पत्तन, पोत पररवहन और िलमागग मंत्रालय अजधसूचना नई दिल्ली 6, िुलाई, 2026 सा.का.जन. 583(अ).—केंद्रीय सरकार वाजणज्य पोत पररवहन अजधजनयम, 2025 (2025 का 24) की धारा 212 की उपधारा (1) के खंड (क) और धारा 216 की उपधारा (4) के साथ परित धारा 222 द्वारा प्रित्त िजियों का प्रयोग करते हुए तथा वाजणज्य पोत पररवहन (तेल प्रिूषण क्षजत के प्रजतकर के जलए अन्तरागष्ट्रीय जनजध) जनयम, 2008 को, उन बातों के जसवाय जिन्हें ऐसे अजधक्रमण से पूवग दकया गया था या दकए िाने का लोप दकया गया था, अजधक्रान्त करते हुए जनम्नजलजखत जनयम बनाती है, अथागत् :-

1. संजक्षप्त नाम, प्रारंभ और लागू होना— (1) इन जनयमों का संजक्षप्त नाम वाजणज्य पोत पररवहन (तेल प्रिूषण क्षजत के प्रजतकर के जलए अन्तरागष्ट्रीय जनजध) जनयम, 2026 है (2) ये जनयम रािपत्र में इनके प्रकािन दक तारीख को प्रवृत्त होंगे । (3) ये जनयम तटीय समुद्र सजहत भारत के राज्य क्षेत्र में काररत प्रिूषण क्षजत और ऐसी प्रिूषण क्षजत का जनवारण करने या उसे कम करने के जलए जनवारणात्मक उपायों, िहां कहीं भी दकए िाएं, के संबंध में लागू होंगे ।

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) “प्ररूप” से इन जनयमों के साथ उपाबद्ध प्ररूप अजभप्रेत है; (ग) “जनजध अजभसमय” से तेल प्रिूषण क्षजत, 1992, यथा संिोजधत, के जलए प्रजतकर हेतु दकसी अंतरागष्ट्रीय जनजध की स्ट्थापना के संबंध में अंतरागष्ट्रीय अजभसमय अजभप्रेत है; (घ) “टन भार” से कुल टन भार अजभप्रेत है, िो अजधजनयम के अधीन बनाए गए लागू जनयमों के अनुसार संगजणत है। (2) ऐसे िब्ि और पि जिन्हें इन जनयमों में प्रयुि दकया गया है दकन्तु पररभाजषत नहीं दकया गया है, दकन्तु अजधजनयम में पररभाजषत है, का वही अथग होगा िा अजधजनयम में क्रमिः उनके है। 3. सहायक व्यजि— अजधजनयम की धारा 212 की उपधारा (1) के खंड (क) के प्रयोिनों के जलए “सहायक व्यजि” पि में जनम्नजलजखत सजममजलत होगा, अथागत् :- (क) कंपनी अजधजनयम, 2013 (2013 का 18) की धारा 2 की उपधारा (87) में यथा पररभाजषत कोई सहायक कंपनी; (ख) कंपनी अजधजनयम, 2013 (2013 का 18) की धारा 2 की उपधारा (46) में यथा पररभाजषत कोई धाररत कंपनी; (ग) कोई ऐसी इकाई िो अजभिायकताग को जनयंजत्रत करती है या अजभिायकताग द्वारा जनयंजत्रत होती है या अजभिायकताग के पास सामान्य जनयंत्रण के अधीन है; और स्ट्पष्टीकरण— खंड (ग) के प्रयोिनों के जलए, ‘जनयंत्रण’ पि का वही अथग होगा िो कंपनी अजधजनयम, 2013 (2013 का 18) की धारा 2 की उपधारा (27) में उसका है । (घ) दकसी सीजमत िाजयत्व साझेिारी की ििा में, कोई व्यजि या इकाई, जिसे नामजनर्िगष्ट साझेिारों को बहुमत में जनयुि करने का अजधकार है, िहां अन्य का जवजनर्िगष्ट अपविगन करने वाले ऐसे नामजनर्िगष्ट साझेिारों का ऐसी सीजमत िाजयत्व भागीिारी की संपूणग नीजतयों पर जनयंत्रण है। 4. जनजध के जलए अजभिाय करने के जलए िायी व्यजि द्वारा घोषणा— कोई व्यजि िो अजधजनयम की धारा 213 के उपबंधों के अनुसार जनजध अजभिाय करने के जलए िायी है, इन जनयमों के साथ उपाबद्ध प्ररूप में जवजनर्िगष्ट सूचना महाजनिेिक को प्रस्ट्तुत करेगा। 5. नोरटस के अनुसरण में सूचना का प्रस्ट्तुतीकरण— (1) िहां कोई, िो व्यजि जनजध के जलए अजभिाय करने के जलए िायी है, जनयम 4 या अन्यथा के अधीन अपेजक्षत सूचना प्रस्ट्तुत करने में जवफल रहता है, तो महाजनिेिक जनयम 4 के अधीन अपेजक्षत सूचना प्रस्ट्तुत करने के जलए ऐसे व्यजि को अजधजनयम की धारा 217 की उपधारा (1) के अधीन कोई नोरटस िारी करेगा। (2) उपजनयम (1) में जनर्िगष्ट सूचना ऐसे नोरटस की प्राजप्त से िो सप्ताह के भीतर या ऐसी और अवजध के भीतर प्रस्ट्तुत की िाएगी, िो महाजनिेिक द्वारा जलजखत में अनुज्ञात की िाए। (3) कोई व्यजि िो इस जनयम के उल्लंघन में दकसी नोरटस के अनुपालन से इंकार करता है या िानबूझकर निरअंिाि करता है या कोई जमथ्या कथन करता है, अजधजनयम की धारा 281 की उपधारा (2) में यथा जवजनर्िगष्ट दकसी िाजस्ट्त के जलए िायी होगा। 6. जनजध के जलए सूचना ररपोटग करने के जलए बाध्यता— महाजनिेिक यथाजस्ट्थजत जनयम 4 या जनयम 5 के अधीन प्राप्त सूचना जनजध को अग्रेजषत करेगा। 7. लेखों की इकाईयां— (1) जनजध अजभसमय में जनर्िगष्ट लेखा की इकाईयां अंतरागष्ट्रीय मुद्रा जनजध द्वारा यथा पररभाजषत जविेष आहरण अजधकार हैं।

MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 6th July, 2026 G.S.R. 583(E).—In exercise of the powers conferred by section 222 read with clause (a) of sub-section (1) of section 212, and sub-section (4) of section 216 of the Merchant Shipping Act, 2025 (24 of 2025) and in supersession of the Merchant Shipping (International Fund for Compensation for Oil Pollution Damage) Rules, 2008, except in respect of things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: –

1. Short title, commencement and application. — (1) These rules may be called the Merchant Shipping (International Fund for Compensation for Oil Pollution Damage) Rules, 2026. (2) These rules shall come into force on the date of their publication in the Official Gazette. (3) These rules shall apply to pollution damage caused in the territory of India, including the coastal waters, and to preventive measures, wherever taken, to prevent or minimise such pollution damage.
2. Definitions. — (1) In these rules, unless the context otherwise requires, - (a) “Act” means the Merchant Shipping Act, 2025 (24 of 2025); (b) “form” means the form appended to these rules; (c) “Fund Convention” means the International Convention on the establishment of an International Fund for Compensation for Oil Pollution Damage, 1992, as amended; and (d) “tonnage” means the gross tonnage, which is calculated in accordance with the applicable rules made under the Act. (2) The words and expressions used in these rules but not defined, but defined in the Act shall have the meanings respectively assigned to them in the Act.
3. Associated person. — For the purposes of clause (a) of sub-section (1) of section 212 of the Act, the term “associated person” shall include the following, namely:— (a) a subsidiary company, as defined in sub-section (87) of section 2 of the Companies Act, 2013 (18 of 2013); (b) a holding company, as defined in sub-section (46) of section 2 of the Companies Act, 2013 (18 of 2013); (c) an entity which controls the contributor or is controlled by the contributor or is under common control with the contributor; and Explanation. – For the purpose of clause (c), the term ‘control’ shall have the same meaning as assigned under sub-section (27) of section 2 of the Companies Act, 2013 (18 of 2013); (d) a limited liability partnership in which the contributor has the right to appoint majority of the designated partners, where such designated partners, with specific exclusion to others, have control over all the policies of such limited liability partnerships.
4. Declaration by persons liable to contribute to the Fund. — Any person who is liable to contribute to the Fund as per the provisions of section 213 of the Act shall submit to the Director-General information specified in the Form annexed to these rules.
5. Furnishing of information pursuant to notice. — (1) Where any person liable to contribute to the Fund fails to furnish information required under rule 4 or otherwise, the Director-General shall issue a notice under sub-section (1) of section 217 of the Act to such person for furnishing information required under rule 4. (2) The information referred to in sub-rule (1) shall be furnished within two weeks of the receipt of such notice, or within such further period as may be permitted in writing by the Director-General. (3) Any person who refuses or wilfully neglects to comply with a notice or makes any false statement in contravention of this rule shall be liable to a penalty as specified in sub-section (2) of section 281 of the Act.

Obligation to report information to Fund. — The Director-General shall forward to the Fund information received under rule 4 or rule 5, as the case may be. 7. Units of accounts. — (1) The units of account referred to in the Fund Convention are the special drawing rights as defined by the International Monetary Fund. (2) The units of account shall be converted into Indian rupees according to the official value in rupees of the special drawing rights as determined by the Reserve Bank of India on the date of the decision of the Assembly of the Fund as to the first date of payment of compensation.
