1. प्राधिकरण ने उन वैयक्तिक सर्वेक्षकों और हानि निर्धारकों (एसएलए) के श्रेणीकरण का प्रयोग संचालित किया था जो आईआरडीए बीमा सर्वेक्षक और हानि निर्धारक (लाइसेंसीकरण, व्यावसायिक अपेक्षाएँ और आचरण संहिता) विनियम, 2000 की अधिसूचना से पहले विधिवान्य सर्वेक्षक लाइसेंस धारित कर रहे थे। उपर्युक्त प्रयोग ने एक वैयक्तिक एसएलए को व्यवसाय/विभाग की कई व्यवस्थाओं (एलओबी) में श्रेणीकृत किया था। उसके बाद, एक वैयक्तिक एसएलए को उसके सर्वेक्षक लाइसेंस पर श्रेणीकृत एलओबी में से केवल 3 एलओबी से संबद्ध होने की अनुमति दी गई थी।

2. प्राधिकरण ने परिपत्र संदर्भ. आईआरडीए/एसयूआर/सीआईआर/विविध/042/02/2020 दिनांक 04 फरवरी 2020 के जरिये ऊपर पैरा 1 के अनुसार, प्राधिकरण द्वारा जारी किये गये श्रेणीकरण पत्र के आधार पर ऐसे वैयक्तिक एसएलए के सर्वेक्षक लाइसेंस पर एलओबी के परिवर्धन की अनुमति दी, जो उपयुक्त शैक्षिक अहर्ता रखते हैं और ऐसे आवेदन को फाइल करने तक जिनके लाइसेंस का नवीकरण किसी क्रमभंग के बिना प्राधिकरण के द्वारा लगातार किया गया है। अतिरिक्त रूप से, एक वैयक्तिक सर्वेक्षक लाइसेंस के संबंध में एलओबी की संख्या पर प्रतिबंध भी हटाया गया।

3. प्राधिकरण को उपर्युक्त पैरा 2 के आधार पर कई आवेदन प्राप्त हुए हैं जिनमें एक वैयक्तिक एसएलए, जो वर्तमान में अपने सर्वेक्षण लाइसेंस में नई एलओबी जोड़ने के लिए प्राधिकरण से संपर्क कर रहा है, ने वर्ष 2002 से संबंधित एलओबी में कोई सर्वेक्षण संचालित नहीं किया है। इन पिछले 23 वर्षों के दौरान प्रौद्योगिकी में तेजी से हुए कोटि-उन्नयन (अपग्रेडेशन) और प्रगति को ध्यान में रखते हुए संबंधित एलओबी में 2001-02 से पहले प्राप्त ऐसे अनुभव और ज्ञान पुराने हो गये हैं तथा यह सुनिश्चित करने के लिए इन्हें अद्यतन बनाने की आवश्यकता है कि वह बीमाकृत हानि का एक उचित निर्धारण करे।

4. उपर्युक्त को देखते हुए, यह निर्णय किया गया है कि उक्त श्रेणीकरण पत्र के आधार पर वैयक्तिक एसएलए को अतिरिक्त एलओबी की अनुमति देने की प्रथा को रोक दिया जाए। अतः उक्त परिपत्र संदर्भ. आईआरडीए/एसयूआर/सीआईआर/विविध/042/02/2020 दिनांक 04 फरवरी 2020 को इसके द्वारा तत्काल प्रभाव से निरस्त किया जाता है।

5. इसके अतिरिक्त, वैयक्तिक सर्वेक्षक समय-समय पर यथासंशोधित आईआरडीएआई (बीमा सर्वेक्षक और हानि निर्धारक) विनियम, 2015 के विनियम 3 में दिये गये पात्रता मानदंडों की पूर्ति के अधीन, अपने सर्वेक्षक लाइसेंस पर किसी भी एलओबी के लिए लगातार पात्र होंगे।

6. अब से, सर्वेक्षक लाइसेंस में एलओबी जोड़ने के लिए, वैयक्तिक एसएलए से अपेक्षित होगा कि वह समय-समय पर यथासंशोधित आईआरडीएआई (बीमा सर्वेक्षक और हानि निर्धारक) विनियम, 2015 के विनियम 27 के अंतर्गत परंतुक का पालन करे।

The Authority had carried out the exercise of categorization of those individual surveyors and loss assessors (SLA) who were holding valid surveyor license prior to notification of IRDA Insurance Surveyors and Loss Assessors (Licensing, Professional requirements and Code of Conduct) Regulations, 2000. The said exercise had categorized an individual SLA in several lines of business/departments (LOB). Thereafter, an individual SLA was allowed to have only 3 LOBs out of the categorized LOBs, on his surveyor license.

8. The Authority, vide Circular Ref. IRDA/SUR/CIR/MISC/042/02/2020 dated 04th Feb, 2020, allowed addition of LOB on Surveyor license of an individual SLA on the basis of categorization letter issued by the Authority, as per para 1 above, who possess pertinent educational qualification and whose license has been continuously renewed by the Authority without break, till filing such modification application. Additionally, the restriction on the number of LOBs on an individual surveyor license was also lifted.

9. The Authority is in receipt of several applications based on para 2 above wherein an individual SLA, who is currently approaching the Authority to add new LOB to his surveyor license, has not carried out any survey in the concerned LOB since the year 2002. Considering the rapid upgradation and advancements in technology during these last 23 years, such experience and knowledge gained prior to 2001-02 in the concerned LOB have become obsolete and the same needs to be updated to ensure that he carries out a fair assessment of an insured loss.

10. In view of the above, it has been decided to stop the practice of allowing additional LOB to individual SLA based on the categorization letter. Therefore, the Circular Ref. IRDAI/SUR/CIR/MISC/042/02/2020 dated 04th Feb 2020 is hereby repealed with immediate effect.

11. Further, the individual surveyors would continue to be eligible for any LOB on his surveyor license, subject to fulfilment of the eligibility criteria given in Regulation 3 of IRDAI (Insurance Surveyors and Loss Assessors) Regulations, 2015 as amended from time to time.

12. Henceforth, in order to add LOB to the surveyor license, an individual SLA would be required to adhere to the Proviso under Regulation 27 of IRDAI (Insurance Surveyors and Loss Assessors) Regulations, 2015 as amended from time to time.
