अधिसूचना नई दिल्ली, 17 जून, 2026 सा.का.नन. 494(अ).—ननम्नललखित मसौिा ननयम, जो केंद्रीय सरकार िूरसंचार अधिननयम, 2023 (2023 का 44) की िारा 4 की उप-िारा (3) और िारा 8 की उप-िारा (2) के साथ पदित िारा 56 की उप-िारा (1) और उप-िारा (2) के िंड (छ) और (ड) द्वारा प्रित्त शक्ततयों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, इसके द्वारा प्रभाववत होने की संभावना वाले सभी व्यक्ततयों की जानकारी के ललए एति द्वारा प्रकालशत करती है और सूधचत करती है कक राजपत्र में यथा प्रकालशत इस अधिसूचना की प्रनतयां सववसािारण के ललए उपलब्ि कराए जाने की तारीि से तीस दिनों की अवधि की समाक्तत के बाि उतत मसौिा ननयमों पर ववचार ककया GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] यदि कोई आपवत्त या सुझाव हो तो संयुतत सधचव (िूरसंचार), िूरसंचार ववभाग, संचार मंत्रालय, भारत सरकार, संचार भवन, 20, अशोका रोड, नई दिल्ली- 110001 को भेजे जा सकते हैं: उतत मसौिा ननयमों के संबंि में उपयुवतत अवधि की समाक्तत से पहले ककसी भी व्यक्तत से प्रातत होने वाली आपवत्तयों या सुझाव पर केंद्रीय सरकार द्वारा ववचार ककया जाएगा। अध्याय I प्रारंभभक 1. संक्षिप्त नाम और प्रारंभ- (1) इन ननयमों को िूरसंचार (प्रशासननक प्रकिया द्वारा स्पेतरम समनुिेशन) ननयम, 2026 कहा जा सकता है। (2) ये उस नतधथ से लागू होंगे जो केन्द्द्रीय सरकार राजपत्र में अधिसूचना द्वारा ववननदिवष्ट करे। 2. पररभाषाएँ— (1) इन ननयमों में, जब तक कक संिभव में अन्द्यथा आवश्यकता न हो- (क) "अधिननयम" का तात्पयव िूरसंचार अधिननयम, 2023 (2023 का 44) है; (ि) "आशय पत्र" का तात्पयव ननयम 6 के उप-ननयम (1) के तहत जारी ककया गया पत्र है; (ग) "पोटवल" का तात्पयव ननयम 14 में ननदिवष्ट पोटवल है; (घ) "स्पेतरम समनुिेशन" का तात्पयव ननयम 6 के उप-ननयम (4) के तहत ककसी रेडडयो स्टेशन द्वारा स्पेतरम के उपयोग के ललए जारी की गई अनुमनत है; तथा (ङ) "स्पेतरम प्रभार" का तात्पयव रेडडयो स्टेशन या रेडडयो उपकरण के ललए स्पेतरम शुल्क और वो शुल्क है, जो अनुसूची II के संगत अनुलग्नक में ववननदिवष्ट है। (2) इन ननयमों में प्रयुतत शब्ि और अलभव्यक्ततयााँ जो यहााँ पररभावित नहीं हैं लेककन अधिननयम, उसके अिीन बनाए गए ननयम या केन्द्द्रीय सरकार द्वारा प्रकालशत राष्रीय आवृवत्त आवंटन योजना (नेशनल फ़्रीतवेंसी अलॉटमेंट तलान) में पररभावित हैं, के अथव वही होंगे जो उन्द्हें िमशः अधिननयम, उतत ननयमों या उतत योजना में दिए गए हैं । 3. काययिेत्र और प्रयोज्यता--(1) ये ननयम अधिननयम की पहली अनुसूची में सूचीबद्ि प्रववक्ष्टयों के संबंि में प्रशासननक प्रकिया द्वारा स्पेतरम समनुिेशन के ननबंिन और शतों को ननिावररत करते हैं। (2) इन ननयमों की अनुसूची-I में ऐसे व्यक्ततयों को ववननदिवष्ट ककया गया है जो अधिननयम की प्रथम अनुसूची की प्रववक्ष्टयों के संबंि में प्रशासननक प्रकिया द्वारा स्पेतरम समनुिेशन के ललए आवेिन कर सकते हैं, , ऐसी प्रववक्ष्टयों के ललए ववलशष्ट उपयोगों, ऐसी प्रववक्ष्टयों के ललए लागू अनुसूची-II के अनुलग्नकों [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 के साथ-साथ इन ननयमों की अनुसूची-II और स्पेतरम समनुिेशन के ननबंिन और शतों जो प्रत्येक अनुलग्नक के ललए ववलशष्ट हैं, और स्पेतरम प्रभारों के ननिावरण के ललए कायवप्रणाली को ववननदिवष्ट करते हैं । 4. पात्रता शतें- (1) इन ननयमों के तहत स्पेतरम समनुिेशन के ललए आवेिन करने वाला कोई भी व्यक्तत इन ननयमों में और अनुसूची I की प्रासंधगक प्रववक्ष्ट में ननदिवष्ट पात्रता मानिंडों को पूरा करेगा। (2) यदि स्पेतरम समनुिेशन के ललए आवेिन करने वाला व्यक्तत केंद्रीय सरकार, राज्य सरकार, ऐसी सरकार द्वारा नालमत एजेंसी या कानून के तहत स्थावपत एक सांववधिक ननकाय नहीं है, तो यह ननम्नललखित पात्रता मानिंडों को पूरा करेगा, अथावत्:- (क) यदि ऐसा व्यक्तत एक कंपनी है, तो ऐसी कंपनी में प्रत्यक्ष वविेशी ननवेश, यदि कोई हो, भारत के मौजूिा कानूनों और नीनतयों के अनुरूप होगा; तथा (ि) यदि ऐसा व्यक्तत एक कंपनी है, तो ऐसी कंपनी में प्रमुि प्रबंिकीय कमवचारी ऐसे सुरक्षा संबंिी मानिंडों को पूरा करेंगे क्जन्द्हें केंद्रीय सरकार पोटवल पर ववननदिवष्ट कर सकती है। स्पष्टीकरण— इन ननयमों के प्रयोजनों के ललए, अलभव्यक्तत— (क) "लाइसेंस" का तात्पयव ककसी लाइसेंस, पंजीकरण या अनुमनत, ककसी भी नाम से ज्ञात हो, भारतीय टेलीग्राफ अधिननयम, 1885 (1885 का 13) के तहत िी गई मंजूरी से है; तथा (ि) "प्रत्यक्ष वविेशी ननवेश" का वही अथव होगा जो वविेशी मुद्रा प्रबंिन अधिननयम, 1999 (1999 का 42) के तहत गैर-ऋण ललितों के संबंि में बनाए गए ननयमों में इसे दिया गया है। (3) उप-ननयम (1) से (2) के तहत ववननदिवष्ट व्यक्तत अधिननयम की पहली अनुसूची की प्रासंधगक प्रववक्ष्ट के तहत स्पेतरम समनुिेशन के प्रयोजनों के ललए केंद्रीय सरकार द्वारा पोटवल पर यथा ववननदिवष्ट ककसी अन्द्य मानिंड का भी पालन करेंगे। अध्याय II स्पेक्ट्रम समनुदेशन का आिेदन और मंजूरी 5. आिेदन- (1) इन ननयमों के अिीन स्पेतरम समनुिेशन प्रातत करने का इच्छुक कोई भी व्यक्तत ऐसे प्रपत्र और रीनत से और एक हजार रुपए के अप्रनतिेय आवेिन शुल्क के भुगतान और ऐसी सूचना और िस्तावेजों के साथ एक आवेिन प्रस्तुत करेगा, जो केंद्रीय सरकार पोटवल पर ववननदिवष्ट करे क्जसमें शालमल हैं- (क) स्पेतरम का ववननदिवष्ट उपयोग; (ि) आवेिक द्वारा िाररत प्राधिकार या लाइसेंस का प्रकार, यदि लागू हो; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) ववधिपूणव अपरोिन करने वाले लसस्टम, ववधिपूणव अपरोिन की ननगरानी करने वाली सुवविाओं और केंद्रीय सरकार द्वारा बताई गई ककसी भी अन्द्य अनतररतत कायावत्मक आवश्यकता, यदि लागू हो, के सफल प्रिशवन का प्रमाण; (घ) संचालन का भौगोललक क्षेत्र; (ङ) ऐसे उपकरणों की तकनीकी डेटा शीट के साथ-साथ आवश्यक रेडडयो उपकरणों का अनुमाननत प्रकार और मात्रा; (च) आवृवत्त रेंज और रांसलमशन पैरामीटर, क्जसमें बैंडववड्थ, मोड, उत्सजवन डेक्िग्नेटर, रांसलमट पावर, स्पेतरम के उपयोग के ललए आवश्यक ईआईआरपी स्तर, और उपयोग ककए जाने वाले सैटेलाइट नेटवकव की जानकारी, इसके कक्षीय मापिंडों और रेडडयो संचार सेवा के साथ, यदि लागू हो, शालमल है; (छ) प्रस्ताववत अवधि क्जसके ललए स्पेतरम समनुिेशन की मांग की गई है; तथा (ज) लागू कानून के तहत अनुमनतयां यदि लागू हो तो, उस क्षेत्र के ललए संगत क्जसके ललए समनुिेशन मांगा गया है। बशते कक जहां ऐसा उपकरण है जो िूरसंचार को अवरुद्ि करता है, उसी के संबंि में समनुिेशन की मांग करने वाला व्यक्तत, ऐसे आवेिन के साथ, अधिननयम की िारा 48 के तहत प्रातत अनुमनत प्रातत करेगा। (2) यदि उप-ननयम (1) के तहत आवेिक एक ननक्श्चत स्थल पर रेडडयो उपकरण स्थावपत करने का इरािा रिता है, तो वह लागू शुल्क के साथ ऐसे प्रकार और तरीके से लागू मंजूरी प्रातत करने के ललए आवेिन करेगा, जैसा कक केंद्रीय सरकार पोटवल पर ववननदिवष्ट कर सकती है: बशते कक यदि केंद्रीय सरकार इस उप-ननयम के तहत आवेिन को अस्वीकार कर िेती है, तो आवेिक इस तरह की मंजूरी के ललए नए लसरे से आवेिन कर सकता है, क्जसमें रेडडयो उपकरण की स्थापना के ललए एक वैकक्ल्पक साइट िी हो: बशते यह भी कक अधिननयम की प्रथम अनुसूची की ननम्नललखित प्रववक्ष्टयों के संबंि में स्पेतरम समनुिेशन के इच्छुक आवेिक स्पेतरम समनुिेशन प्रिान ककए जाने के बाि ऐसी स्वीकृनत के ललए आवेिन कर सकते हैं, अथावत् - (क) प्रववक्ष्ट 1: राष्रीय सुरक्षा और रक्षा; (ि) प्रववक्ष्ट 2: ववधि प्रवतवन और अपराि ननवारण; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ग) प्रववक्ष्ट 11: पक्ब्लक मोबाइल रेडडयो रंककंग सेवाएं; (घ) प्रववक्ष्ट 12: िूरसंचार सेवाओं के ललए रेडडयो बैकहॉल; तथा (ङ) प्रववक्ष्ट 18: भारत संचार ननगम लललमटेड (बीएसएनएल) और महानगर टेलीफोन ननगम लललमटेड (एमटीएनएल)। स्पष्टीकरण--शंकाओं को िूर करने के ललए, यह स्पष्ट ककया जाता है कक उप-ननयम (2) के तहत पूवव मंजूरी प्रातत ककए बबना एक ननक्श्चत स्थल पर रेडडयो उपकरण की स्थापना नहीं की जाएगी। 6. स्पैक्ट्रम समनुदेशन प्रदान करना-(1) केंद्रीय सरकार, ऐसी जांच करने के बाि, जो वह उधचत समझे, आवेिक से ऐसी सूचना प्रस्तुत करने की अपेक्षा करेगी क्जसकी वह मांग कर सकती है और ननयम 5 के उप-ननयम (2) के अिीन लागू स्वीकृनत प्रातत करने के अध्यिीन और स्पेतरम की उपलब्िता और संगत सुरक्षा स्वीकृनतयों, जहां लागू हो, आशय पत्र जारी करेगी: बशते कक केंद्रीय सरकार, जनदहत में, ननयम 5 के उपननयम (2) के िूसरे परंतुक में ववननदिवष्ट के अलावा अधिननयम की पहली अनुसूची की प्रववक्ष्टयों के संबंि में ऐसी लागू स्वीकृनत प्रातत करने से पूवव आशय पत्र जारी कर सकती है। (2) उप-ननयम (1) के तहत जारी ककए गए आशय पत्र में ननम्नललखित ववननदिवष्ट होंगे, अथावत्: - (क) अधिननयम की पहली अनुसूची की प्रासंधगक प्रववक्ष्ट और अनुसूची II के लागू अनुलग्नकों के साथ स्पेतरम समनुिेशन के ववलशष्ट उपयोग; (ि) लागू स्पेतरम प्रभार और ऐसे प्रभारों के भुगतान के ललए समय-सीमा; (ग) आवृवत्त रेंज और रांसलमशन पैरामीटर, क्जसमें बैंडववड्थ, मोड, उत्सजवन डेक्िग्नेटर, संचाररत शक्तत, स्पेतरम के उपयोग के ललए आवश्यक ईआईआरपी स्तर, और उपयोग ककए जाने वाले सैटेलाइट नेटवकव की जानकारी, इसके कक्षीय मापिंडों और रेडडयो संचार सेवा के साथ, यदि लागू हो तो, शालमल है; (घ) संचालन का भौगोललक क्षेत्र; (ङ) प्रासंधगक रेडडयो स्टेशन और ऐसे स्टेशनों का स्थान; तथा (च) रेडडयो उपकरणों का प्रकार और मात्रा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) आशय पत्र का प्राततकताव, ऐसे पत्र में ननदिवष्ट समय-सीमा के भीतर, - (क) ऐसे पत्र में यथा ववननदिवष्ट स्पेतरम प्रभारों के संघटक का भुगतान करेगा, तथा (ि) संबंधित रेडडयो उपकरण की िरीि करेगा। (4) इस बात से संतुष्ट होने पर कक आवेिक द्वारा आशय पत्र में ववननिष्ट अपेक्षाओं को पूरा कर ललया गया है, केंद्रीय सरकार अन्द्य बातों के साथ-साथ ननम्नललखित को ववननिष्ट करते हुए पोटवल के माध्यम से स्पेतरम समनुिेशन प्रिान करेगी, अथावत् - (क) आशय पत्र में ववननदिवष्ट वववरण; तथा (ि) स्पेतरम समनुिेशन की प्रभावी नतधथ और अवधि। बशते कक यदि केंद्रीय सरकार ने रेडडयो उपस्करों की संस्थापना के ललए लागू स्वीकृनत प्रातत करने से पहले आशय पत्र जारी ककया है तो ऐसी स्वीकृनत प्रातत होने के बाि स्पेतरम समनुिेशन प्रिान ककया जाएगा। स्पष्टीकरण- शंकाओं को िूर करने के ललए, यह स्पष्ट ककया जाता है कक यदि स्पेतरम समनुिेशन की अवधि एक कैलेंडर महीने की अवधि से कम है, तो पूरे कैलेंडर महीने के ललए स्पेतरम प्रभार लागू होगा। (5) एक समनुिेलशती के पास अधिननयम की िारा 3 की उप-िारा (1) के िंड (ग) के तहत एक अलग प्राधिकार की अपेक्षा के बबना अपने स्पेतरम समनुिेशन में ननदिवष्ट रेडडयो उपकरण हो सकता है। (6) केंद्रीय सरकार पोटवल पर स्पेतरम समनुिेशन की अधिकतम अवधि और अधिननयम की प्रथम अनुसूची की एक या अधिक प्रववक्ष्टयों के संबंि में इन ननयमों के अिीन प्रिान ककए जाने वाले स्पेतरम समनुिेशन की संख्या की सीमा ननदिवष्ट कर सकती है। 7. सामान्य ननयम और शतें- एक समनुिेलशती ननम्नललखित ननयमों और शतों का पालन करेगा, अथावत्: - (क) अनुमत रेडडयो उपकरणों की एक अद्यतन सूची बनाना और केवल अधिकृत कलमवयों द्वारा इसकी सुरक्षक्षत दहरासत और संचालन सुननक्श्चत करना; (ि) स्पेतरम समनुिेशन की अवधि के िौरान ननयम 4 में ननदिवष्ट पात्रता शतों का पालन करना; (ग) सुननक्श्चत करना कक इसके रेडडयो स्टेशन केवल उन ववलशष्ट उपयोगों के ललए संचाललत होते हैं क्जनके ललए स्पेतरम समनुिेशन प्रिान ककया गया है; (घ) यह सुननक्श्चत करने के ललए सभी आवश्यक उपाय करना कक इसका िूरसंचार नेटवकव अन्द्य अनुमत िूरसंचार नेटवकव में हस्तक्षेप नहीं करे; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (ङ) अपने िूरसंचार नेटवकव को साववजननक िूरसंचार नेटवकव से नहीं जोड़ना, क्जसमें साववजननक क्स्वच्ड टेलीफोन नेटवकव, साववजननक लैंड मोबाइल नेटवकव, सैटेलाइट या इंटरनेट द्वारा वैक्श्वक मोबाइल व्यक्ततगत संचार शालमल है, जब तक कक केंद्रीय सरकार द्वारा अनुमनत न िी जाए; (च) यह सुननक्श्चत करना कक इसका िूरसंचार नेटवकव मानकों के अनुरूप है, जैसा लागू हो, क्जसे केंद्रीय सरकार अधिननयम की िारा 19 के तहत अधिसूधचत मानकों सदहत ननदिवष्ट कर सकती है; (छ) केंद्रीय सरकार के पूवव ललखित अनुमोिन के बबना अपने स्पेतरम समनुिेशन को सौंपना या हस्तांतररत नहीं करना; (ज) भारत की राष्रीय सुरक्षा, साववजननक सुरक्षा, संप्रभुता और अिंडता के दहत में केंद्रीय सरकार द्वारा जारी ककए गए ककसी भी सुरक्षा संबंिी ननिेशों का पालन करना; (झ) पोटवल पर अपने िूरसंचार नेटवकव को प्रभाववत करने वाली अनधिकृत पहुंच, अपरोिन, स्पूकफंग, तलोननंग, जैलमंग या अन्द्य सुरक्षा घटना की ककसी भी घटना की ररपोटव ऐसे प्रपत्र और तरीके से करना, जो इस संबंि में ननदिवष्ट ककया जा सकता है; (ञ) ननम्नललखित के ललए केंद्रीय सरकार और उसके द्वारा प्राधिकृत ककसी भी एजेंसी को सभी आवश्यक सहायता और सहयोग प्रिान करना- (i) अपने रेडडयो उपकरणों के िुरुपयोग, असुरक्षक्षत ककए जाने या गैरकानूनी संचालन से संबंधित मामले; तथा (ii) स्पैतरम के उपयोग के ननयमों और शतों का अनुपालन सुननक्श्चत करने और ननिावररत स्पेतरम के हस्तक्षेप-मुतत उपयोग को सक्षम बनाने के ललए ननगरानी और प्रवतवन; तथा (ट) इसके रेडडयो उपकरणों के नुकसान, चोरी, कब्जे के नुकसान या संदिग्ि िुरुपयोग की ककसी भी घटना की सूचना पोटवल पर ऐसे प्रपत्र और तरीके से िेना, जैसा कक इस संबंि में ननदिवष्ट ककया जा सकता है। 8. स्पेक्ट्रम समनुदेशन के ननबंिन और शतों में संशोिन या पररितयन-(1) स्पेतरम समनुिेशन में ववननदिवष्ट वववरणों में से रेडडयो स्टेशनों के वववरणों, आवृवत्त या ककसी अन्द्य तकनीकी पैरामीटरों में ककसी भी प्रकार के पररवतवन की मांग करने वाला समनुिेलशती पोटवल पर एक हजार रुपये के गैर-वापसी योग्य शुल्क के साथ ऐसे प्रपत्र में एक आवेिन प्रस्तुत करेगा, जैसा कक केंद्रीय सरकार पोटवल पर ववननदिवष्ट कर सकती है। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) केंद्रीय सरकार, उप-ननयम (1) के अिीन ककसी आवेिन की जांच करने और स्पेतरम की उपलब्िता, जहां लागू हो, संगत सुरक्षा स्वीकृनतयों और लागू स्पेतरम प्रभारों के भुगतान के अध्यिीन ऐसे आवेिन को अनुमोदित कर सकती है और एक अद्यतन स्पेतरम समनुिेशन प्रिान कर सकती है। (3) केंद्रीय सरकार, स्वतः संज्ञान लेकर भी समनुिेशन के ननबंिन एवं शतों को संशोधित और उनमें बिलाव अथवा तकनीकी समायोजन भी कर सकती है, क्जसमें आवृवत्त बैंड, शक्तत या उत्सजवनों के प्रकारों के उपयोग में पररवतवन करना भी शालमल है, यदि वह संतुष्ट हो जाती है कक ऐसा करना ननम्नललखित बातों को ध्यान में रिते हुए समीचीन है - (क) राष्रीय आवृवत्त आवंटन योजना के प्राविान; (ि) उपस्करों के संबंि में कुशल स्पेतरम उपयोग को बढावा िेने के ललए बेहतर तकनीकी मानकों को लागू करने की आवश्यकता; (ग) राष्रीय और अंतरावष्रीय रेडडयो हस्तक्षेप शमन आवश्यकता; तथा (घ) स्पेतरम के री-फालमवग, सामंजस्य या इष्टतम उपयोग के संबंि में कोई भी ननयम, जो केंद्रीय सरकार ननिावररत कर सकती है। (4) केंद्रीय सरकार, उप-ननयम (3) के अिीन ककसी संशोिन या लभन्द्नता के अनुसरण में, संबंधित समनुिेलशती को एक अद्यतन स्पेतरम समनुिेशन प्रिान करेगी। (5) समनुिेलशती पोटवल पर केंद्रीय सरकार द्वारा ननदिवष्ट समय-सीमा के भीतर इस ननयम के तहत ककसी भी संशोिन या लभन्द्नता को लागू करेगा। (6) इस ननयम के तहत स्पेतरम समनुिेशन में कोई भी संशोिन या लभन्द्नता मूल रूप से समनुिेलशती को जारी ककए गए स्पेतरम समनुिेशन में ननदिवष्ट अवधि को प्रभाववत नहीं करेगी। अध्याय III निीनीकरण और समपयण 9. निीनीकरण- (1) प्रववक्ष्ट 18, अथावत्, भारत संचार ननगम लललमटेड (बीएसएनएल) और महानगर टेलीफोन ननगम लललमटेड (एमटीएनएल), के अलावा अधिननयम की पहली अनुसूची की ककसी भी प्रववक्ष्ट के संबंि में स्पेतरम समनुिेशन िारण करने वाला एक समनुिेलशती, स्पेतरम समनुिेशन के नवीनीकरण के ललए आवेिन प्रस्तुत कर सकता है, इसकी समाक्तत की तारीि से कम से कम एक महीने पहले, इस तरह के प्रपत्र और तरीके से और ऐसे स्पेतरम प्रभारों के साथ जैसा कक केंद्रीय सरकार पोटवल पर ननदिवष्ट कर सकती है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (2) ककसी समनुिेलशती से ललखित अनुरोि प्रातत होने पर, केंद्रीय सरकार उपननयम (1) में ववननदिवष्ट अवधि के पश्चात् आवेिन की अनुमनत िे सकती है, यदि वह संतुष्ट हो जाती है कक ऐसी अवधि के भीतर ऐसा आवेिन न करने का पयावतत कारण था, बशते कक ऐसे ववलंब शुल्क का भुगतान ककया जाता है जैसा कक केंद्रीय सरकार ऐसे अनुरोि के उत्तर में ववननदिवष्ट कर सकती है। (3) अधिननयम की प्रथम अनुसूची की प्रववक्ष्ट 19 के अिीन परीक्षण अथवा प्रायोधगक के संबंि में जारी ककए गए स्पेतरम समनुिेशन के नवीनीकरण के ललए उप-ननयम (1) के अिीन कोई भी आवेिन, ऐसे परीक्षण या प्रयोग के पररणाम और ऐसे नवीनीकरण की मांग करने के कारणों को प्रमाखणत करने वाले सहायक िस्तावेजों के साथ संलग्न ककया जाएगा। (4) केंद्रीय सरकार, अपने वववेक से, उप-ननयम (1) या (2) के अिीन आवेिन प्रातत होने पर, इन ननयमों और ऐसे नवीनीकरण के समय लागू कानून और नीनत के अनुपालन के अिीन रहते हुए, केंद्रीय सरकार द्वारा ननणीत की जाने वाली अवधि के ललए स्पेतरम समनुिेशन का नवीनीकरण कर सकती है। (5) अधिननयम की प्रथम अनुसूची की प्रववक्ष्ट 18 अथावत्, भारत संचार ननगम लललमटेड (बीएसएनएल) और महानगर टेलीफोन ननगम लललमटेड (एमटीएनएल), के संबंि में स्पेतरम समनुिेशन नवीनीकरण के ललए पात्र नहीं होगा और संबंधित समनुिेलशती स्पेतरम समनुिेशन प्रातत करने के ललए ननयम 5 के तहत एक नया आवेिन प्रस्तुत कर सकता है। 10. स्पेक्ट्रम का समपयण—(1) स्पेतरम समपवण करने का इच्छुक कोई समनुिेलशती समपवण की प्रस्ताववत तारीि से कम से कम तीस दिन पहले ऐसे प्रपत्र और रीनत से जैसा कक केंद्रीय सरकार पोटवल पर ववननदिवष्ट करे, , स्पेतरम प्रभारों के भुगतान के प्रमाण या आवेिन की तारीि तक उसके द्वारा संिेय ककसी अन्द्य लागू िेय के प्रमाण और ऐसी अन्द्य जानकारी ऐसे प्रपत्र में जो केंद्रीय सरकार पोटवल पर ननदिवष्ट कर सकती है, के साथ आवेिन प्रस्तुत करेगा । (2) केंद्रीय सरकार उप-ननयम (1) के तहत एक आवेिन को अनुमोदित या अस्वीकार कर सकती है, और यदि अनुमोदित ककया जाता है, तो समपवण की प्रभावी तारीि इस तरह के आवेिन की प्राक्तत की तारीि से इकतीसवें दिन होगी, या समपवण की प्रस्ताववत तारीि, जो भी बाि में हो। (3) स्पेतरम के समपवण के बाि, यदि केंद्रीय सरकार यह ननिावररत करती है कक समनुिेलशती द्वारा िेय सभी िेय रालशयों के ननपटान के बाि कोई शेि रालश है, तो वह या तो समनुिेलशती के अन्द्य सकिय समनुिेशन के ललए लंबबत ऐसी रालशयों को समायोक्जत कर सकती है या समनुिेलशती को ऐसी रालश वापस कर सकती है। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) इस ननयम के तहत अपने स्पेतरम को समपवण करने वाले प्रत्येक समनुिेलशती, केंद्रीय सरकार को िेय सभी रालशयों का भुगतान करेगा क्जसमें उप-ननयम (2) में यथा ननदिवष्ट समपवण की प्रभावी तारीि तक िेय स्पेतरम प्रभार भी शालमल है। (5) अधिननयम की प्रथम अनुसूची की प्रववक्ष्ट 18 के संबंि में स्पेतरम का समपवण िूरसंचार (नीलामी के माध्यम से स्पेतरम समनुिेशन) ननयम, 2026 के अनुसार ककया जाएगा। 11. रेडियो उपकरणों का ननपटान- (1) नीचे िी गई सारणी 1 में ननदिवष्ट ककसी भी घटना के घदटत होने पर, संबंधित समनुिेलशती नीचे सारणी I में ननदिवष्ट अवधि के अनुसार स्पेतरम समनुिेशन में ननदिवष्ट रेडडयो उपकरणों का ननपटान करेगा- सारणी I क्रम संख्या निपटाि से संबंधित घटिा निपटाि के लिए सीमा 1. नवीकरण न होने के कारण स्पेक्ट्रम समनुिेशन की समाप्ति। ऐसी समाप्ति के िीन महीने के भीिर। 2. ननयम 10 के िहि ककए गए समपपण के लिए ककए गए आवेदन को केंद्रीय सरकार द्वारा स्वीकृनि। इस िरह के समपपण की प्रभावी निथि से दो महीने के भीिर। 3. ननयम 7 के िहि केंद्रीय सरकार के एक आदेश के अनुसार समनुिेशन का ननरसन। इस िरह के आदेश की िारीख से दो महीने के भीिर। (2) संबंधित समनुिेलशती उप-ननयम (1) के अिीन ककसी भी ववधि का प्रयोग करते हुए, जैसा कक केंद्रीय सरकार पोटवल पर ववननदिवष्ट करे, का ननपटान करेगा और ऐसे ननपटान का प्रमाण िेने वाला िस्तावेज ऐसे प्रपत्र और रीनत से प्रस्तुत करेगा, जैसा कक केंद्रीय सरकार उस पर ववननदिवष्ट करे। अध्याय IV विविि 12. केन्रीय सरकार की शक्क्ट्तयाँ—(1) केंद्रीय सरकार पोटवल पर भारत के राज्यक्षेत्र की अंतरावष्रीय सीमाओं, ननयंत्रण रेिा, भारत की वास्तववक ननयंत्रण रेिा या ककसी अन्द्य क्षेत्र के ननकट आने वाले प्रनतबंधित क्षेत्रों में समनुिेलशती द्वारा स्पेतरम के उपयोग पर प्रनतबंि ववननदिवष्ट कर सकती है, जैसा कक केंद्रीय सरकार पोटवल पर ववननदिवष्ट कर सकती है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (2) केंद्रीय सरकार, इन ननयमों को प्रभावी करने के प्रयोजन के ललए, ऐसे आिेश, ननिेश या दिशाननिेश जारी कर सकती है जो अधिननयम या इन ननयमों से असंगत न हों, जो प्रत्येक समनुिेलशती पर लागू ननबंिन और शतों का गिन करेंगे। (3) केंद्रीय सरकार, राजपत्र में अधिसूचना द्वारा, इन ननयमों की अनुसूधचयों में संशोिन कर सकती है। 13. उल्लंघन- (1) एक समनुिेलशती द्वारा इन ननयमों के तहत ननयमों और शतों का उल्लंघन अधिननयम की िारा 32 में ननदिवष्ट उल्लंघन माना जाएगा। (2) केंद्रीय सरकार, अधिननयम की िारा 32 की उपिारा (1) के िंड (ि) के अिीन प्रातत लसफाररशों पर ववधिवत ववचार करने के पश्चात् और समनुिेलशती को सुनने का अवसर िेने के पश्चात् अधिननयम की िारा 32 की उपिारा (2) के अिीन स्पेतरम समनुिेशन के ननलंबन, ननरसन या कटौती का आिेश जारी कर सकती है। (3) उप-ननयम (2) के तहत प्रत्येक आिेश केंद्रीय सरकार द्वारा पोटवल पर प्रकालशत ककया जाएगा, और ऐसे आिेश के प्रकाशन की तारीि से तुरंत प्रभावी होगा: बशते कक समनुिेशन, प्राधिकार या लाइसेंस का ननलंबन समनुिेशन की अवधि के ववस्तार के ललए एक कारण या आिार नहीं होगा। (4) समनुिेलशती ककसी समनुिेशन के संबंि में भुगतान ककए गए शुल्क या ककसी अन्द्य शुल्क की वापसी का हकिार नहीं होगा जो ननलंबन, ननरसन, कटौती, संशोिन या लभन्द्नता का वविय है। 14. डिक्जटल कायायन्ियन- केंद्रीय सरकार, अधिननयम की िारा 53 के अनुसरण में, इन ननयमों के डडक्जटल कायावन्द्वयन, क्जसमें इन ननयमों के तहत ननदिवष्ट ककए जाने वाले ककसी भी प्रपत्र, तरीके, आिेश, ननिेश या दिशाननिेश का प्रकाशन शालमल है, के ललए एक या एक से अधिक पोटवलों को अधिसूधचत कर सकती है, । अनुसूची I (ननयम 3(2) और 4 िेिें) स्पेक्ट्रम समनुदेशन के लिए आवेदि करिे के लिए पात्र व्यक्क्ट्त ववलिष्ट उपयोग स्पेक्ट्रम प्रभारों के नििाारण के लिए कायाप्रणािी सहित ववलिष्ट ननबंिन और ितों पर िागू अिुिग्िक 1. राष्रीय सुरक्षा और रक्षा अथिननयम की पहिी अनुसूची की प्रववप्टि 1 के प्रयोजन के लिए केंद्रीय (क) एिएफ/एमएफ/एचएफ/वीएचएफ/यू एचएफ बैंड में लैंड मोबाइल सेवा, करने के साि-साि स्पेक्ट्रम समनुिेशन प्रदान करने के लिए प्राथिकार रखने वािा कोई भी व्यप्क्ट्ि, इस अनुसूची की प्रववप्टि 4 के पोिपि पर केंद्रीय सरकार द्वारा ननददपटि ककए गए अनुसार उपयोग ककया जाएगा। केंद्रीय सरकार के रूप में संबंथिि प्राधिकार या िाइसेंस रखने वािा कोई भी व्यप्क्ट्ि, जैसा कक पोिपि पर ननददपटि कर सकिा है। सैटेलाइट आिाररि सेवाएं (क) अनुलग्नक-VII: सैटेलाइट आिाररि सेवाएं; ििा (ि) अनुलग्नक-XIII: स्पेक्ट्रम प्रभारों के वविंबबि भुगिान के लिए वविंब शुल्क। 16(ङ). डिक्जटि सैटेिाइट समाचार एकत्रीकरण केंद्रीय सरकार के रूप में संबंथिि प्राधिकार या िाइसेंस रखने वािा कोई भी व्यप्क्ट्ि, स्माल एपचार टलमािि (कैक्टटव) (क) केंद्रीय सरकार, राज्य सरकार या ऐसी सरकार द्वारा नालमि कोई भी एजेंसी वैरी स्माल भू-प्स्िर कक्षा का उपयोग करिे हुए सैटेलाइट आिाररि सेवाएं (क) अनुिग्नक-VII: सैटेलाइट अधिकतम सीमा तक सीलमत ऑपरेशन की आवृवत्त रेंज को ननदिवष्ट करेगा। (ि) एक समनुिेलशती बाि में, अपनी आवश्यकताओं के आिार पर, पोटवल पर ननदिवष्ट फॉमव में एक आवेिन जमा करके, उसी के औधचत्य के साथ, अनतररतत आवृवत्तयों के ललए अनुरोि कर सकता है। (ग) केंद्रीय सरकार द्वारा अनतररतत आवृवत्तयों के ककसी भी अनुिान को स्पेतरम समनुिेशन पत्र के संशोिन के रूप में िजव ककया जाएगा। 4. इस अनुलग्नक के तहत स्पेतरम के आवंटन के संबंि में स्पेतरम शुल्क लगाने के ललए ननम्नललखित शतें लागू होंगी: (क) एलएफ/एमएफ/एचएफ/वीएचएफ बैंड के ललए स्पेतरम शुल्क चैनल बैंडववड्थ के ललए लगाया जाएगा, न कक आतयपाइड (occupied) बैंडववड्थ के ललए। (ि) सारणी ए1 में यथा ननदिवष्ट स्पेतरम शुल्क ननम्नललखित शतों के अिीन होगा: (i) सारणी A1 में ननदिवष्ट शुल्क का आिा दहस्सा 6.25 kHz या उससे कम की बैंडववड्थ के ललए लागू होगा, और 12.5 kHz से अधिक बैंडववड्थ के ललए, स्पेतरम शुल्क 12.5 kHz के गुणकों में ललया जाएगा, और ककसी भी लभन्द्नात्मक बैंडववड्थ को 12.5 kHz के अगले गुणक तक पूणाांककत ककया जाएगा। (ii) िो स्थानों यानी शहरों के ववलभन्द्न वगों में जनसंख्या श्रेखणयों में फैले िूरसंचार नेटवकव के मामले में, उच्च जनसंख्या श्रेणी का शुल्क लागू होगा। (iii) आवृवत्त समनुिेशन के ललए वाविवक स्पेतरम शुल्क जो समुद्र (अपतटीय), उप-सतह उपयोग, जैसे सुरंग-रेडडयो में रेडडयो स्टेशन शुल्क बताया गया है। 3. इस अनुलग्नक के प्रयोजन के ललए, “आईओटी” का अथव इंटरनेट ऑफ धथंग्स है, क्जसमें इंटरनेट पर एम2एम संचार शालमल है। भाग I: स्पेक्ट्रम शुल्क पर लागू शतें 1. स्पेतरम शुल्क, असाइन ककए गए कुल बैंडववड्थ पर िेनी होगी, क्जसमें कोई भी गाडव बैंड शालमल है, और भारत से या भारत के क्षेत्र में रांसलमट की गई आवृवत्त के संबंि में भी िेनी होगी। 2. अथव एतसतलोरेशन सैटेलाइट सवववस / मौसम सैटेलाइट सवववस के ललए स्पेतरम शुल्क गणना करने के ललए, िूरसंचार नेटवकव में ररमोट यूिसव या कनेतशन की संख्या चाहे जो भी हो, लसफव एक ररमोट टलमवनल को ध्यान में रिा जाएगा। 3. डडक्जटल सैटेलाइट न्द्यूि गैिररंग (डीएसएनजी) / सैटेलाइट न्द्यूि गैिररंग (एसएनजी) के संबंि में स्पेतरम शुल्क, अपललंक और डाउनललंक िोनों पर इस्तेमाल होने वाली आवृवत्त के ललए िेनी होगी। 4. अगर असाइनी के एक से ज़्यािा डीएसएनजी वैन से एक ही आवृवत्त कैररयर का प्रयोग ककया जाता है, तो ये लागू होगा: (क) पहली डीएसएनजीवैन के ललए, इस अनुलग्नक में बताई गई वाविवक स्पेतरम शुल्क ली जाएगी; और 52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ि) प्रत्येक अनतररतत डीएसएनजी वैन के ललए, इस अनुलग्नक में ननदिवष्ट वाविवक स्पेतरम शुल्क के 25% की िर से स्पेतरम शुल्क ललया जाएगा। बशते कक उसी जगह पर तैनात ऐसे अनतररतत डीएसएनजी वैन के ललए कोई स्पेतरम शुल्क नहीं ली जाएगी। 5. सवववसेि के ललए वाविवक स्पेतरम शुल्क ) टीटीसी ऑपरेशन) का शुल्क 1,50,000/- रुपये प्रनत अथव स्टेशन की िर से िेय होगा । 6. स्पेतरम शुल्क डेटा कलेतशन तलेटफॉमव के ररमोट टलमवनलों और एमएसएस में लोकेशन और अन्द्य डेटा िेने के ललए इस्तेमाल होने वाले आईओटी टलमवनलों पर लागू नहीं होगी। 7. ऊपर दिए गए पॉइंट 1 से 5 में शालमल नहीं ककए गए बाकी सभी मामलों में, स्पेतरम शुल्क हर साल िेनी होगी, क्जसकी कैलकुलेशन इस फॉमूवले के दहसाब से की जाएगी: वाविवक स्पेतरम शुल्क (आर) = Rs . 35000xBs, जहााँ Bs का अलभप्राय है बैंडववड्थ फैतटर, क्जसे सारणी 1 में दिए गए तरीके से कैलकुलेट ककया गया है। स्टेशन शुल्क सारणी 2 में दिए गए शुल्क के अनुसार होगा। 2. आईओटी और एग्रीगेटर या डायरेतट-टू-सैटेलाइट मोड में आईओटी डडवाइस के ललए रेडडयो स्टेशन शुल्क नहीं िेना होगा। सारणी 2: िावषयक रेडियो स्टेशन शुल्क THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अनुलग्नक -VIII: पीएमआरटी सेिा 1. यह अनुलग्नक, अनुसूची I की प्रववक्ष्ट 11 के तहत पक्ब्लक मोबाइल रेडडयो रंककंग सेवाओं के ललए स्पेतरम के आवंटन पर लागू होगा। 2. इस अनुलग्नक में शालमल हैं : (क) भाग क, क्जसमें सालाना स्पेतरम शुल्क बताया गया है; और (ि) भाग ि, क्जसमें रेडडयो स्टेशन शुल्क बताया गया है। भाग क: िावषयक स्पेक्ट्रम शुल्क समनुिेलशती ननम्नललखित ववकल्पों में से ककसी एक का उपयोग करके सालाना स्पेतरम शुल्क का भुगतान करेगा: विकल्प 1: स्पेक्ट्रम शुल्क का िावषयक भुगतान 1. उसी सवववस एररया के अंिर शहर में 30 ककंमी तक की ललंक िूरी के ललए, प्रनत 6.25 kHz चैनल के ललए 1,200 रुपये (केवल एक हिार िो सौ रुपये) सालाना। 2. उसी सवववस एररया के अंिर शहर में 60 ककंमी तक की ललंक िूरी के ललए, प्रनत 6.25 kHz चैनल के ललए ₹2400 रुपये (केवल िो हिार चार सौ रुपये) सालाना। विकल्प 2: स्पेक्ट्रम शुल्क का एक बार में अधिम भुगतान पांच साल की अवधि के ललए स्पेतरम शुल्क का एकमुश्त अधग्रम भुगतान इस प्रकार है: 1. उसी सवववस एररया के अंिर शहर में 30 ककंमी तक की ललंक िूरी के ललए, प्रनत 6.25 kHz चैनल के ललए 5,000 रुपये (केवल पााँच हिार रुपये)। 2. उसी सवववस एररया में 60 ककंमी तक की ललंक िूरी के ललए हर 6.25 kHz चैनल के ललए 10,000 रुपये (लसफव िस हिार रुपये)। भाग ख: रेडियो स्टेशन शुल्क रेडडयो स्टेशन शुल्क एजीआर का एक प्रनतशत होगी और इसका भुगतान िूरसंचार (ववववि िूरसंचार सेवाएं प्रिान करने के ललए प्राधिकार) ननयम, 2026 के अनुसार ककया जाएगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 55 अनुलग्नक IX: सैटेलाइट- आिाररत िाणणक्ज्यक संचार सेिाएँ 1. यह अनुलग्नक अनुसूची I की प्रववक्ष्टयों 16(च)(2) (वीसैट वाखणक्ज्यक तक सीलमत) और 16(झ) के संबंि में सैटेलाइट-आिाररत वाखणक्ज्यक संचार सेवाओं के ललए स्पेतरम के समनुिेशन पर लागू होगा। 2. स्पेतरम प्रभार की गणना समायोक्जत सकल राजस्व के प्रनतशत के रूप में की जाएगी जेसा की नीचे दिया गया है: सैटेलाइट सेिा का प्रकार सालाना 3.5% 512 केबीपीएस से ज़्यादा और 2 एमबीपीएस िक एजीआर का 4.0% भारत संचार ननगम लललमटेड (बीएसएनएि) द्वारा सुई जेनेररस कैिेगरी के िहि ग्िोबि सैिेिाइि फोन सववपस (जीएसपीएस) एजीआर का 1% 56 THE GAZETTE OF लललमटेड (बीएसएनएल) और महानगर टेलीफोन ननगम लललमटेड (एमटीएनएल); (ि) अनुसूची I की प्रववक्ष्ट 4 के संबंि में तीन महीने से अधिक की अवधि नहीं; और (ग) अनुसूची I की प्रववक्ष्ट 6 के तहत मेरो और क्षेत्रीय रेल प्रणाललयों की सुरक्षा और संचालन। 2. जैसा कक राष्रीय आवृवत्त आवंटन योजना में अंतरावष्रीय मोबाइल िूरसंचार के कायावन्द्वयन के ललए धचक्ननत ककया गया है, आवृवत्त बैंड या उसके भागों में जैसा कक केंद्रीय सरकार पोटवल पर ननदिवष्ट कर सकती है, उनमें प्रशासननक प्रकिया के माध्यम से एतसेस स्पेतरम का आवंटन, बािार मूल्य के आिार पर होगा। स्पष्टीकरण - इस अनुलग्नक के प्रयोजनों के ललए, अलभव्यक्तत "बाजार मूल्य" का तात्पयव आरक्षक्षत मूल्य या एतसेस स्पेतरम की कीमत से है, जो स्पेतरम समनुिेशन की प्रभावी नतधथ से पहले प्रकालशत अंनतम एनआईए के अनुसरण में आयोक्जत नीलामी के माध्यम से ननिावररत ककया जाता है, जो भी अधिक हो: बशते कक जहां ऐसी नीलामी स्पेतरम समनुिेशन की प्रभावी तारीि से बारह महीने से अधिक पहले आयोक्जत की गई हो, नीलामी के तहत ननिावररत ऐसा आरक्षक्षत मूल्य या मूल्य, जैसा भी मामला हो, भारतीय स्टेट बैंक की वेबसाइट पर अधिसूधचत भारतीय स्टेट बैंक की ननधियों पर आिाररत उिार िर (एमसीएलआर) की प्रासंधगक सीमांत लागत का उपयोग करके ननकाला जाएगा। 58 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अनुलग्नक-XII: एक या अधिक विननयामक सैंिबॉक्ट्स के सृजन सहहत नई प्रौद्योधगक्रकयों के कायायन्ियन को सिम बनाने के भलए टेक्स्टंग, रायल, प्रयोगात्मक, प्रदशयन उद्देश्य 1. यह अनुलग्नक अनुसूची-I की प्रववक्ष्ट 19 के संबंि में एक या अधिक ववननयामक सैंडबॉतस के सृजन सदहत नई प्रौद्योधगककयों के कायावन्द्वयन को सक्षम बनाने के ललए टेक्स्टंग, रायल, प्रयोगात्मक, प्रिशवन उद्िेश्यों के ललए स्पेतरम के आवंटन पर लागू होगा। 2. समनुिेलशती इस अनुलग्नक के तहत स्पेतरम असाइंगमेंट के संबंि में, - (क) यह सुननक्श्चत करना कक ककसी भी टेक्स्टंग, रायल, प्रयोगात्मक, प्रिशवन से ककसी अन्द्य प्राधिकृत संस्था या समनुिेलशती के ककसी भी िूरसंचार उपकरण, िूरसंचार नेटवकव या िूरसंचार सेवा में हस्तक्षेप नहीं होता है; और (ि) ककसी अन्द्य प्राधिकृत संस्था या समनुिेलशती के ककसी भी िूरसंचार उपकरण, िूरसंचार नेटवकव या िूरसंचार सेवा के कारण होने वाले हस्तक्षेप से सुरक्षा का िावा नहीं करता है। स्पष्टीकरण- इस प्राविान में, "हस्तक्षेप" अलभव्यक्तत का अलभप्राय रेडडयो संचार प्रणाली में प्राक्तत पर एक या एक से अधिक इलमशन रेडडयेशन या इन्द्डतशन के संयोजन के कारण अवांनछत ऊजाव के प्रभाव है जो ऐसी ककसी अवांनछत ऊजाव की गैरमौजूिगी मे ननष्पािन में धगरावट, गलत व्याख्या या सूचना नहीं लमलने के पररणामस्वरूप होता है। 3. इस अनुलग्नक के तहत स्पेतरम का कोई भी आवंटन गैर-हस्तक्षेप और गैर-सुरक्षा के आिार पर ककया जाएगा और इसका उपयोग ननयलमत उपयोग या प्रयोतताओं को िूरसंचार सेवाएं प्रिान करने के ललए नहीं ककया जाएगा। 4. इस अनुलग्नक के तहत स्पेतरम के आवंटन पर लागू शतें इस प्रकार हैं: (क) टेक्स्टंग: (i) टेक्स्टंग से वायरलेस िूरसंचार उपकरण या प्रणाललयों के रेडडयो आवृवत्त टेक्स्टंग का अस्थायी प्रचालन, क्जसमें तकनीकी मूल्यांकन, सत्यापन या प्रमाणन के उद्िेश्य से प्रोडतट टेक्स्टंग, कम्पलायन्द्स टेक्स्टंग, परफॉमेंस टेक्स्टंग, फील्ड टेक्स्टंग, नेटवकव टेक्स्टंग और ववननयामक टेक्स्टंग, वाखणक्ज्यक संचालन या िूरसंचार सेवाओं का ववतरण शालमल हैं लेककन यह यही तक सीलमत नहीं हैं। (ii) टेक्स्टंग के संबंि में स्पेतरम का आवंटन इनडोर और आउटडोर एनवायरनमेंट के ललए रेडडएशन मोड में ककया जाएगा, जहां ईआईआरपी 100 लमलीवाट से अधिक है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 59 (iii) इनडोर और आउटडोर एनवायरनमेंट में, रेडडएशन मोड में, जहां ईआईआरपी 100 लमलीवाट से कम है, को स्पेतरम के समनुिेशन की आवश्यकता से छूट िी गई है। (iv) टेक्स्टंग करने वाला समनुिेलशती यह सुननक्श्चत करेगा कक टेक्स्टंग के िौरान संबंधित प्रौद्योधगककयों, उत्पािों, प्रकियाओं या व्यावसानयक मॉडल को इस तरह के टेक्स्टंग की अवधि के िौरान बाजार में व्यावसानयक रूप से उपलब्ि नहीं कराया जाएगा। (ि) रायल: (i) स्पेतरम का आवंटन प्रौद्योधगकी और क्षमता के प्रिशवन, प्रोडतट स्टैबलाइजेशन, इकोलसस्टम के ववकास और इसी तरह के अन्द्य उद्िेश्यों से िूरसंचार सेवाओं के वाखणक्ज्यक लॉन्द्च से पहले ककए गए रायल के ललए ककया जाएगा। (ii) रायल करने वाला समनुिेलशती यह सुननक्श्चत करेगा कक रायल के िौरान संबंधित प्रौद्योधगककयों, उत्पािों, प्रकियाओं या व्यावसानयक मॉडल को इस तरह के रायल की अवधि के िौरान बाजार में व्यावसानयक रूप से उपलब्ि नहीं कराया जाएगा। (iii) रायल पूरी होने पर, समनुिेलशती केंद्रीय सरकार को एक ररपोटव प्रस्तुत करेगा क्जसमें इस तरह के रायल के पररणामस्वरूप ककसी भी बौद्धिक संपिा अधिकारों के पररणाम और सृजन शालमल होंगे। (ग) प्रायोधगक: (i) प्रायोधगक से ववज्ञान और प्रौद्योधगकी के ववकास के ललए और शैक्षक्षक उद्िेश्यों के ललए प्रयोगों में रेडडयो तरंगों का उपयोग अलभप्रेत है। (ii) प्रयोग के संबंि में स्पेतरम का समनुिेशन इनडोर और आउटडोर एनवायरनमेंट के ललए रेडडएदटंग मोड में ककया जाएगा, जहां ईआईआरपी 100 लमलीवाट से अधिक है। (iii) इनडोर और आउटडोर एनवायरनमेंटमें, ववककरण मोड में, जहां ईआईआरपी 100 लमलीवाट से कम है, को स्पेतरम के समनुिेशन की आवश्यकता से छूट िी गई है। (iv) प्रयोग करने वाला समनुिेलशती यह सुननक्श्चत करेगा कक प्रयोग के िौरान संबंधित प्रौद्योधगककयों, उत्पािों, प्रकियाओं या व्यावसानयक मॉडल को इस तरह के प्रयोग की अवधि के िौरान बाजार में व्यावसानयक रूप से उपलब्ि नहीं कराया जाएगा। (v) प्रयोग करने वाला समनुिेलशती यह सुननक्श्चत करेगा कक इस संबंि में केंद्रीय सरकार की पूवव अनुमनत के बबना, भारत में प्रायोधगक वायरलेस स्टेशन और भारत के बाहर ककसी भी िेश में क्स्थत ऐसे समान स्टेशन के बीच कोई संचार नहीं होगा। 60 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (vi) प्रयोग पूरा होने पर, समनुिेलशती केंद्रीय सरकार को एक ररपोटव प्रस्तुत करेगा क्जसमें इस तरह के प्रयोग के पररणामस्वरूप ककसी भी बौद्धिक संपिा अधिकारों के पररणाम और ननमावण शालमल होंगे। (घ) प्रिशवन: (i) प्रिशवन में तकनीकी डडस्तले, प्रिशवनी, प्रूफ ऑफ कान्द्सेतट, मूल्यांकन और बबिी के ललए प्रिशवन, ववननदिवष्ट स्थानों पर, सीलमत अवधि के ललए, ककसी भी िूरसंचार सेवा के प्राविान के बबना या राजस्व के ककसी भी उत्पािन के बबना शालमल है। (ii) प्रिशवन के संबंि में स्पेतरम का आवंटन आउटडोर एनवायरनमेंट के ललए रेडडएदटंग मोड में ककया जाएगा, जहां ईआईआरपी 100 लमलीवाट से अधिक है। (iii) इनडोर और आउटडोर एनवायरनमेंट में प्रिशवन, ववककरण मोड में, जहां ईआईआरपी 100 लमलीवाट से कम है, को स्पेतरम के समनुिेशन की आवश्यकता से छूट िी गई है। 5. लागू स्पेतरम प्रभार नीचे ववननदिवष्ट ककया गया है: वववरण स्पेक्ट्रम समनुिेशन पत्र की अवधि के लिए रािपत्र : असाधारण 61 अनुलग्नक-XIII: स्पेक्ट्रम प्रभार के भुगतान में देरी के भलए विलंब शुल्क 1. यह अनुलग्नक ववननदिवष्ट अनुसूची II के प्रासंधगक अनुलग्नक के साथ पदित अनुसूची-I की ननम्नललखित प्रववक्ष्टयों के संबंि में स्पेतरम प्रभार के ववलंबबत भुगतान के संबंि में लागू होगा: क्र.सं. अिुसूची I की प्रववक्ष्टयां 1 राटरीय सुरक्षा और रक्षा। 2 ववधि प्रवतवन और अपराि रोकथाम। 3 लोक प्रसारण सेवाएं। 4 आपदा following draft rules, which the Central Government proposes to make in exercise of the powers conferred by sub-section (3) of section 4 and sub-section (2) of section 8 read with sub-section (1) and clauses (g) and (m) to sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), are hereby published for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after expiry of a period of thirty days from the date on which copies of this notification as published in the Official Gazette, are made available to the public: Objections or suggestions, if any, may be addressed to the Joint Secretary (Telecommunications), Department of Telecommunications, Ministry of Communications, Government of India, Sanchar Bhawan, 20, Ashoka Road, New Delhi- 110001: The objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be taken into consideration by the Central Government. CHAPTER I PRELIMINARY 1. Short title and commencement.—(1) These rules may be called the Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026. (2) They shall come into force on such date as the Central Government may specify by notification in the Official Gazette. 2. Definitions.—(1) In these rules, unless the context otherwise requires,— (a) “Act” means the Telecommunications Act, 2023 (44 of 2023); (b) “letter of intent” means the letter issued under sub-rule (1) of rule 6; (c) “portal” means the portal referred to in rule 14; (d) “spectrum assignment” means the permission issued under sub-rule (4) of rule 6, for use of spectrum by a radio station; and (e) “spectrum charge” means the spectrum fees and the fees for the radio station or radio equipment, specified in the relevant annexure to Schedule II. (2) Words and expressions used in these rules and not defined herein but defined in the Act, the rules made thereunder or the National Frequency Allocation Plan published by the Central Government shall have the meanings respectively assigned to them in the Act, the said rules or the said plan. 64 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. Scope and applicability.—(1) These rules prescribe the terms and conditions of spectrum assignment by administrative process, in respect of the entries listed in the First Schedule to the Act. (2) Schedule I to these rules specifies persons who may apply for spectrum assignment by administrative process in respect of entries of the First Schedule to the Act, the specific usages for such entries, along with the annexures of Schedule II applicable to such entries, and Schedule II to these rules and the annexures thereto specify terms and conditions of spectrum assignment that are specific to each annexure, and methodology for determination of spectrum charges. 4. Eligibility Conditions.—(1) Any person applying for spectrum assignment under these rules shall meet the eligibility criteria specified in this rule and in the relevant entry of Schedule I. (2) If the person applying for spectrum assignment is a person other than the Central Government, State Government, agency designated by such government, a statutory body established under law, then it shall satisfy the following eligibility criteria, namely:— (a) If such person is a company, the foreign direct investment, if any, in such company, shall be in conformity with the extant laws and policies of India; and (b) If such person is a company, the key managerial personnel in such company shall fulfil such security related criteria as the Central Government may specify on the portal. Explanation.—For the purposes of these rules, the expression— (a) “licence” means a licence, registration or permission, by whatever name called, granted under the Indian Telegraph Act, 1885 (13 of 1885); and (b) “foreign direct investment” shall have the same meaning as is assigned to it in the rules made in respect of non-debt instruments under the Foreign Exchange Management Act, 1999 (42 of 1999). (3) The persons specified under sub-rules (1) to (2) shall also comply with any other criteria as may be specified by the Central Government on the portal for the purposes of spectrum assignment under the relevant entry of the First Schedule to the Act. CHAPTER II APPLICATION AND GRANT OF SPECTRUM ASSIGNMENT 5. Application.—(1) Any person intending to obtain spectrum assignment under these rules shall submit an application, in such form and manner and accompanied by payment of non-refundable application fees of one thousand rupees and such information and documents as the Central Government may specify on the portal, including— (a) specified usage of spectrum; (b) type of authorisation or licence held by the applicant, if applicable; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 65 (c) proof of successful demonstration of the lawful interception systems, lawful interception monitoring facilities and any other additional functional requirement that the Central Government may specify, if applicable; (d) the geographical area of operation; (e) estimated type and quantity of radio equipment required, along with technical data sheet of such equipment; (f) frequency range and transmission parameters, including bandwidth, mode, emission designator, transmit power, EIRP levels required for usage of spectrum, and the information of the satellite network used, along with its orbital parameters and radiocommunication service, if applicable; (g) proposed duration for which spectrum assignment is sought; and (h) permissions under applicable law, relevant to the sector for which assignment is sought, if applicable. Provided that where such equipment is equipment that blocks telecommunication, the person seeking assignment in respect of the same shall, along with such application, submit the permission obtained under section 48 of the Act. (2) If the applicant under sub-rule (1) intends to install radio equipment at a fixed site, it shall apply to obtain the applicable clearance, in such form and manner along with applicable fees, as the Central Government may specify on the portal: Provided that if the Central Government rejects the application under this sub-rule, the applicant may apply afresh for such clearance, specifying an alternate site for installation of radio equipment: Provided further that applicants seeking spectrum assignment in respect of the following entries of the First Schedule to the Act may apply for such clearance after the grant of spectrum assignment, namely:— (a) Entry 1: National security and defence; (b) Entry 2: Law enforcement and crime prevention; (c) Entry 11: Public Mobile Radio Trunking Services; (d) Entry 12: Radio backhaul for telecommunication services; and (e) Entry 18: Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL). Explanation.—For removal of doubts, it is clarified that there shall be no installation of radio equipment at a fixed site without obtaining prior applicable clearance under sub-rule (2). 6. Grant of spectrum assignment.—(1) The Central Government shall, after making such inquiry as it deems fit, require the applicant to furnish such information as it may call for and may, subject to obtaining the applicable clearance under sub-rule (3) of rule 5, and subject to the availability of spectrum and relevant security clearances, where applicable, issue a letter of intent: 66 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided that the Central Government may, in public interest, issue a letter of intent prior to obtaining such applicable clearance, in respect of entries of the First Schedule to the Act other than those specified in the second proviso of sub-rule (3) of rule 5. (2) The letter of intent issued under sub-rule (1) shall specify the following, namely:— (a) The relevant entry of First Schedule to the Act and specific usages of spectrum assignment, along with the applicable annexures of Schedule II; (b) Applicable spectrum charges and timelines for payment of such charges; (c) Frequency range and transmission parameters, including bandwidth, mode, emission designator, transmit power, EIRP levels required for usage of spectrum, and the information of the satellite network used, along with its orbital parameters and radiocommunication service, if applicable; (d) Geographical area of operation; (e) Relevant radio stations and location of such stations; and (f) Type and quantity of radio equipment. (3) The recipient of the letter of intent shall, within the timelines as specified in such letter,— (a) make payment of the component of spectrum charges as specified in such letter; and (b) procure the relevant radio equipment. (4) On being satisfied that the requirements specified in the letter of intent are fulfilled by the applicant, the Central Government shall grant spectrum assignment through the portal, specifying, among other things, the following, namely:— (a) details as specified in the letter of intent; and (b) effective date and duration of spectrum assignment. Provided that if the Central Government has issued a letter of intent prior to obtaining the applicable clearance for the installation of radio equipment, the spectrum assignment shall be granted, after such clearance has been obtained. Explanation.— For the removal of doubts, it is clarified that if the duration for which spectrum assignment is granted is less than a period of one calendar month, the spectrum charges for the entire calendar month shall apply. (5) An assignee may possess radio equipment as specified in its spectrum assignment, without requiring a separate authorisation under clause (c) of sub-section (1) of section 3 of the Act. (6) The Central Government may specify on the portal, the maximum duration of spectrum assignment and limits on the number of spectrum assignments that may be granted under these rules in respect of one or more entries of the First Schedule to the Act. General terms and conditions.— An assignee shall adhere to the following terms and conditions, namely:— (a) Maintain an updated inventory of permitted radio equipment and ensure its secure custody and operation only by authorised personnel; (b) Adhere to the eligibility conditions specified in rule 4 throughout the duration of spectrum assignment; (c) Ensure that its radio stations are operated only for the specific usages for which spectrum assignment has been granted; (d) Take all necessary measures to ensure that its telecommunication network shall not cause interference to other permitted telecommunication network; (e) Not connect its telecommunication network with public telecommunication networks including public switched telephone network, public land mobile network, global mobile personal communication by satellite, or internet, unless permitted by Central Government; (f) Ensure that its telecommunication network is in conformity with standards, as applicable, that the Central Government may specify, including those notified under section 19 of the Act; (g) Not assign or transfer its spectrum assignment without the prior written approval of the Central Government; (h) Comply with any security-related directions issued by the Central Government in the interest of national security, public safety, sovereignty and integrity of India; (i) Forthwith report any instance of unauthorised access, interception, spoofing, cloning, jamming or other security incident affecting its telecommunication network, on the portal, in such form and manner as may be specified thereon in this behalf; (j) Extend all necessary assistance and cooperation to the Central Government and any agency authorised by it, for— (i) matters relating to misuse, compromise or unlawful operation of its radio equipment; and (ii) monitoring and enforcement, to ensure adherence to terms and conditions of spectrum utilisation and enable interference-free use of the assigned spectrum; and (k) Forthwith report any instance of loss, theft, loss of possession or suspected misuse of its radio equipment, on the portal, in such form and manner as may be specified thereon in this behalf. 8. Modification or variation of terms and conditions of spectrum assignment.—(1) An assignee seeking any change in the particulars of the radio stations, the frequency or any other technical parameters, from those specified in the spectrum assignment, shall submit an application on the portal, along with non-refundable fees of one thousand rupees, in such form as the Central Government may specify on the portal. (2) The Central Government may, upon examination of an application under sub-rule (1) and subject to the availability of spectrum, relevant security clearances where applicable, and payment 68 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] of applicable spectrum charges, approve such application and grant an updated spectrum assignment. (3) The Central Government may also, suo motu, modify, vary or make technical adjustments to the terms and conditions of assignment, including by making changes to the usage of frequency bands, power or types of emission, if it is satisfied that it is expedient to do so, having regard to— (a) the provisions of the National Frequency Allocation Plan; (b) the need for enforcement of better technical standards to promote efficient spectrum utilisation in respect of equipment; (c) the national and international radio interference mitigation requirements; and (d) any rules in respect of re-farming, harmonisation or optimal utilisation of spectrum, that the Central Government may prescribe. (4) The Central Government shall, pursuant to any modification or variation under sub-rule (3), grant an updated spectrum assignment to the relevant assignee. (5) The assignee shall implement any modification or variation under this rule within the timelines as specified by the Central Government on the portal. (6) Any modification or variation of the spectrum assignment under this rule shall not affect the duration specified in the spectrum assignment originally issued to the assignee. CHAPTER III RENEWAL AND SURRENDER 9. Renewal—(1) An assignee holding spectrum assignment in respect of any entry of the First Schedule to the Act other than entry 18, namely, Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL), may submit an application for renewal of spectrum assignment, at least one month prior to the date of its expiry, in such form and manner and along with such spectrum charges as the Central Government may specify on the portal. (2) On receipt of a written request from an assignee, the Central Government may permit an application after the period specified in sub-rule (1), if it is satisfied that there was sufficient cause for not making such application within such period, subject to payment of such late fees as the Central Government may specify in response to such request. (3) Any application under sub-rule (1) for renewal of spectrum assignment, issued in respect of trial or experimental under entry 19 of the First Schedule to the Act, shall be accompanied by supporting documents evidencing the outcome of such trial or experiment, and the reasons for seeking such renewal. (4) The Central Government may, in its discretion, on receipt of an application under sub-rules (1) or (2), renew the spectrum assignment for such period as may be decided by the Central Government, subject to these rules and adherence to law and policy applicable at the time of such renewal. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 69 (5) Spectrum assignment in respect of entry 18 of the First Schedule to the Act, namely, Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL), shall not be eligible for renewal and the relevant assignee may submit a fresh application under rule 5 to obtain spectrum assignment. 10. Surrender of spectrum.—(1) An assignee seeking to surrender spectrum shall submit an application, in such form and manner as the Central Government may specify on the portal, at least thirty days prior to the proposed date of surrender, accompanied by proof of payment of spectrum charges or any other applicable dues payable by it till the date of the application, and such other information in such form as the Central Government may specify on the portal. (2) The Central Government may approve or reject an application under sub-rule (1), and if approved, the effective date of surrender shall be the thirty-first day from the date of receipt of such application, or the proposed date of surrender, whichever is later. (3) After the surrender of spectrum, if the Central Government determines that there are any balance amounts after settlement of all dues payable by the assignee, it may either adjust such amounts pending against other active assignments of the assignee or refund such amount to the assignee. (4) Every assignee surrendering its spectrum under this rule shall pay all amounts due and payable to the Central Government including spectrum charges, payable till the effective date of surrender as referred to in sub-rule (2). (5) Surrender of spectrum in respect of entry 18 of the First Schedule to the Act shall be done in accordance with the Telecommunications (Spectrum Assignment through Auction) Rules, 2026. 11. Disposal of radio equipment.—(1) On occurrence of any event as specified in Table 1 below, the relevant assignee shall dispose of the radio equipment specified in the spectrum assignment in accordance with the period specified in Table I below— TABLE I Sl. (2) The relevant assignee shall dispose of the radio equipment under sub-rule (1), using any method as the Central Government may specify on the portal and shall submit the document evidencing such disposal, in such form and manner, as the Central Government may specify thereon. 70 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] CHAPTER IV MISCELLANEOUS 12. Powers of Central Government.—(1) The Central Government may specify on the portal the restrictions on use of spectrum by the assignee in restricted areas falling near the international borders of the territory of India, the Line of Control, the Line of Actual Control of India, or any other area as the Central Government may specify on the portal. (2) The Central Government may, for the purpose of giving effect to these rules, issue orders, directions or guidelines not inconsistent with the Act or these rules, which shall constitute the terms and conditions applicable to every assignee. (3) The Central Government may, by notification in the Official Gazette, amend the Schedules to these rules. 13. Breach.—(1) A breach of terms and conditions under these rules by an assignee shall constitute a breach as referred to in section 32 of the Act. (2) The Central Government may, after due consideration of the recommendations received under clause (b) of sub-section (1) of section 32 of the Act and giving an opportunity of being heard to the assignee, issue an order of suspension, revocation or curtailment of spectrum assignment under sub-section (2) of section 32 of the Act. (3) Every order under sub-rule (2) shall be published by the Central Government on the portal, and be effective immediately from the date of publishing of such order: Provided that the suspension of assignment, authorisation or licence shall not be a cause or ground for extension of the duration of the assignment. (4) The assignee shall not be entitled to refund of fees or any other charges paid in respect of an assignment which is the subject matter of suspension, revocation, curtailment, modification or variation. 14. Digital implementation.—The Central Government may, in furtherance of section 53 of the Act, notify one or more portals for the digital implementation of these rules, including publication of any form, manner, order, direction or guideline to be specified under these rules. Law Enforcement and crime prevention (a) Central Government, State Government or any agency designated by such government for the purpose of entry 2 of the First Schedule to the Act; and (b) If the person specified in clause (a) seeks spectrum assignment for captive mobile radio trunking network, such person shall also hold a captive mobile radio trunking service authorisation under the Telecommunications (Authorisation for Captive Telecommunication Services) Rules, 2026. (a) Land Mobile Service in LF/MF/HF/VHF/UHF bands, having bandwidth up to 375 kHz; (b) Maritime Mobile Service in LF/MF/HF/VHF/UHF bands; (c) Aeronautical Service in LF/MF/HF/VHF/UHF bands; (d) Radars for Radionavigation and Radiolocation Services; (e) Fixed and Mobile Services having Multiplexed Multi- channels; and (f) Satellite based Services. Disaster Management, safeguarding life and property (a) Central Government, State Government or any agency designated by such government for the purpose of entry 4 of the First Schedule to the Act; (b) A statutory body established under a law made by Parliament or by the Legislature of a State, having powers to undertake activities for the purpose of entry 4 of the First Schedule to the Act; (c) Any person, other than as specified under clauses (a) and (b), who satisfies the criteria specified under sub-rule (2) of rule 4; and (d) If the person specified in clauses (a) to (c) seeks spectrum assignment for captive mobile radio trunking network, such person shall also hold a captive mobile radio trunking service authorisation under the Telecommunications (Authorisation for Captive Telecommunication Services) Rules, 2026. (a) Land Mobile Service in LF/MF/HF/VHF/UHF bands, having bandwidth up to 375 kHz; (b) Maritime Mobile Service in LF/MF/HF/VHF/UHF bands; (c) Aeronautical Service in LF/MF/HF/VHF/UHF bands; (d) Radars for Radionavigation and Radiolocation Services; (e) Fixed and Mobile Services having Multiplexed Multi- channels; and (f) Satellite based Services. (f) Table F specifying the radio equipment fees applicable to equipment that blocks telecommunication. 3. In order to promote efficient use of radio frequencies in respect of assignment of spectrum under this annexure, the following provisions shall apply: (a) The letter of intent issued under rule 5 and spectrum assignment letter issued under rule sub-rule (3) of rule 5, shall specify the frequency range of operation limited to a maximum extent of 10 simplex frequencies or 2 duplex frequencies. (b) An assignee may subsequently, based on its requirements, request for additional frequencies, by submitting an application in the form as specified on the portal, along with justification for the same. (c) Any grant of additional frequencies by the Central Government shall be recorded as a modification of the spectrum assignment letter. 4. The following conditions shall apply for levy of spectrum fees in respect of assignment of spectrum under this annexure: (a) The spectrum fees for LF/MF/HF/VHF bands shall be levied for channel bandwidth and not for the occupied bandwidth. (b) The spectrum fees as specified in Table A1 shall be subject to the following conditions: (i) Half of the fees specified in Table A1 shall apply for bandwidths of 6.25 kHz or less, and for bandwidths greater than 12.5 kHz, the spectrum fees shall be charged in multiples of 12.5 kHz, and any fractional bandwidth shall be rounded up to the next multiple of 12.5 kHz. (ii) In case of a telecommunication network spread across population categories across two locations, i.e., different class of cities, the charging of higher population category shall be applicable. 84 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) Annual spectrum fees for frequency assignments that are in the sea (offshore), sub-surface use, such as, tunnel-radio, shall be charged at the minimum charging rate, in the respective band and population category. (iv) If antenna of radio equipment is used indoors or underground or is a down-fire, leaky feeder or radiating cable type, it will fall within Category 1 of the respective band and population category. (v) Annual spectrum fees in Table A1 shall be applicable for the first 10 simplex frequencies or 2 duplex frequencies. (vi) Beyond the quantity of frequencies, an incremental additional charge of 30% higher for the next 5 simplex frequencies or 2 duplex frequencies, and 50% higher charges on number of frequencies exceeding beyond 15 simplex or 4 duplex frequencies shall be applicable. (vii) No spectrum fee shall be applicable for equipment that blocks telecommunication. This annexure shall apply to assignment of spectrum for Satellite based Services (including Fixed Satellite Services (FSS), Broadcasting Satellite Services (BSS), Mobile Satellite Services (MSS) and Earth Exploration Satellite Services (EESS)/ Meteorological Satellite Service) in respect of entries 1, 2, 4, 5, 6, 7, 8, 9, 10, 15, 16(a), 16(b), 16(c), 16(d), 16(e), 16(f)(1) (limited to captive VSAT), 16(g), 16(h) and 17 of Schedule I, and does not apply to Satellite-based Commercial Communication Services. 2. This annexure comprises of: (a) Part I read with Table 1 specifying the spectrum fees; and (b) Part II read with Table 2 specifying the radio station fees for earth stations operating under Satellite Services. 3. For the purpose of this annexure, “IoT” means internet of things, which comprises M2M communication over the internet. Part I: Condition applicable to spectrum fees 1. The spectrum fees shall be payable on the total bandwidth assigned, including any guard bands, and in respect of frequencies transmitted from or into the territory of India. 2. For the purpose of calculation of spectrum fee in respect of Earth Exploration Satellite Service / Meteorological Satellite Service, only one remote terminal shall be taken into account, irrespective of the number of remote users or connections in the telecommunication network. 3. The spectrum fees in respect of Digital Satellite News Gathering (DSNG) /Satellite News Gathering (SNG), shall be payable for the frequencies used on both uplinks and downlinks. 4. In case the same frequency carrier is used from more than one DSNG van of the assignee, the following shall apply: (a) for the first DSNG van, the annual spectrum fees specified in this annexure shall be charged; and (b) for each additional DSNG van, spectrum fee at the rate of 25% of the annual spectrum fee specified in this annexure, shall be charged. Provided that, no spectrum fees shall be charged for such additional DSNG vans, deployed within the same venue. 5. Annual spectrum fees for Space Operation Services )TTC operation) shall be payable at the rate of Rs 1,50,000/- per earth station. 6. The spectrum fees shall not be applicable on remote terminals of data collection platforms, and IoT terminals used for providing location, and other data in MSS. 7. This annexure comprises of: (a) Part A specifying the annual spectrum fees; and (b) Part B specifying the radio station fees. PART A: Annual spectrum fees The assignee shall pay annual spectrum fees by exercising one of the following options: Option 1: Annual Payment of spectrum fees 1. Rs. 1200/- (Rupees One Thousand Two Hundred Only) per annum per 6.25 kHz channel for link distances up to 30 km in the city within the same service area. 2. Rs. 2400/- (Rupees Two Thousand Four Hundred Only) per annum per 6.25 kHz channel for link distances up to 60 km in the city within the same service area. Option 2: One-Time Upfront Payment of spectrum fees One-time upfront payment of spectrum fees for a period of five as follows: 1. Rs. 5,000 (Rupees Five Thousand Only) per 6.25 kHz channel for link distances up to 30 km in the city within the same service area. 2. Rs. 10,000 (Rupees Ten Thousand Only) per 6.25 kHz channel for link distances up to 60 km in the city within the same service area. This annexure shall apply to spectrum assignment for: (a) Bharat Sanchar Nigam Limited (BSNL) and Mahanagar Telephone Nigam Limited (MTNL) in respect of entry 18 of Schedule I; (b) a duration not exceeding three months in respect of entry 4 of Schedule I; and (c) safety and operations of metro and regional rail systems under entry 6 of Schedule I. 2. Assignment of access spectrum through administrative process, in the frequency bands or parts thereof as the Central Government may specify on the portal, as identified for implementation of International Mobile Telecommunication in the National Frequency Allocation Plan, shall be on the basis of market price. Explanation—For the purposes of this Annexure, the expression “market price” shall mean the reserve price or the price of access spectrum, determined through auction held pursuant to the last NIA published prior to the effective date of spectrum assignment, whichever is higher: Provided that where such auction was held more than twelve months prior to the effective date of spectrum assignment, such reserve price or price determined under the auction, as the case may be, shall be arrived at by using the relevant marginal cost of funds based lending rate (MCLR) of the State Bank of India as notified on the website of State Bank of India. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 99 Annexure-XII: Testing, trial, experimental, demonstration purposes for enabling implementation of new technologies, including for creation of one or more Regulatory Sandboxes 1. This annexure shall apply to assignment of spectrum for testing, trial, experimental, demonstration purposes for enabling implementation of new technologies, including for creation of one or more Regulatory Sandboxes in respect of entry 19 of Schedule I. 2. The assignee shall, in respect of spectrum assignment under this annexure,— (a) ensure that any testing, trial, experimental, demonstration does not cause interference to any telecommunication equipment, telecommunication network or telecommunication service of any other authorised entity or assignee; and (b) not claim protection from interference caused by any telecommunication equipment, telecommunication network or telecommunication service of any other authorised entity or assignee. Explanation.—In this provision, the expression “interference” shall mean the effect of unwanted energy due to one or a combination of emissions, radiations or induction on reception in a radio communication system, manifested by any performance degradation, misinterpretation or loss of information that could have been extracted in the absence of such unwanted energy. 3. Any assignment of spectrum under this annexure shall be made on a non-interference and non- protection basis, and shall not be used for regular use or for providing telecommunication services to users. 4. The conditions as applicable to assignment of spectrum under this annexure are as follows: (a) Testing: (i) Testing means the temporary conduct of radio frequency tests of wireless telecommunication equipment or systems, including but not limited to product testing, compliance testing, performance testing, field testing, network testing, and regulatory testing, for the purpose of technical evaluation, validation, or certification, and not for commercial operation or delivery of telecommunication services. (ii) The assignment of spectrum in respect of testing shall be made for indoor and outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Testing in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. (iv) The assignee undertaking testing shall ensure that the associated technologies, products, processes or business models undergoing testing, shall not be made commercially available in the market during the period of such testing. (b) Trial: (i) The assignment of spectrum shall be made for trials, undertaken prior to the commercial launch of telecommunication services, for the purpose of demonstration of technology and capability, product stabilisation, ecosystem development, and other similar purposes. (ii) The assignee undertaking trial shall ensure that the associated technologies, products, processes or business models undergoing trial, shall not be made commercially available in the market during the period of such trial. (iii) On completion of trial, the assignee shall submit a report to the Central Government containing the outcome and creation of any intellectual property rights as a result of such trial. (c) Experimentation: 100 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) Experimentation means utilisation of radio waves in experiments for the development of science and technology, and for educational purposes. (ii) The assignment of spectrum in respect of experimentation shall be made for indoor and outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Experimentation in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. (iv) An assignee undertaking experimentation shall ensure that the associated technologies, products, processes or business models undergoing experimentation, shall not be made commercially available in the market during the period of such experimentation. (v) An assignee undertaking experimentation shall ensure that there shall be no communication between the experimental wireless station in India and such similar station located in any country outside India, without the prior approval of the Central Government in this regard. (vi) On completion of experimentation, the assignee shall submit a report to the Central Government containing the outcome and creation of any intellectual property rights as a result of such experiment. (d) Demonstration: (i) Demonstration includes the technical display, exhibition, proof of concept, evaluation, and demonstration for sale, at specified locations, for a limited duration, without the provision of any telecommunication service or without any generation of revenue. (ii) The assignment of spectrum in respect of demonstration shall be made for outdoor environment, in radiating mode, where EIRP is more than 100 mW. (iii) Demonstration in indoor and outdoor environment, in radiating mode, where EIRP is less than 100 mW, is exempt from the requirement of assignment of spectrum. 5. This annexure shall apply in respect of delayed payment of spectrum charges in respect of the following entries of Schedule I, read with the relevant annexures of Schedule II as specified therein: S. No. Entries of Schedule I 1 National security and defence. 2 Law Enforcement and crime prevention. 3 Public broadcasting services. 4 Disaster Management, safeguarding life and property. 5 Promoting scientific research, resource development and exploration. 6 Safety and operation of roads, railways, metro, regional rail, inland waterways, airports, ports, pipelines, shipping, and other transport systems. 7 Conservation of natural resources and wildlife. 8 Meteorological department and weather forecasting. 9 Internationally recognised dedicated bands for amateur stations, navigation, telemetry, and other like usages. 10 Use by Central Government, State Government, or their entities or other authorised entities for safety and operations of mines, ports and oil exploration and such other activities where the use of spectrum is primarily for supporting the safety and operations. 11 Public Mobile Radio Trunking Services, limited to the payment of spectrum fees. 13 Community Radio Stations. 15 Space research and application, launch vehicle operations and ground station for satellite control. 16 Certain satellite-based services such as: 16(a) Teleports 16(b) Television channels 16(c) Direct To Home 16(d) Headend In The Sky 16(e) Digital Satellite News Gathering 16(f)(1) Very Small Aperture Terminal (Captive) 16(g) National Long Distance 16(h) International Long Distance 17 Use by Central Government, State Government or their authorised agencies for telecommunication services. 2. Any payment reflected in the account of the Central Government after midnight of the due date for payment, shall be considered as a delay in payment, irrespective of the date on which the payment transaction was initiated by the assignee. 102 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. In the event of any delayed payment as explained under paragraph 2, the applicable late charges for each Financial Year shall be calculated at the rate of Marginal Cost of Lending Rate (MCLR) of State Bank of India, plus two percent, compounded annually: Provided that the minimum late charges applicable shall be rupees two hundred and fifty only: Provided further that a part of the month shall be considered as a full month for the purpose of calculation of late charges.
