प्राधिकरण ने आईआरडीएआई (बीमाकर्ताओं का पंजीकरण, पूँजी विन्यास, शेयरों का अंतरण और समामेलन) विनियम, 2024 (इस परिपत्र में इसके बाद “पंजीकरण विनियम, 2024” के रूप में उल्लिखित) अधिसूचित किया है। इसके अनुसरण में, प्राधिकरण ने पंजीकरण विनियम, 2024 के विभिन्न उपबंधों पर स्पष्टीकरण देने के लिए, बीमाकर्ताओं के पंजीकरण, पूँजी विन्यास, शेयरों के अंतरण और समामेलन, 2024 संबंधी मास्टर परिपत्र दिनांक 15.05.2024 (इस परिपत्र में इसके बाद “पंजीकरण संबंधी मास्टर परिपत्र, 2024” के रूप में उल्लिखित) जारी किया है।

The Authority has notified the IRDAI (Registration, Capital Structure, Transfer of Shares and Amalgamation of Insurers) Regulations, 2024 (herein after referred to as “Registration Regulations, 2024”). Pursuant to the same, the Authority has issued Master Circular on Registration, Capital Structure, Transfer of Shares and Amalgamation of Insurers, 2024 dated 15.05.2024 (hereinafter referred to as “Master Circular on Registration, 2024”) to provide clarifications on various provisions of Registration Regulations, 2024.

बीमा अधिनियम, 1938 (इस परिपत्र में इसके बाद “अधिनियम” के रूप में उल्लिखित) की धारा 34, आईआरडीए अधिनियम, 1999 की धारा 14 तथा पंजीकरण विनियम, 2024 के विनियम 50, 59 और 60 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पंजीकरण संबंधी मास्टर परिपत्र, 2024 का पैरा घ.2 निम्नानुसार प्रतिस्थापित किया जाता है:

In exercise of the powers conferred by section 34 of the Insurance Act, 1938 (hereinafter referred to as “the Act”), section 14 of the IRDA Act, 1999 and Regulation 50, 59 and 60 of Registration Regulations, 2024, para D.2 of the Master Circular on Registration, 2024 is substituted as under:

“घ.2 पंजीकरण विनियम, 2024 के विनियम 50 के संबंध में: किसी भी बीमाकर्ता के द्वारा जारी की गई अन्य प्रकार की पूँजी का अभिदान निम्नलिखित किसी भी संस्था(ओं) के द्वारा, कराधान, विदेशी मुद्रा, धन-शोधन निवारण, आतंकवाद के वित्तपोषण का मुकाबला करने से संबंधित कानूनों सहित परंतु केवल इन्हीं तक असीमित सभी अन्य लागू कानूनों के अनुपालन के अधीन किया जा सकता है:

“D.2 With respect to Regulation 50 of Registration Regulations, 2024: The other forms of capital issued by any insurer may be subscribed by any of the following entity(ies), subject to compliance with all other applicable laws including but not limited to laws pertaining to taxation, foreign exchange, anti-money laundering, combating the financing of terrorism:

1. भारत में फिलहाल प्रचलित किसी कानून के अंतर्गत निगमित, स्थापित अथवा पंजीकृत कोई संस्था; अथवा Any entity incorporated, set-up or registered under any law for the time being in force in India; or

2. किसी वित्तीय कार्य बल अनुपालक अधिकार-क्षेत्र में फिलहाल प्रचलित किसी कानून के अंतर्गत निगमित, स्थापित अथवा पंजीकृत कोई संस्था।” Any entity incorporated, set-up or registered under any law for the time being in force in any Financial Action Task Force compliant jurisdiction.”

यह परिपत्र निर्गम की तारीख से प्रवृत्त होगा। इस परिपत्र से पहले जारी किये गये किसी भी ओएफसी का उक्त ओएफसी के निर्गम की शर्तों के द्वारा नियंत्रित होना जारी रहेगा।

This Circular will come in force from the date of issuance. Any OFC issued prior to this Circular will continue to be governed by the terms of issuance of the said OFC.

इसे सक्षम प्राधिकारी का अनुमोदन प्राप्त है। This has approval of the Competent Authority.
