This is with reference to the provisions of Regulation 3(1) of the PFRDA (Point of Presence) Regulations, 2018 (as amended vide notification dated 10.01.2024), hereinafter referred to as the “Regulations”. Proviso to sub-regulation (1) of the Regulation 3 states that: “Provided that the entity(s) already registered for distribution and servicing only its own employees and other personnel, either through physical or online platforms, prior to these amendments, shall surrender its certificate of registration, and a. seek registration or authorization in such manner as may be directed by Authority; or b. be associated with a point of presence, for its employees who are subscribers, within the time period so directed.” 2. Accordingly, the existing PoP(s) registered with the Authority for distribution and servicing for NPS to its own employees and other personnel, either through physical or online platforms, prior to the aforementioned amendments, shall undertake below-mentioned compliances within the time period, hereby stipulated: (i) Surrender their existing certificate of registration issued under regulation 3 (1) (iii) of the erstwhile PFRDA (PoP) Regulations, 2018 at the earliest, but not later than 30th September 2024; and may either पŐशन िनिध िविनयामक एवं िवकास Ůािधकरण PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY Page 2 of 4 बी – १४/ए , छũपित िशवाजी भवन , कुतुब सं˕ागत Ɨेũ , कटवाįरया सराय ,नई िदʟी – 110 016 दूरभाष: 011 - 26517501, 26517503, 26133730 फैƛ: 011 – 26517507, वेबसाइट: www.pfrda.org.in B-14/A, Chhatrapati Shivaji Bhawan, Qutab Institutional Area, Katwaria Sarai, New Delhi – 110 016 Phone : 011 - 26517501, 26517503, 26133730 Fax: 011 – 26517507 website: www.pfrda.org.in (a) Seek new registration under Regulation 3(1) (a) of the amended Regulations subject to meeting the eligibility criteria as specified under Regulation 5 thereof; or (b) Shall continue to be associated for an interim period and service its employees who are NPS subscribers, and ensure timely transfer of all these subscribers to such other eligible PoPs at the earliest, before the surrender of its certificate of registration to the Authority. 3. PoPs are advised to ensure submission of Annual Compliance Certificate, Compliance Report / Audit Reports (as required to be submitted by them in compliance to PoP regulations/guidelines applicable to them), before surrender of CoR issued to them under PoP Regulations 2018. 4. All the concerned PoPs are advised to take note of the above and ensure compliance within the stipulated timeline. 5. (Ashish Kumar Bharati) General Manager CC : To all the PoPs and concerned stakeholders ASHISH KUMAR BHARATI Digitally signed by ASHISH KUMAR BHARATI पŐशन िनिध िविनयामक एवं िवकास Ůािधकरण PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY Page 3 of 4 बी – १४/ए , छũपित िशवाजी भवन , कुतुब सं˕ागत Ɨेũ , कटवाįरया सराय ,नई िदʟी – 110 016 दूरभाष: 011 - 26517501, 26517503, 26133730 फैƛ: 011 – 26517507, वेबसाइट: www.pfrda.org.in B-14/A, Chhatrapati Shivaji Bhawan, Qutab Institutional Area, Katwaria Sarai, New Delhi – 110 016 Phone : 011 - 26517501, 26517503, 26133730 Fax: 011 – 26517507 website: www.pfrda.org.in पįरपũ पीएफआरडीए/2024/03/आरईजी-पीओपी/03 िदनांक : 11 माचŊ, 2024 Ůित, पूवŊवतŎ पीएफआरडीए (उपİ˕ित अİˑȕ) िविनयम, 2018 के िविनयमन 3 (1) (iii) के तहत पंजीकृत उपİ˕ित अİˑȕ िवषय : पूवŊवतŎ पीएफआरडीए (उपİ˕ित अİˑȕ) िविनयम, 2018 के िविनयम 3(1)(iii) अथाŊत राʼŌ ीय पŐशन Ůणाली (एनपीएस) - केवल अपने कमŊचाįरयों तथा अɊ कािमŊकों हेतु भौितक या ऑनलाइन ɘेटफॉमŊ के माȯम से िवतरण और सिवŊिसंग - के अंतगŊत जारी िवȨमान पंजीकरण Ůमाणपũ (सीओआर) का समपŊण और नए पंजीकरण Ůाɑ करना, अथवा िकसी अɊ पाũ उपİ˕ित अİˑȕ (पीओपी) से जुड़ना, जैसा भी मामला हो। 1. यह, पीएफआरडीए (उपİ˕ित अİˑȕ) िविनयम, 2018 (िदनांक 10.01.2024 Ȫारा यथासंशोिधत) और िवशेषतया िविनयम 3 के उप-िविनयम (1) के खंड (क) के Ůावधान के संदभŊ मŐ है। संशोिधत िविनयमों के िविनयम 3(1) का परंतुक िनɻानुसार है : " परȶु इन संशोधनों से पहले भौितक या ऑनलाइन ɘेटफ़ॉमŊ के माȯम से केवल अपने कमŊचाįरयों और अɊ किमŊयों के िलए िवतरण और सेवाओं हेतु पंजीकृत सं˕ाएं, अपना पंजीकरण Ůमाणपũ वापस लौटाएंगी, और (क) Ůािधकरण Ȫारा िनदőिशत तरीके से पंजीकरण या Ůािधकार Ůाɑ करŐगी अथवा ; (ख) इस Ůकार िनदőिशत समयाविध के भीतर अपने उन कमŊचाįरयों, जो अिभदाता हœ, के िलए उɎŐ उपİ˕ित अİˑȕ के साथ संबȠ िकया जाएगा”। 2. तदनुसार, उपयुŊƅ संशोधनों का अनुपालन सुिनिʮत करने के िलए इन संशोधनों के पहले से ही, भौितक या ऑनलाइन ɘेटफॉमŊ के माȯम से केवल अपने कमŊचाįरयों तथा अɊ कािमŊकों हेतु एनपीएस िवतरण और सिवŊिसंग हेतु, Ůािधकरण के साथ पंजीकृत, िवȨमान पीओपी Ȫारा यहाँ िनधाŊįरत अविध के भीतर िनɻिलİखत अनुपालनों को सुिनिʮत िकया जाना आवʴक है : i. पूवŊवतŎ िविनयमों के िविनयम 3(1)(iii) के अंतगŊत जारी िकए गए उनके िवȨमान पंजीकरण Ůमाणपũ को, जʗ से जʗ िकȶु 30 िसतंबर 2024 के पहले समिपŊत करना होगा, अɊथा: पŐशन िनिध िविनयामक एवं िवकास Ůािधकरण PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY Page 4 of 4 बी – १४/ए , छũपित िशवाजी भवन , कुतुब सं˕ागत Ɨेũ , कटवाįरया सराय ,नई िदʟी – 110 016 दूरभाष: 011 - 26517501, 26517503, 26133730 फैƛ: 011 – 26517507, वेबसाइट: www.pfrda.org.in B-14/A, Chhatrapati Shivaji Bhawan, Qutab Institutional Area, Katwaria Sarai, New Delhi – 110 016 Phone : 011 - 26517501, 26517503, 26133730 Fax: 011 – 26517507 website: www.pfrda.org.in (a) िविनयमों के िविनयम 3(1)(क) (यथासंशोिधत) के अंतगŊत नए पंजीकरण के िलए अनुरोध कर सकतŐ हœ, जो इन िविनयमों के िविनयम 5 (यथासंशोिधत) के अंतगŊत िनिदŊʼ पाũता मानदंडों को पूरा करने के अȯधीन होगा; या (b) अंतįरम अविध के िलए संबȠ जारी रखŐगे और अपने कमŊचाįरयों को सेवा Ůदान करŐगŐ जो एनपीएस Ťाहक हœ, तथा अपने पंजीकरण Ůमाणपũ को समिपŊत करने से पहले, ऐसे योƶ पीओपी मŐ सभी अिभदाताओं का यथाशीť अंतरण सुिनिʮत करŐगे। 3. पीओपी को सलाह दी जाती है िक पीओपी िविनयम 2018 के तहत, उɎŐ जारी पंजीकरण Ůमाणपũ को समपŊण से पहले वािषŊक अनुपालन Ůमाणपũ, अनुपालन įरपोटŊ/ऑिडट įरपोटŊ (जैसा िक उनके िलए लागू पीओपी िविनयमों/िदशािनदőशों के अनुपालन के िलए उनके Ȫारा Ůˑुत िकया जाना आवʴक है), Ůˑुत करना सुिनिʮत करŐ। 4. सभी संबंिधत उपİ˕ित अİˑȕों को इस पर ȯान देने और समय-सीमा के भीतर अनुपालन सुिनिʮत करने की सलाह दी जाती है। 5. उपयुŊƅ संशोिधत िविनयमों की एक Ůित पीएफआरडीए की वेबसाइट https://www.pfrda.org.in/myauth/admin/showimg.cshtml?ID=2861 पर उपलɩ है। 6. यह पįरपũ पŐशन िनिध िविनयामक और िवकास Ůािधकरण अिधिनयम, 2013 की धारा 14(1) के अंतगŊत Ůदȅ शİƅयों का Ůयोग करते Šए जारी िकया गया है। (आशीष कुमार भारती) महाŮबंधक Ůित: सभी पीओपी और संबंिधत िहतधारकों के िलए ASHISH KUMAR BHARATI Digitally signed by ASHISH KUMAR BHARATI
