Subject: Clarification regarding implementation of PP Policy-reg.
Sir,
Kindly refer to your letter No. HAL/CD/508/MSME/2016/566 dated the 21st March, 2016 on the subject cited above.
We appreciate participation of HAL in the meeting of selected CPSUs chaired by the Hon'ble Minister of MSME on 17th March, 2016.
The comments on points raised by HAL are detailed below:
a) HAL has achieved more than 32% procurement from MSEs till February, 2015 but excluding Defence Procurement
Comment:
This issue was pointed out during the meeting with CPSUs held on 17.3.2016, and it was made ample clear to the participants that the 20% procurement from MSEs has become mandatory w.e.f. 1.4.2015 and the CPSUs cannot exclude the cost of any item while computing the total procurement made by them during the year 2015-16. Hence the items left out by HAL (Defence Procurement) while computing the total procurement need to be provided to this Ministry.
b) List of MSEs not available in the MSME/NSIC website c) MSEs not disclosing their status relating to SC/ST category d) Item-wise details of MSEs for supply of 358 items not available on the website of this Ministry
Comments (b) to (d):
It was made clear to the participants in the meeting held on 17.3.2016 that web platform for Public Procurement facilitations is under the process of development to take care of the issues.

e) Some of the items reserved in the list of 358 items is not applicable to HAL.
Comments:
HAL is required to submit specific details with regard to above.
f) Exemption given to MSEs from submission of bank guarantee
Comments:
Regarding extension of benefit of Exemption from Security Deposit/performance bank guarantee, it is for the procuring agency to decide as to whether exempt the MSEs from depositing bank guarantee.
g) Sought clarification relating to L1+15 in case of non-divisibility of tenders items (service) as this is commercially not feasible for HAL.
Comments:
Regarding L1 +15% clause, it is clarified that in cases where more than one MSE have quoted in the price band of L1+15% (where L1 price is from other than an MSE), 20% of the tendered quantity (equivalent to at least 20% of the tendered value) will be shared equally amongst the MSEs quoted in the price band of L1 + 15% subject to condition that these MSEs will bring down their price to L1.
If in a tender L1 price is quoted by an MSE, then the L1 + 15% clause will not apply and the MSE who quoted L1 price will get the opportunity for fully supply.
In case of non-divisible tenders, an MSE quoting in the price band of L1+15% may be awarded for full/complete supply of tendered value, considering the spirit of policy for enhancing the government procurement from MSEs subject to bringing down of price to L-1 by the MSE concerned.
