This is with reference to the provisions of Regulation 5(1)(e) and Regulation 14(2) of the PFRDA (Point of Presence) Regulations, 2018 (as amended vide notification dated 10.01.2024), hereinafter referred to as the “Regulations”. 2. In order to seek registration as a Point of Presence (PoP) with the Pension Fund Regulatory & Development Authority (PFRDA), an applicant is required to fulfil the eligibility criteria, as specified under Regulation 5 of the Regulations. The sub-regulation (1) of the Regulation 5 states that: "Eligibility criteria.-(1) An applicant is required to fulfil the following eligibility criteria: " The clause (e) of sub-regulation (1) of the Regulation 5 states that: “minimum net worth of Rupees two crore which shall include minimum paid up equity capital of Rupees fifty lakh, as on the last day of the immediately preceding quarter, duly certified by the statutory auditor; Explanation.— “net worth” shall be as defined under section 2(57) of the Companies Act, 2013. Provided that this requirement shall not be applicable for: (i) entity(s) seeking registration under Atal Pension Yojana; and (ii) departments / boards of the Central or the State Governments;” 3. Regulation 14 of the Regulations provides exemption in certain cases from eligibility criteria. In this regard, it is stipulated that the existing PoPs are required to meet the eligibility criteria of ‘Net Worth’ latest by the end of Financial Year 2024-25. 5. The concerned PoPs are required to furnish a duly certified 'Net Worth certificate' from their statutory auditor, fulfilling the ‘Net Worth’ criteria as per the Regulations. This certificate shall be submitted on or before 30th June 2025. 6. The PoPs have to meet the eligibility criteria at all the times, including it and its key managerial personnel meeting the 'fit and proper person criteria' under the Regulations. 7.
