May 2023 alt Stared / All Insurers er I Re: Surrogacy Act, 2021 and ART Act, 2021 and the relevant Rules thereunder 1. उपर्युक्त अधिनियमों/नियमों के निम्नलिखित उपबंधों की ओर ध्यान आकर्षित किया जाता हैः Reference is drawn to the following provisions of the above Acts/Rules: i REA fear offer, 2021 wt emer 4cii) ey tl) निम्नानुसार कहती हैः Section 4 (iii)(a)(IIl) of Surrogacy (Regulation) Act, 2021 states as under: (॥) ऐसी राशि और ऐसी पद्धति में बीमा कवरेज जो बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 के अधीन स्थापित बीमा विनियामक और विकास प्राधिकरण द्वारा मान्यता प्राप्त किसी बीमा कंपनी अथवा किसी एजेंट से प्रसवोत्तर प्रसूति संबंधी जटिलताओं को कवर करते हुए छत्तीस महीने की अवधि के लिए किराये की कोख वाली माता के नाम निर्धारित की जा सकती है; (ख) किराये की कोख वाली (सरोगेट) माता के UN 6! (Ill) an insurance coverage of such amount and in such manner as may be prescribed in favour of the surrogate mother for a period of thirty-six months covering postpartum delivery complications from an insurance company or an agent recognised by the Insurance Regulatory and Development Authority established under the Insurance Regulatory and Development Authority Act, 1999; (b) the surrogate mother is in possession. सरोगेसी (विनियमन) नियम, 2022 का नियम 5 निम्नानुसार कहता हैः rc Rule 5 of Surrogacy (Regulation) Rules, 2022 states as under: बीमा कवरेज.- (1) इच्छुक महिला अथवा दंपति ऐसी राशि के लिए जो सगर्भावस्था पप्रेग्नन्सी) से उत्पन्न होनेवाली सभी जटिलताओँ के सभी व्ययों को कवर करने के लिए और प्रसवोत्तर प्रसूति संबंधी जटिलताओँ को भी कवर करने के लिए पर्याप्त हो, बीमा विनियामक और विकास प्राधिकरण अधिनियम, (1999 का 41) के उपबंधों के अधीन स्थापित बीमा विनियामक और विकास प्राधिकरण द्वारा मान्यता प्राप्त किसी बीमा कंपनी या किसी एजेंट से छत्तीस महीने की अवधि के लिए किराये की कोख वाली माता के नाम खरीदेगी/खरीदेंगे। Insurance coverage.- (1) The intending woman or couple shall purchase a general health insurance coverage in favour of surrogate mother for a period of thirty six months from an insurance company or an agent recognized by the Insurance Regulatory and Development Authority established under the provisions of the Insurance Regulatory and Development Authority Act, (41 of 1999) for an amount which is sufficient enough to cover all expenses for all complications arising out of pregnancy and also covering post- partum delivery complications. पे n° = 5 5/1, Financial Distric kramguda, Hyderabad-500 032, India 1. 115/1, फाइनें शियल डिस्ट्रिक्ट, नानकरामगुडा, हैदराबाद- भारत Survey No. 115/1, Financial District, Nana | yderabad: i. me oa meh मो वेबसाइट : करत जा (3) :+91-40-20204000, ॥४७७आ४ : ४४७.॥०४.090५.॥ 1... एआरटी अधिनियम, 2021 की धारा 22(1)(ख) निम्नानुसार कहती हैः Section 22(1)(b) of ART Act, 2021 states as under: An insurance coverage of such amount as may be prescribed for a period of twelve months in favour of the oocyte donor by the commissioning couple or woman from an insurance company or an agent recognised by the Insurance Regulatory and Development Authority established under the provisions of the Insurance Regulatory and Development Authority Act, 1999. 1... एआरटी (विनियमन) नियम, 2022 का नियम 12 निम्नानुसार कहता हैः Rule 12 of ART (Regulation) Rules,2022 states as under Insurance coverage/Guarantee for oocyte donor. - 0) इच्छुक दंपति अथवा महिला ऐसी राशि के लिए बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 के उपबंधों के अधीन स्थापित बीमा विनियामक और विकास प्राधिकरण द्वारा मान्यता प्राप्त किसी बीमा कंपनी अथवा किसी एजेंट से 12 महीने की अवधि के लिए अण्डक दाता (ऊसाइट डोनर) के नाम एक साधारण स्वास्थ्य बीमा कवरेज खरीदेंगे/खरीदेगी, जो अण्डक पुनःप्राप्ति (रिट्रीवल) के कारण उत्पन्न होनेवाली सभी जटिलताओं हेतु सभी व्ययों को कवर करने के लिए पर्याप्त हो। (i) The Intending couple or woman will purchase a general health insurance coverage in favor of oocyte donor for a period of 12 months from an insurance company or an agent recognized by the Insurance Regulatory and Development Authority established under the provisions of the Insurance Regulatory and Development Authority Act, 1999 for an amount which is sufficient enough to cover all expenses for all complications arising due to oocyte retrieval. 2. सभी बीमाकर्ताओं को इसके द्वारा निदेश दिया जाता है कि वे तत्काल प्रभाव से उक्त दोनों अधिनियमों के उपर्युक्त उपबंधों का अनुपालन करें तथा सुनिश्चित करें कि उपयुक्त उत्पाद उपलब्ध किये जाएँ। All insurers are hereby directed to comply with the aforesaid provisions of the two Acts with immediate effect and ensure that suitable products are made available.
