(1) इन जनयमों का संजिप्त नाम नागररकता (संिोधन) जनयम, 2026 है। (2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे । 2. नागररकता जनयम, 2009 (जिसे इसमें इसके पश्चात उि जनयम कहा गया है) में, जनयम 3 के पश्चात् जनम्नजलजखत परंतुक अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाात्:— “परंतु ऐसे मामलों में आवेिक यह भी ध्यान रखेगा दक अवयस्ट्क बालक दकसी भी समय भारतीय पासपोर्ा धाररत करते हुए दकसी अन्द्य िेि का पासपोर्ा धारण नहीं कर सकता है।” 3. उि जनयमों में, जनयम 29 के उप-जनयम (1) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम रखा िाएगा, अर्ाात्:— “(1) धारा 7क के अधीन भारत का जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण हेतु आवेिन, प्ररूप 28 में, जनर्िाष्ट ऑनलाइन पोर्ाल अर्ाात् https://ociservices.gov.in पर इलेक्ट्रॉजनक रूप से दकया िाएगा।” सं. 299] नई दिल्ली, बृहस्ट् पजतवार, अप्रैल 30, 2026/वैिाख 10, में, जनयम 31 में— (i) “दकया िाएगा” िब्िों के पूवा आने वाले िब्ि “िो प्रजतयों में” का लोप दकया िाएगा; (ii) खंड (क) के उपखंड (ii) का लोप दकया िाएगा। 5. उि जनयमों में, जनयम 33 के स्ट्र्ान पर जनम्नजलजखत जनयम रखा िाएगा, अर्ाात्:— “33. भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण तर्ा धारा 7क के अधीन व्यजियों के रजिस्ट्र्र का अनुरिण.— (1) प्रत्येक व्यजि, िो धारा 7क के अधीन भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकृत है, उसे प्ररूप 29 में अंतर्वाष्ट जववरणों सजहत भौजतक रूप में भारत के जविेिी नागररक काडा अर्वा इलेक्ट्रॉजनक भारत के जविेिी नागररक (e-OCI) रजिस्ट्रीकरण िारी दकया िाएगा। (2) िारी कताा प्राजधकारी भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकृत व्यजियों का अजभलेख, प्ररूप 30 में इलेक्ट्रॉजनक रूप में अनुरजित करेगा।” 6. उि जनयमों में, जनयम 34 के स्ट्र्ान पर जनम्नजलजखत जनयम रखा िाएगा, अर्ाात्:— “34. भारत के जविेिी नागररक काडा के त्यिन की घोषणा.— (1) धारा 7ग के अधीन दकसी व्यजि को भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकृत करने वाले काडा के पररत्याग की घोषणा, संबंजधत भारतीय जमिन या पोस्ट्र् अर्वा संबंजधत जविेिी िेत्रीय रजिस्ट्रीकरण अजधकारी को इलेक्ट्रॉजनक रूप से प्ररूप 31 में, जनर्िाष्ट ऑनलाइन पोर्ाल, अर्ाात् https://ociservices.gov.in पर की िाएगी और िहााँ भारत का जविेिी नागररक काडा भौजतक रूप में िारी दकया गया है, वहााँ भारत का जविेिी नागररक काडा की मूल प्रजत भी संबंजधत भारतीय जमिन या पोस्ट्र् अर्वा संबंजधत जविेिी िेत्रीय रजिस्ट्रीकरण अजधकारी को अभ्यर्पात की िाएगी। (2) भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण के पररत्याग की घोषणा प्राप्त होने तर्ा भारत का जविेिी नागररक काडा की मूल प्रजत के समपाण (िहााँ भारत का जविेिी नागररक काडा भौजतक रूप में िारी दकया गया है) पर, संबंजधत भारतीय जमिन या पोस्ट्र् अर्वा संबंजधत जविेिी िेत्रीय रजिस्ट्रीकरण अजधकारी, प्ररूप 32 में, जनर्िाष्ट ऑनलाइन पोर्ाल, अर्ाात् https://ociservices.gov.in पर, इलेक्ट्रॉजनक रूप से अजभस्ट्वीकृजत िारी करेगा तर्ा जनयम 33 के उप-जनयम (2) के अधीन इलेक्ट्रॉजनक रूप में अनुरजित अजभलेख से घोषणाकताा का नाम हर्ा िेगा।” 7. उि जनयमों में, जनयम 35 के स्ट्र्ान पर जनम्नजलजखत रखा िाएगा, अर्ाात्:— “35. भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण का जनरस्ट्तीकरण.— (1) िहााँ भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण को जनरस्ट्त करने का आिेि दकया गया है, वहााँ वह व्यजि जिसका रजिस्ट्रीकरण जनरस्ट्त दकया गया है या वह कोई अन्द्य व्यजि जिसके पास संबंजधत व्यजि को िारी दकया गया भारत के जविेिी नागररक काडा भौजतक रूप में है, केंरीय सरकार द्वारा जलजखत सूचना के माध्यम से अपेजित दकए िाने पर, उि काडा की मूल प्रजत, ऐसे व्यजि को तर्ा ऐसी अवजध के भीतर, िो सूचना में जवजनर्िाष्ट की िाए, पररित्त करेगा। (2) भारत के जविेिी नागररक काडा पररित्त दकए िाने पर, उसे जनरस्ट्त कर दिया िाएगा और यदि काडा पररित्त नहीं दकया िाता है, तो केंरीय सरकार यह जनिेि िे सकेगी दक उसे जनरस्ट्त माना िाएगा। (3) िहााँ दकसी व्यजि के संबंध में भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण को जनरस्ट्त करने का आिेि दकया गया है जिसे इ-ओ सी आई रजिस्ट्रीकरण िारी दकया गया है, वहााँ केंरीय सरकार यह जनिेि िे सकेगी दक इसे जनरस्ट्त माना िाएगा। (4) िारी कताा प्राजधकारी, जनयम 33 के उप-जनयम (2) के अधीन इलेक्ट्रॉजनक रूप में अनुरजित अजभलेख में, भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण के जनरस्ट्तीकरण का उल्लेख करते हुए, उपयुि प्रजवजष्ट करेगा।” 8. उि जनयमों में, जनयम 42 के स्ट्र्ान पर जनम्नजलजखत जनयम रखा िाएगा, अर्ाात्:— “42. अजधजनयम के अधीन पाररत आिेि के पुनरीिण के जलए प्राजधकारी.— (1) यदि दकसी व्यजि द्वारा, िो अजधजनयम के उपबंधों के अधीन नागररकता हेतु उसके आवेिन के संबंध में दकसी प्राजधकारी द्वारा पाररत आिेि से व्यजर्त है, धारा 15 के अधीन पुनरीिण हेतु आवेिन दकया िाता है, तो ऐसे आवेिन का [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 जनपर्ारा उस प्राजधकारी से एक रैंक उच्च प्राजधकारी द्वारा दकया िाएगा, िो नागररकता के जलए आवेिन के जनपर्ान हेतु जवजनर्िाष्ट है। (2) यदि दकसी व्यजि द्वारा, िो धारा 7क के अधीन भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण हेतु उसके आवेिन के संबंध में संबंजधत भारतीय जमिन या पोस्ट्र् अर्वा संबंजधत जविेिी िेत्रीय रजिस्ट्रीकरण अजधकारी द्वारा पाररत आिेि से, या धारा 7घ के अधीन भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण के जनरस्ट्तीकरण पर उि प्राजधकाररयों द्वारा पाररत आिेि से व्यजर्त है, धारा 15 के अधीन पुनरीिण हेतु आवेिन दकया िाता है, तो ऐसे आवेिन का जनपर्ारा ऐसे प्राजधकारी द्वारा दकया िाएगा, जिसे केंरीय सरकार द्वारा जवजनर्िाष्ट दकया िाए। (3) उप-जनयम (1) और (2) के अधीन आने वाले सभी मामलों में, पुनरीिण हेतु आवेिन का जनपर्ारा, प्रभाजवत व्यजि को अपना पि प्रस्ट्तुत करने का युजिसंगत अवसर प्रिान करने के पश्चात दकया िाएगा।” 9. उि जनयमों में, जनयम 42 के पश्चात् जनम्नजलजखत जनयम अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाात्:— “42क. अजधजनयम के अधीन दकए गए आिेि के पुनर्वालोकन हेतु आवेिन.— यदि दकसी व्यजि द्वारा धारा 15क के अधीन पुनर्वालोकन हेतु आवेिन दकया िाता है, तो उि पुनर्वालोकन आवेिन का जनपर्ारा केंरीय सरकार द्वारा, प्रभाजवत व्यजि को अपना पि प्रस्ट्तुत करने का युजिसंगत अवसर प्रिान करने के पश्चात् दकया िाएगा।” 10. उि जनयमों में, अनुसूची 1 में— (i) प्ररूप 1 के भाग 2 की क्रम संख्या 10 और उससे सम्बंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत क्रम संख्या अंतःस्ट्र्ाजपत की िाएाँगी, अर्ाात्:— “10क. मैं, ……………, यह भी ध्यान रखता/रखती हाँ दक मेरा अवयस्ट्क बालक …………. दकसी भी समय भारतीय पासपोर्ा धाररत करते हुए दकसी अन्द्य िेि का पासपोर्ा धारण नहीं कर सकता।”; (ii) प्ररूप 28 में— (i) भारतीय मूल के आवेिक से सम्बंजधत भाग – क में क्रम संख्या 2 और उससे सम्बंजधत प्रवजष्टयों का लोप दकया िाएगा; (ii) पजत या पत्नी आधाररत आवेिक से सम्बंजधत भाग क में, क्रम संख्या 2 और उससे सम्बंजधत प्रवजष्टयों का लोप दकया िाएगा; (iii) घोषणा में, पैरा 4 के पश्चात् जनम्नजलजखत पैरा अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाात्:— “5. मैं एतद्द्वारा अपनी सहमजत प्रिान करता/करती हाँ दक— (i) भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण हेतु संकजलत की िाने वाली मेरी िैवजमतीय िानकारी को, भजवष्य में िब भी मैं फास्ट्र् रैक इजमग्रेिन प्रोग्राम का लाभ उठाने हेतु आवेिन करूाँ, उस प्रोग्राम के अंतगात मेरे रजिस्ट्रीकरण के प्रयोिन के जलए साझा दकया िाए; अर्वा (ii) भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण हेतु संकजलत मेरी िैवजमतीय िानकारी का उपयोग करते हुए, फास्ट्र् रैक इजमग्रेिन प्रोग्राम के अंतगात मेरे स्ट्वतः रजिस्ट्रीकरण पर जवचार दकया िाए। [िो लागू न हो, उसे हर्ा िें]”; (ग) प्ररूप 29 के स्ट्र्ान पर जनम्नजलजखत प्ररूप रखा िाएगा, अर्ाात्:— 4 THE GAZETTE OF INDIA : सजम्मजलत दकए िाने वाले जववरण 1. जवजिष्ट ओसीआई संख्या 2. ओसीआई रजिस्ट्रीकरण का प्रवगा 3. नाम 4. राष्ट्रीयता 5. ललंग 6. िन्द्म जतजर् 7. ओसीआई िारी करने की जतजर् 8. वैधता की जतजर् 9. िारी करने का स्ट्र्ान 10. पासपोर्ा संख्या 11. पूवा पासपोर्ा (यदि कोई हो) 12. जपता का नाम 13. माता का नाम 14. पजत/पत्नी का नाम 15. वतामान पता” ; (iv) प्ररूप 30 के स्ट्र्ान पर जनम्नजलजखत प्ररूप रखा िाएगा, अर्ाात् :— फोटोग्राफ [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 “प्ररूप 30 [जनयम 33(2), िेखें] नागररकता जनयम, 2009 नागररकता अजधजनयम, 1955 की धारा 7क के अधीन भारत के जविेिी नागररक (OCI) काडाधारक के रूप में रजिस्ट्रीकृत तर्ा धारा 7ग के अधीन त्याग करने वाले और धारा 7घ के अधीन रद्द दकए गए व्यजियों का रजिस्ट्र्र क्र म सं. आवेि क का पूरा नाम और पता जपता का नाम माता का नाम पजत/प त्नी का नाम िन्द्म स्ट्र्ान प्ररूप रखा िाएगा, अर्ाात्:- ‘प्ररूप 31 [जनयम 34(1) िेखें] नागररकता जनयम, 2009 भारत के जविेिी नागररक काडाधारक द्वारा नागररकता अजधजनयम, 1955 की धारा 7ग(1) के अधीन भारत के जविेिी नागररक काडाधारक के रूप में रजिस्ट्रीकरण के काडा अर्वा ई-ओसीआई रजिस्ट्रीकरण के त्यिन की घोषणा 1. मैं, ………… (यहााँ घोषणाकताा का पूरा नाम और पता अंदकत करें), पूणा आयु और जवजधक िमता का हाँ तर्ा मेरा िन्द्म ………….. को ………….. Short title and commencement. — (1) These rules may be called the Citizenship (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Citizenship Rules, 2009 (hereinafter referred to as the said rules), in rule 3, the following proviso shall be inserted, namely: - “Provided that the applicant in such cases shall note that the minor child cannot at any time hold the passport of any other country while also holding the Indian passport.”. 3. In the said rules, in rule 29, for sub-rule (1), the following sub-rule shall be substituted, namely:— 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(1) An application for registration as an Overseas Citizen of India cardholder under section 7A shall be made in Form XXVIII electronically on the designated online portal, namely, https://ociservices.gov.in.” 4. In the said rules, in rule 31, – (i) in the opening portion, the words “in duplicate” shall be omitted; (ii) in clause (a), sub-clause (ii) shall be omitted. 5. In the said rules, for rule 33, the following rule shall be substituted, namely:— “33. Registration as Overseas Citizen of India cardholder and maintenance of register of persons under section 7A.— (1) Every person, who is registered as an Overseas Citizen of India cardholder under section 7A shall be issued an Overseas Citizen of India card in physical form or an electronic Overseas Citizen of India (e-OCI) registration containing the details as in Form XXIX. (2) The issuing authority shall maintain a record of the persons registered as Overseas citizen of India cardholder as in Form XXX in electronic form.”. 6. In the said rules, for rule 34, the following rule shall be substituted, namely :— “34. Declaration of renunciation of Overseas Citizen of India card.— (1) A declaration of renunciation of the card registering a person as an Overseas Citizen of India cardholder under section 7C shall be made in Form XXXI electronically on the designated online portal, namely, https://ociservices.gov.in to the Indian Mission or Post concerned or the Foreigners Regional Registration Officer concerned and in case of Overseas Citizen of India card issued in physical form, the original of the Overseas Citizen of India card shall also be surrendered to the Indian Mission or Post concerned or the Foreigners Regional Registration Officer concerned. (2) On receipt of the declaration of renunciation of the card registering as an Overseas Citizen of India cardholder and surrender of the original Overseas Citizen of India card (in cases where the Overseas Citizen of India card has been issued in physical form), the Indian Mission or Post concerned or the Foreigners Regional Registration Officer concerned shall issue an acknowledgment in Form XXXII electronically on the designated online portal, namely, https://ociservices.gov.in and remove the name of the declarant from the record maintained in electronic form under sub-rule (2) of rule 33.”. 7. In the said rules, for rule 35, the following rule shall be substituted, namely:— “35. Cancellation of registration as Overseas Citizen of India cardholder.— (1) Where an order has been made cancelling the registration as an Overseas Citizen of India cardholder, the person whose registration has been cancelled or any other person in possession of the Overseas Citizen of India card in physical form issued to the person concerned shall, when required by notice in writing by the Central Government, deliver the said card in original to such person and within such period as may be specified in the notice. (2) On the Overseas Citizen of India card being delivered, it shall be cancelled and in case the card is not delivered, then the Central Government may direct that it shall be treated as cancelled. (3) Where an order has been made cancelling the registration as an Overseas Citizen of India cardholder in respect of a person who has been issued an e-OCI registration, the Central Government may direct that the e-OCI registration shall be treated as cancelled. (4) The issuing authority shall make an appropriate entry in the record maintained in the electronic form under sub-rule (2) of rule 33 stating the cancellation of registration as Overseas Citizen of India cardholder.”. 8. In the said rules, for rule 42, the following rule shall be substituted, namely :— [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 “42. Authority for revision of an order made under Act.— (1) If an application for revision is made under section 15 by a person aggrieved by an order made by an authority with reference to his application for citizenship under the provisions of the Act, the application shall be disposed of by an authority one rank higher than the authority specified for disposal of the application for citizenship. (2) If an application for revision is made under section 15 by a person aggrieved by an order made by an Indian Mission or Post concerned or the Foreigners Regional Registration Officer concerned with reference to his application for registration as an Overseas Citizen of India cardholder under section 7A or an order made by the said authorities on cancellation of the registration as an Overseas Citizen of India cardholder under section 7D, the application shall be disposed of by an authority as may be specified by the Central Government. (3) In all such cases covered by sub-rules (1) and (2), the application for revision shall be disposed of after giving a reasonable opportunity to the person affected to present his case.”. 9. In the said rules, after rule 42, the following rule shall be inserted, namely:— “42A. Application for review of order made under Act.— If an application is made by a person for review under section 15A, the said application for review shall be disposed of by the Central Government after giving a reasonable opportunity to the person affected to present his case.”. 10. In the said rules, in Schedule I, – (a) in Form I, in PART II, after serial number 10 and the entries relating thereto, the following serial number shall be inserted, namely :— “10A. I, ……………, have also noted that my minor child …………. cannot at any time hold the passport of any other country while also holding the Indian passport.” ; (b) in Form XXVIII,— i. In Part A relating to Indian Origin Applicant, serial number 2 and the entries relating thereto shall be omitted; ii. In Part A relating to Spouse Based Applicant, serial number 2 and the entries relating thereto shall be omitted; iii. in the DECLARATION, after paragraph 4, the following paragraph shall be inserted, namely:- “5. I hereby give my consent to — (i) share my biometric information that will be captured for registration as an Overseas Citizen of India cardholder for the purpose of my registration under the Fast Track Immigration Programme whenever I submit an application for availing such Programme in future; or 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) consider my automatic registration under the Fast Track Immigration Programme using the biometric information captured for registration as an Overseas Citizen of India cardholder. [Delete whichever is not applicable].”; (c) for Form XXIX, the following Form shall be substituted by following Form, namely:— “FORM XXIX [See rule 33(1)] THE CITIZENSHIP RULES, 2009 DETAILS TO BE INCORPORATED IN THE OVERSEAS CITIZEN OF INDIA CARD TO BE ISSUED TO THE APPLICANT EITHER IN PHYSICAL FORM OR AS e-OCI REGISTRATION 1. Unique OCI number 2. Category of OCI Registration 3. Name 4. Nationality 5. Gender 6. Date of Birth 7. OCI Issue Date 8. Valid Till 9. Place of Issue 10. Passport Number 11.
