विषय: साधारण बीमा पॉलिसियों में विवाचन खंड का संशोधन Re: Amendment of Arbitration Clause in General Insurance policies

भारत के माननीय सर्वोच्च न्यायालय द्वारा दिये गये निर्देश के संदर्भ में आईआरडीएआई ने साधारण बीमा उद्योग में व्यवसाय की विभिन्न व्यवस्थाओं में प्रचलित वर्तमान विवाचन खंड की एक व्यापक समीक्षा की है। हितधारकों के साथ उचित परामर्श करने के उपरांत, आईआरडीएआई का अभिमत है कि वर्तमान विवाचन खंड का विस्तार सीमित है तथा इसका संशोधन करने की आवश्यकता है। यह भी देखा गया है कि विवाचन खंड के उपबंधों से खुदरा / वैयक्तिक पॉलिसीधारक बाहर रखे जा सकते हैं क्योंकि उनकी शिकायतों / विवादों के निवारण के लिए सिविल न्यायालयों के साथ ही, बीमाकर्ता की शिकायत प्रणाली, बीमा लोकपाल और उपभोक्ता न्यायालयों के वैकल्पिक मंच उपलब्ध हैं।

On reference made by the Hon’ble Supreme Court of India, IRDAI undertook a comprehensive review of the extant Arbitration Clause prevalent across various lines of business in the General Insurance Industry. After due consultation with stakeholders, IRDAI is of the view that the extant Arbitration Clause is limited in scope and need to be amended. It was also viewed that the retail / individual policy holders may be kept out from the provisions of Arbitration Clause as they have alternative forums of Insurer’s Grievances System, Insurance Ombudsman and the Consumer Courts besides the Civil Courts available for redressal of their grievances/ disputes.

तदनुसार, प्राधिकरण आईआरडीए अधिनियम, 1999 की धारा 14 की उप-धारा (2) के खंड (i) के अंतर्गत प्रदत्त अपनी शक्तियों का प्रयोग करते हुए इसके द्वारा निर्देश देता है कि

Accordingly, the Authority in exercise of its powers under Clause (i) sub Section (2) of Section 14 of the IRDA Act, 1999, hereby directs that

I. व्यवसाय की खुदरा व्यवस्थाओं के अंतर्गत जारी की गई सभी पॉलिसियों में कोई विवाचन खंड नहीं होगा। All policies issued under the Retail Lines of Business shall not have any Arbitration Clause.

II. व्यवसाय की वाणिज्यिक व्यवस्थाओं के अंतर्गत जारी की गई सभी पॉलिसियों में निम्नानुसार एक विवाचन खंड होगा: All policies issued under the Commercial Lines of Business shall have an Arbitration Clause as under:

“इस संविदा के पक्षकार इस पॉलिसी से संबंधित किसी भी और सभी विवादों का निपटान करने के लिए पारस्परिक तौर पर सहमत हो जाएँ और एक अलग विवाचन करार कर लें। “The parties to the contract may mutually agree and enter into a separate Arbitration Agreement to settle any and all disputes in relation to this policy.

विवाचन का संचालन मध्यस्थम् और सुलह अधिनियम, 1996 के उपबंधों के अंतर्गत और उक्त उपबंधों के अनुसार किया जाएगा।” Arbitration shall be conducted under and in accordance with the provisions of the Arbitration and Conciliation Act, 1996.”

III. अस्थायी उपबंध / Transitory provisions

क. इस परिपत्र की तारीख को या उसके बाद जारी की गई सभी नई पॉलिसियों के लिए: a. For all the new policies issued on or after the date of this circular:

• यह समझा जाएगा कि सभी खुदरा पॉलिसियों से विवाचन खंड हटाया गया है। Arbitration Clause shall be deemed deleted from all the retail policies.
• उपर्युक्त 'II' पर उल्लिखित खंड सभी वाणिज्यिक बीमा पॉलिसियों की सामान्य शर्तों में विवाचन खंड के रूप में माना जाएगा। Clause at ‘II’ above shall be deemed to be the Arbitration Clause in General Conditions of all the commercial insurance policies.

ख. सभी वर्तमान पॉलिसियों के लिए: b. For all the existing policies:

• वर्तमान विवाचन खंड पॉलिसी की अवधि तक विधिमान्य रहेगा जब तक पॉलिसीधारक उपर्युक्त “II” पर विद्यमान खंड से इसे प्रतिस्थापित करने के लिए बीमाकर्ता से विशिष्ट रूप से अनुरोध नहीं करता। The existing Arbitration Clause shall remain valid till the term of the policy unless a policyholder specifically requests the insurer to replace it with the clause at “II” above.
• यह समझा जाएगा कि इस परिपत्र की तारीख को या उसके बाद नियत होनेवाली नवीकरण की तारीख से सभी वाणिज्यिक पॉलिसियों में “II” पर विद्यमान खंड ने वर्तमान विवाचन खंड को प्रतिस्थापित किया है। The clause at “II” shall be deemed replaced the existing Arbitration Clause in all the commercial policies from the date of renewal falling on or after the date of this circular

बीमाकर्ता इसे पॉलिसीधारकों की जानकारी में लाने और ऐसी पॉलिसियों के संबंधित उपबंधों का संशोधन करने के लिए आवश्यक कदम उठाएँगे। Insurers shall take necessary steps to bring it to the notice of the policyholders and to amend the relevant provisions of such policies.

यह परिपत्र तत्काल प्रभाव से प्रवृत्त होगा। This circular comes into force with immediate effect.
