सा.का.जन. 516(अ).––संजिधान के अनुच्छेि 309 के परंतुक द्वारा प्रित्त िजियों का प्रयोग करते हुए, राष्ट्रपजत,
सीमा िुल्क और केंद्रीय उत्पाि िुल्क समझौता आयोग (अध्यक्ष, उपाध्यक्ष और सिस्ट्यों की भती और सेिाितत) जनयमािली,
2015 में संिोधन करने के जलए जनम्नजलजखत जनयम बनाते हैं, अर्ात:-
1. (1) इन जनयमों को सीमा िुल्क और केंद्रीय उत्पाि िुल्क समझौता आयोग (अध्यक्ष, उपाध्यक्ष और सिस्ट्यों की भती
और सेिाितत) संिोधन जनयमािली, 2025 कहा िा सकेगा।
(2) यह दिनांक 1 अप्रैल, 2025 को प्रिृत्त समझे िाएंगे।
2. सीमा िुल्क और केंद्रीय उत्पाि िुल्क समझौता आयोग (अध्यक्ष, उपाध्यक्ष और सिस्ट्यों की भती और सेिाितत)
जनयमािली, 2015 के जनयम 7 में, िूसरे परंतुक के पश्चात्, जनम्नजलजखत परंतुक अंतःस्ट्र्ाजपत दकया िाएगा, अर्ात्: -
“यह भी प्रािधान है दक अध्यक्ष, उपाध्यक्ष या सिस्ट्य के रूप में जनयुि कोई भी व्यजि, िो इस संबंध में केंद्र सरकार
द्वारा अजधसूजचत की िाने िाली जतजर् से ठीक पूित उस पि पर आसीन है, उस जतजर् से उस पि पर नहीं रहेगा और
िे अपने कायतकाल अिजध की समयपूित समाजि के जलए तीन महीने के िेतन और भत्ते से अजधक मुआििे का िािा
करने के हकिार नहीं होंगे।”

स्ट्पष्टीकरण ज्ञापन: सीमा िुल्क और केंद्रीय उत्पाि िुल्क समझौता आयोग (अध्यक्ष, उपाध्यक्ष और सिस्ट्यों की और सेिाितत)
संिोधन जनयमािली, 2025 को जित्त अजधजनयम, 2025 की धारा 106 के अनुसरण में दिनांक 1 अप्रैल, 2025 से पूितव्यापी
प्रभाि दिया िा रहा है, जिसमें सीमा िुल्क और केंद्रीय उत्पाि िुल्क समझौता आयोग (अध्यक्ष, उपाध्यक्ष और सिस्ट्यों की
भती और सेिाितत) जनयमािली, 2015 के जनयम 7 के तहत िूसरे प्रािधान के बाि एक प्रािधान डालने का प्रस्ट्ताि है।
इसजलए, यह प्रमाजणत दकया िाता है दक इस अजधसूचना से दकसी भी व्यजि के जहत पर प्रजतकूल प्रभाि नहीं पडेगा।

NOTIFICATION
New Delhi, the 31st July, 2025
G.S.R. 516(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the
President hereby makes the following rules further to amend the Customs and Central Excise Settlement Commission
(Recruitment and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 2015, namely: -
1. (1) These rules may be called the Customs and Central Excise Settlement Commission (Recruitment and
Conditions of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2025.
(2) They shall be deemed to have come into force on the 1st day of April, 2025.
2. In the Customs and Central Excise Settlement Commission (Recruitment and Conditions of Service of Chairman,
Vice-Chairmen and Members) Rules, 2015, in rule 7, after the second proviso, the following Proviso shall be inserted,
namely: -
“Provided also that any person appointed as Chairman, Vice-Chairman or Member holding office as such
immediately before the date to be notified by the Central Government in this behalf, shall on and from such date,
cease to hold such office, and they shall be entitled to claim compensation not exceeding three months' pay and
allowances for the premature termination of term of their office.”.

Note: The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated
the 30th March, 2015 vide notification number G.S.R. 236(E), dated the 27th March, 2015 and were last amended vide
notification number G.S.R. 829 (E), dated the 23 August, 2016.
Explanatory Memorandum: The Customs and Central Excise Settlement Commission (Recruitment and Conditions
of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2025 is being given the retrospective effect
from the 1st April, 2025 in pursuance of section 106 of the Finance Act, 2025 proposing to insert a proviso after the
second proviso in rule 7 of the Customs and Central Excise Settlement Commission (Recruitment and Conditions of
Service of Chairman, Vice-Chairmen and Members) Rules, 2015. Therefore, it is certified that no person interest will
be adversely affected by this notification.
