INSURANCE REGUI.AJORY AND DEVEWPMENT Al!fHORITY NOTIFICATION Hyderabad, the 10th November, 2005 Insurance Regulatory and Development Authority (Conditions of Service of Officers and Other Employees) (Amendment) Regulations, 2005 F. No. IRDA/Reg./2/2005.-In exercise of the powers conferred by clause (c) of sub-section (2) of Section 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999) the Authority, in consultation with the lnsuranceAdvisory Committee, hereby makes the following regulations to amend the Insurance Regulatory and Development Authority (Conditions ofServiceofOfficers and Other Employees) Regulations, 2000, namely: I. Short title and commeocemeot.-(l) These regulations may be called the losurance Regulatory,and Development Authority (Conditions of Service of Officers and Other Employees) (Amenchnent) Regulations, 2005. (2) They shall come into force on the date of their publication in the Official Gazette. 2 Amendment of Regulation 25.- (i) lo sub-regulation (2) of regulation 25 of the Insurance Regulatory and Development Authority (Conditions of Service of Officers and Other Employees) Regulations, 2000, after the1irst proviso, the following shall be inserted as the second proviso:- '' Provided further that au officer or other employee, during the first three years of service from the tlate of his appointment in the Authority, may, ifhe so requests, be permitted to avai I himself, sick leave on leave pay for the purpose of hospitalization due to sickness, or for undergoing surgery upon production of a medical certificate.from a qualified Surgeon, and such leave on leave pay will be entered in his sick leave account at twice the amount of leave taken by him.•' (u) After the insertion of the aforesaid as the second proviso, the existing Explanation shall be substituted with the following: "Expla,wtio11.-For the purposes of the above provisos, 'service' includes probationary service rendered by au officer and other employee prior to confinnation." 3. AmendmentofRegulation 26.-Forthe existing Regulation 26 of the Insurance Regulatory and Development Authority (Conditions ofServiceofOfficers and Other Employees) Regulatioru;, 2000, the following shall be substi1uted : "26. Maternity Leave.-( 1) Matemiry I eave, which shall be on leave pay, may be granted to female o fficcrs and female employees up to a period ofone hundred and eighty days on full pay at a time and not more than tlJree hundred and sixty days during the entire period of service. (2) F emaJe otlicers and female employees undergoing hysterectomy operatJOn may also claim maternity leave for a penod ofnot exceedmg twenty days (including stay in hospital) within the overall ceilmg of$ree hundred and sixty days. (3) Leave not exi;eeding fony five days may be granted 10 female officers and female employees during the entire service of such offkcn; aruJ employees, in case of miscarriage, including abortion, on production of medical certificate within the overall ceiling of three hundred and sixty days. (4) The competent authority may grant leave of any other kind admissible to female officers and female employees in combination with or in continuauon of maternity leave, if the request for the same is supported by requisite medical ccrllficatc."
