ऩरयऩत्र संदबभ सं. आईआयडीए / एनएर / सीआईआय / एभआइएससी /206 /8 / 2017 दद: 31 अगस् त, 2017 सेवा भं, सबी फीभा कंऩननमँ के भुख् म ्रबफंध ननदेकक / भुख् म कामभकायी अनधकारयम को, ववषम :(!) रोक अदारत / एभएसीटी भं कुछ फीभा कंऩननम का बाग न रेना / असंतोषजनक बागीदायी (!!)ऩॉनरसी धायक क सेवा देना मह फीभा अनधननमभ, 1938 के अनुबाग 34 के अंतगभत ननदहत अनधकाय के अनुसाय औय सभादेक मानिका देखें डब्‍ ् मू. ऩी (सी) ( ऩीआईएर ) सं. 04 / 2017 के संफंध भं ऩारयत, वत्रऩुया के भाननीम उच् ि न् मामारम के आदेक ददनांक 12. 7. 2017 के अनुऩारन भं जायी दकमा गमा है। ्रब ानधकयण को, ऩत्रािाय के नरए उनित ऩता उऩरब्‍ ध नहीं कयामे जाने क वजह से स्‍ भन न नभरने सदहत, कुछ फीभा कंऩननम के रोक अदारत भं बाग न रेने / असंतोषजनक बागीदायी के संफंध भं वत्रऩुया के भाननीम उच् ि न् मामारम वाराया क गई गंबीय दट‍ ऩणिणमॉं ्रबा‍ त हुई ह । भाननीम न् मामारम ने गौय दकमा है दक कुछ भाभर भे ऩॉनरसीधायक को नभर यही सेवाएं असंतोषजनक ह । भाभर को ध् मान भं यखेते हुए औय फीभा ऺे त्र ऩय नागरयक के वव‍ वास को भजफूत कयने क ष्वस से सबी फीभा कंऩननम के नरए नन्‍ ननरणिखेत सुननणिचितत कयना अननवामभ होगा : 1. जफ बी भाननीम अदारत से स्‍ भन ्रबा‍ त ह , एभएसीटी / न् मामारम के भाभर भं उऩणिस्थत यहना ; 2. जफ बी आमोणिजत ह , रोक अदारत भं बाग रेना ; 3. आईआयडीएआई (ऩानरसीधायक के दहत क यऺा कयना) ववननमभ, 2017 का कड़ाई से ऩारन कयना ; 4. ऩानरसी धायक के साथ ऩत्र व् मवहाय कयने, ववकेष रूऩ से स्‍ भन क उनित ताभीर कयने, दावा भाभर से ननऩटने के नरए एक ऩत्रािाय कामाभरम का ऩता यखेना । इन अनुदेक / ननदेक भं से दकसी का बी उ् रंघन न कयने मा इन ऩहरुम भं से दकसी के संफंध भं नककामत ्रबा‍ त होने ऩय, आईआयडीएआई फीभा अनधननमभ, 1938 के अनुच् छेद के अंतगभत ्रब दत् त अनधकाय का ्रबमोग कयते हुए, िूककताभ फीभाकताभ के ऊऩय , मथा आव‍ मक कायभवाई कयेगा। ह./- ---- ऩी.जे. जोसेप (गैय – जीवन सदस् म) • I '41U11ll ~ ~~lll4cfi 3ITT ~cfilft ~ ti111am INSURANCE REGULATORY AND irJai DEVELOPMENT AUTHORITY OF INDIA CIRCULAR Ref No: IRDA/NL/CIR/MISC/~06/8/2017 31st August, 2017 To CEOs/CMDs of All General Insurance Companies. Re: (i) Non-participation/ unsatisfactory participation of certain insurance companies in Lok Adalats/MACT (ii) Servicing of policy holder. This is issued in accordance with the power vested under Section 34 of Insurance Act, 1938, and in compliance with the order of the Hon'ble High Court of Tripura dated 12.07.2017 passed in connection with the Writ Petition vide W.P (C) (PIL) No . . 04/2017. The Authority has received serious observations made by the Hon'ble High Court of r ripura regarding non-participation/ unsatisfactory participation of certain insurance companies in Lok Adalats including due to non-receipt of summons due to proper address tor correspondence not being provided. The Hon'ble Court has also observed poor service to policy holders in some cases. Keeping in view, the seriousness of the issues and with a view to strengthen the faith of the citizens upon the insurance sector, all the insurance companies shall mandatorily ensure the following: - 1. Attend MACT/ Court cases promptly and properly whenever summons are received from the Hon'ble Courts; 2. Participate in Lok Adalats whenever they are held; 3. Adhere to IRDAI (Protection of Policy Holders' Interest) Regulations, 2017 strictly. 4. Maintain a correspondence office address for communication with the policy holders especially for dealing with claim matters including proper service of summons. In case of violation of any of these instructions/ directions or on receipt of any complaint in any of these aspects, IRDAI in exercise of the power conferred under section 34 of Insurance Act, 1938, would take action as deemed necessary upon the defaulting insurer. ~ :::=,--- (Member Non-life) ~l>;!tl \fc:R, cfimr <R1', ~. ~ - 500 004.
