता है, अथाात्:- 1. इन जिजनयमों का संजिप्त नाम अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बुजलयन एक्सचेंि) (संिोधन) जिजनयम, 2021 है । 2. ये रािपत्र में उनके प्रकािन की तारीख से प्रिृत्त होंगे । 3. अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बुजलयन एक्सचेंि) जिजनयम, 2020 में, I. जिजनयम 4 के उप-जिजनयम (2) में, “ऐसा कोई जनगजमत जनकाय” िब्दों के स्ट्थान पर “ऐसा कोई जनगजमत” िब्द रखे िाएंगे; II. जिजनयम 6 के उप-जिजनयम (7) में, “जिजनयम 3” िब्द और अंक के स्ट्थान पर “जिजनयम 4” िब्द और अंक रखे िाएंगे; सं. 279] नई ददल्ली, मंगलिार, िुलाई 6, 2021/आषाढ़ 15, 1943 No. 279] NEW DELHI, TUESDAY, JULY 6, 2021/ASHADHA 15, 1943 सी.जी.-डी.एल.-अ.-06072021-228136 CG-DL-E-06072021-228136 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] III. जिजनयम 20 में, (i) उप-जिजनयम (2) के खंड (iii) में, “स्ट्टॉक” िब्द का लोप दकया िाएगा; (ii) उप-जिजनयम (3) में, “प्राजधकरण द्वारा” िब्दों के स्ट्थान पर “ऐसी अन्द्य ितें, िो प्राजधकरण” िब्द रखे िाएंगे और “ऐसी अन्द्य ितें जिजनर्दाष्ट की िा सकेंगी” िब्दों के स्ट्थान पर “जिजनर्दाष्ट करे” िब्द रखे िाएंगे; IV. जिजनयम 21 के उप-जिजनयम (3) में, “स्ट्टॉक” िब्द के स्ट्थान पर “बुजलयन” िब्द रखा िाएगा; V. जिजनयम 31 में, “जिजनयम 3, जिजनयम 5 और जिजनयम 6” िब्दों और अंकों के स्ट्थान पर “जिजनयम 4, जिजनयम 6 और जिजनयम 7” िब्द और अंक रखे िाएंगे; VI. जिजनयम 41 के उप-जिजनयम (2) में, “जिजहत” िब्द के स्ट्थान पर “जिजनर्दाष्ट” िब्द रखा िाएगा; VII. जिजनयम 43 के उप-जिजनयम (1) में, “जिजनयम 43” िब्द और अंक के स्ट्थान पर “जिजनयम 44” िब्द और अंक रखे िाएंगे; VIII. जिजनयम 48 के उप-जिजनयम (1) में, “िो उपबंजधत की िाए” िब्दों के स्ट्थान पर “िो जिजनर्दाष्ट की िाए” िब्द रखे िाएंगे; IX. जिजनयम 52 में, (i) जिजनयम (2) में, “जिजनयम 50” िब्द और अंक के स्ट्थान पर “जिजनयम 51” िब्द और अंक रखे िाएंगे; (ii) उप-जिजनयम (5) में, “प्राजधकरण द्वारा िारी” िब्दों का लोप दकया िाएगा; X. जिजनयम 53 के उप-जिजनयम (4) में, “कृत्यों के बारे में” िब्दों के स्ट्थान पर “अपने कृत्यों के बारे में” िब्द रखे िाएंगे; XI. जिजनयम 58 के पश्चात् जनम्नजलजखत िीषा और जिजनयम अंतःस्ट्थाजपत दकया िाएगा, अथाात्:- “प्रकीणा 59. इन जिजनयमों के, एक ही जिषयिस्ट्तु के संबंध में अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बाजार अिसंरचना संस्ट्था) जिजनयम 2021 के साथ दकसी परस्ट्पर-जिरोध या असंगजत की दिा में अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बाजार अिसंरचना संस्ट्था) जिजनयम, 2021 के उपबंध अजभभािी होंगे ।” इनिेती श्रीजनिास, अध्यि [जिज्ञापन-III/4/असा./144/2021-22] ठटप्पण: अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बुजलयन एक्सचेंि) जिजनयम, 2020, भारत के रािपत्र, असाधारण में अजधसूचना सं. आई.एफ.एस.सी.ए./2020-21/िी.एन./रेग्यु.005 द्वारा तारीख 11 ददसम्बर, 2020 को प्रकाजित दकए गए थे । INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY NOTIFICATION Gandhinagar, the 5th July, 2021 INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY (BULLION EXCHANGE) (AMENDMENT) REGULATIONS, 2021 No. IFSCA/2021-22/GN/REG014.—In exercise of the powers conferred by sub-section (1) of Section 28 read with sub-section (1) of Section 12 and sub-section (1) of Section 13 of the International Financial Services Centres Authority Act, 2019, the International Financial Services Centres Authority hereby makes the following regulations to amend the International Financial Services Centres Authority (Bullion Exchange) Regulations, 2020, namely: - 1. These regulations may be called the International Financial Services Centres Authority (Bullion Exchange) (Amendment) Regulations, 2021. [भागIII—खण् ड 4] भारत का रािपत्र : असाधारण 3 2. They shall come into force on the date of their publication in the Official Gazette. 3. In the International Financial Services Centres Authority (Bullion Exchange) Regulations, 2020, I. in regulation 2, in sub-regulation (1), in clause (l), the word “and” shall be inserted after the word “established” and before the word “recognised”; II. in regulation 4, in sub-regulation (2), the word “Anybody” shall be substituted with the words “Any body”; III. in regulation 6, in sub-regulation (7), the words and figures “regulation 3” shall be substituted with the words and figures “regulation 4”; IV. in regulation 20, (i) in sub-regulation (2), in clause (iii), the word “stock” shall be omitted; (ii) in sub-regulation (3), the word “as” shall be inserted after the word “conditions” and before the word “may”; V. in regulation 21, (i) in sub-regulation (2), the word “stock” shall be substituted with the word “bullion”; (ii) in sub-regulation (3), the word “stock” shall be substituted with the word “bullion”; VI. in regulation 28, in sub-regulation (2), the word “sub-rule” shall be substituted with the word “sub- regulation”; VII. in regulation 31, the figures, words and symbols “3, 5 and 6” shall be substituted with the figures, words and symbols “4, 6 and 7”; VIII. in regulation 41, in sub-regulation (2), the word “prescribed” shall be substituted with the word “specified”; IX. in regulation 43, in sub-regulation (1), the figure “43” shall be substituted with the figure “44”; X. in regulation 48, in sub-regulation (1), the word “provided” shall be substituted with the word “specified”; XI. in regulation 52, (i) in sub-regulation (2), the figure “50” shall be substituted with the figure “51”; (ii) in sub-regulation (5), the words “by the Authority” after the word “registration” shall be omitted; XII. in regulation 53, in sub-regulation (4), the word “the” shall be substituted with the word “its”; XIII. after regulation 58, the following heading and regulation shall be inserted, namely: “Miscellaneous 59.
