L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx III—[k.M 4 PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la - 413] ubZ fnYyh] lkse okj ] vD r wcj 2 3 ] 201 7 @ dk£rd 1 ] 193 9 No. 413] NEW DELHI, MONDAY, OCTOBER 23, 2017/KARTIKA 1, 1939 भारतीय बीमा विवियामक और विकास प्राविकरण अविसूचिा हैदराबाद, 10 अक् तूबर, 2017 भारतीय बीमा विवियामक और विकास प्राविकरण (बीमा एजेंटों और बीमा मध्यिर्तियों को कमीशि अथिा पाररश्रवमक अथिा प्रवतफल का भुगताि) (दूसरा संशोिि) विवियम, 2017 फा. सं. भा.बी.वि.वि.प्रा./विवियम/9/146/2017.—बीमा अविवियम, 1938 (1938 का 4) की िारा 31बी के साथ परित तथा बीमा विवियामक और विकास प्राविकरण अविवियम, 1999 (1999 का 41) की िारा 14 और 26 की उप िारा (1) के साथ परित बीमा अविवियम की िारा 114ए की उपिारा (2) के खंड (आईसी) और (जेडी) द्वारा प्रद्त शवतिययों का प्रयोग करते ुएए प्राविकरण ससके द्वारा वि्नलवलवखत विवियम बिाता है, अथाित् :— 1. विवियमों का संविप्त िाम और प्रारंभः (क) ये विवियम भारतीय बीमा विवियामक और विकास प्राविकरण (बीमा एजेंटों और बीमा मध्यिर्तियों को कमीशि अथिा पाररश्रवमक अथिा प्रवतफल का भुगताि) (दूसरा संशोिि) विवियम, 2017 कहलाएँगे । (ख) ये विवियम 1 ििंबर 2017 को प्रिृ्त होंगे। 2. भारतीय बीमा विवियामक और विकास प्राविकरण (बीमा एजेंटों और बीमा मध्यिर्तियों को कमीशि अथिा पाररश्रवमक अथिा प्रवतफल का भुगताि) विवियम, 2016 में क) विवियम 5 (ग) के अंतगित अिुसूची-II की तावलका की पंवतिय 1 और पंवतिय 6 को वि्नलवलवखत से प्रवतस्थावपत करें । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] क्रम सं. व्यिसाय की पद्धवत बीमा एजेंटों / बीमा मध्यिर्तियों को देय अविकतम कमीशि/ पाररश्रवमक 5 स्िास््य – सरकारी योजिा सरकारी योजिा / अविसूचिा में यथाविविर्दिष्ट ख) विवियम 5(ङ) के अंतगित अिुसूची-IV को वि्नलवलवखत से प्रवतस्थावपत करें। "अिुसूची-IV मोटर बीमा – विवियम 5(ङ) प्रीवमयम के प्रवतशत के रूप में अविकतम कमीशि अथिा पाररश्रवमक जो सािारण बीमा (मोटर) के वलए अिुमत है, वि्नलािुसार हैः क्रम सं. िर्ि बीमा एजेंटों / बीमा मध्यिर्तियों को देय अविकतम कमीशि/ पाररश्रवमक मोटर (व्यापक) मोटर (स्टैंड-अलोि टीपी) दुपवहया को छोड़कर अन्य दुपवहया दुपवहया को छोड़कर अन्य दुपवहया 1 पंजीकरण प्रमाणपत्र – पहले िर्ि से तीसरे िर्ि तक 15% (ओडी अंश) + (शून्य – टीपी अंश) 17.5% (ओडी अंश) + (शून्य – टीपी अंश) 2.5% 2.5% 2 पंजीकरण प्रमाणपत्र – चौथे िर्ि से आगे 15% (ओडी अंश) + 2.5% (टीपी अंश) 17.5% (ओडी अंश) + 2.5% (टीपी अंश) 2.5% 2.5% टी. एस. विजयि, अध्यि [विज्ञापि III/4/असा./282/17] INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION Hyderabad, the 10th October, 2017 Insurance Regulatory and Development Authority of India(Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (Second Amendment) Regulations, 2017 F. No. IRDAI/Reg/9/146/2017.—In exercise of the powers conferred by clause (ic) and (jd) of sub-section (2) of section 114A read with section 31B of the Insurance Act, 1938 (4 of 1938), and read with sub-section (1) of sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority hereby makes the following regulations, namely:— 1. Short Title and Commencement of the Regulations: (a) These Regulations may be called the Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (Second Amendment) Regulations, 2017. (b) They shall come into force on 1st November, 2017. 2. In Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) Regulations, 2016 a) Replace line 1 and line 6 of Table of Schedule – II under Regulation 5(c) with the following III 4 3 S.
