L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx III—[k.M 4 PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 146] ubZ fnYyh] eaxyokj] vizSy 18] 2017@pS=k 28] 1939 No. 146] NEW DELHI, TUESDAY, APRIL 18, 2017/CHAITRA 28, 1939 भारतीय बीमा िविनयामक और िवकास ᮧािधकरण अिधसूचना हैदराबाद, 7 अᮧैल, 2017 भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा एजᱶटᲂ और बीमा म᭟यवᳶतᭅयᲂ को कमीशन अथवा पाᳯर᮰िमक अथवा ᮧितफल का भुगतान) (पहला संशोधन) िविनयम, 2017 फा. सं. भा.बी.िव.िव.ᮧा./िविनयम/3/140/2017.– बीमा अिधिनयम, 1938 (1938 का 4) कᳱ धारा 31बी के साथ पᳯठत धारा 114ए कᳱ उपधारा 2 के खंड (आईसी) और (जेडी) तथा बीमा िविनयामक और िवकास ᮧािधकरण अिधिनयम, 1999 (1999 का 41) कᳱ धारा 14 कᳱ उप-धारा (1) और धारा 26 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए ᮧािधकरण इसके ᳇ारा िन᳜िलिखत िविनयम बनाता है, अथाᭅत्:- 1. संिᭃ᳙ नाम और िविनयमᲂ का ᮧारंभ: (क) ये िविनयम भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा एजᱶटᲂ और बीमा म᭟यवᳶतᭅयᲂ को कमीशन अथवा पाᳯर᮰िमक अथवा ᮧितफल का भुगतान) (पहला संशोधन) िविनयम, 2017 के नाम से जाने जाएँगे । (ख) ये िविनयम 1 अᮧैल, 2017 को ᮧवृᱫ हᲂगे। 2. भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा एजᱶटᲂ और बीमा म᭟यवᳶतᭅयᲂ को कमीशन अथवा पाᳯर᮰िमक अथवा ᮧितफल का भुगतान) िविनयम, 2016 मᱶ (क) िविनयम 5(च) को िन᳜िलिखत श᭣दᲂ से ᮧित᭭थािपत ᳰकया जाएगा "बीमाकताᭅ ᳇ारा देय कमीशन अथवा पाᳯर᮰िमक कᳱ अिधकतम दर िन᳜िलिखत मᱶ से ᳰकसी से भी अिधक नहᱭ होगीः- (i) इन िविनयमᲂ के ᳇ारा िविन᳸दᭅ᳥ अिधकतम सीमा; अथवा 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ii) ᳰकसी अ᭠य िविनयम अथवा ᳰदशािनदᱷश के अंतगᭅत ᮧािधकरण के ᳇ारा अनुमोᳰदत कमीशन अथवा पाᳯर᮰िमक कᳱ कोई अ᭠य दर जो भी कम हो।" (ख) अनुसूची-III मᱶ, साधारण बीमा (मोटर को छोड़कर अ᭠य) - िविनयम 5(घ) और अनुसूची-V, सारणी III – साधारण और ᭭ टᱹडअलोन ᭭वा᭭᭝य बीमा (जैसा लागू हो) मᱶ श᭣द "कॉरपोरेट" के ᭭थान पर "वािणि᭔यक" रखा जाएगा। टी. एस. िवजयन, अ᭟यᭃ [िव᭄ापन-III/4/असाधारण/12/17] INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION Hyderabad, the 7th April, 2017 Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (First Amendment) Regulations, 2017 F. No. IRDAI/Reg/3/140/2017.—In exercise of the powers conferred by clause (ic) and (jd) of su-bsection 2 of section 114A read with section 31B of the Insurance Act, 1938 (4 of 1938), and read with su-bsection (1) of sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority hereby makes the following regulations, namely: - 1. Short Title and Commencement of the Regulations: (a) These Regulations may be called the Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (First Amendment) Regulations, 2017. (b) They shall come into force on 1st April, 2017. 2. In Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) Regulations, 2016 (a) Replace Regulation 5(f) with the following wordings “The maximum rate of commission or remuneration payable by an insurer shall not exceed either: - (i) The maximum specified by these regulations; or (ii) Any other rate of commission or remuneration approved by the Authority under any other Regulations or guidelines whichever is lower.” (b) In Schedule – III, General Insurance (Other than motor) – Reg 5(d) and Schedule V, Table III – General and Stand Alone Health Insurance (as applicable) the word “corporate” may be replaced by “commercial”.
