सा.का.जन.135(अ). –– औषजध जनयम, 1945 को और संिोधन करने के जलए कजतपय जनयमों का एक प्रारूप,
ओषजध और प्रसाधन सामग्री अजधजनयम, 1940 (1940 का 23) की धारा 12 की उप-धारा (1) और धारा 33 की उप-धारा
(1) के अधीन यथा अपेजित, भारत सरकार के स्ट्वास्ट््य और पररवार कल्याण मंत्रालय (स्ट्वास्ट््य और पररवार कल्याण जवभाग)
की अजधसूचना संख्या सा.का.जन. 345 (अ), दिनांक 28 मई, 2025 द्वारा भारत के रािपत्र, असाधारण, भाग II, खंड 3,
उप-खंड (i) में प्रकाजित दकया गया था, जिसमें इससे प्रभाजवत होने की संभावना वाले व्यजियों से आपजियां और सुझाव
आमंजत्रत दकए गए थे, उस तारीख से तीस दिन की अवजध समाप्त होने से पहले जिस तारीख को उि अजधसूचना वाले रािपत्र
की प्रजतयां िनता के जलए उपलब्ध कराई गई थीं;
और, उि रािपत्र की प्रजतयां 28 मई, 2025 को िनता के जलए उपलब्ध कराई गई थीं;
और, केंद्रीय सरकार उि प्रारूप जनयमों पर िनता से प्राप्त आपजियों और सुझावों पर जवचार दकया गया है;
अतः, अब, केंद्रीय सरकार उि अजधजनयम की धारा 12 और धारा 33 द्वारा प्रिि िजियों का प्रयोग करते हुए,
ओषजध तकनीकी सलाहकार बोडड से परामिड के पश्चात्, औषजध जनयम, 1945 का और संिोधन करने के जलए जनम्नजलजखत
जनयम बनाती है, अथाडत्: —
1. (i) इन जनयमों का संजिप्त नाम औषजध (संिोधन) जनयम, 2026।

(ii) ये जनयम रािपत्र में उनके प्रकािन की तारीख को प्रवृि होंगे।
2. ओषजध जनयम, 1945 (जिसे इसमें उसके पश्चात् उि जनयम कहा गया है) में, ―
(क) जनयम 121क के स्ट्थान पर जनम्नजलजखत जनयम रखा िाएगा, अथाडत्: ―
“121क. बैक्टीररयल एंडोटॉजक्सन-पायरोिन हेतु परीिण ― पैरेंटरल प्रिासन के जलए आिजयत पिाथों का घोल (साथ
ही ऐसे पिाथड के साथ आपूर्तड दकया गया पानी या कोई अन्य िलीय जवलायक) बैक्टीररयल एंडोटॉजक्सन के जलए
परीिण का अनुपालन करेगा या, िहां न्यायोजचत और प्राजधकृत हो, पायरोिन के जलए परीिण का अनुपालन करेगा
और बैक्टीररयल एंडोटॉजक्सन-पायरोिन के जलए परीिण भारतीय भेषि संजहता (आई.पी.) के वतडमान संस्ट्करण के
अनुसार दकया िाएगा।”;
(ख) उि जनयमों में, अनुसूची 'क' में, ―
(i). प्ररूप 20ख में, ―
(अ) पैरा 2 के पश्चात् जनम्नजलजखत पैरा अंतःस्ट्थाजपत दकया िाएगा, अथाडत्: ―
“3. जवक्रय दकसी सिम व्यजि के व्यजिगत अधीिण में होगा। (सिम व्यजि का नाम)
……………………………………….”;
(आ) "लाइसेंस की ितें" उप-िीषडक के अधीन, ितड 2 के पश्चात्, जनम्नजलजखत ितड अंतःस्ट्थाजपत की िाएगी,
अथाडत्: ―
“2क. लाइसेंसधारी ऐसे पररवतडन के एक मास के भीतर सिम व्यजि में दकसी भी पररवतडन की सूचना
लाइसेंससंग प्राजधकारी को िेगा।”;
(ii). प्ररूप 20छ में, ―
(अ) पैरा 3 के पश्चात् जनम्नजलजखत पैरा अंतःस्ट्थाजपत दकया िाएगा, अथाडत्: ―
“3क. जवक्रय दकसी सिम व्यजि के व्यजिगत अधीिण में होगा। (सिम व्यजि का नाम)
…………………………………………”;
(आ) "लाइसेंस की ितें" उप-िीषडक के अधीन, ितड 2 के पश्चात् जनम्नजलजखत ितड अंतःस्ट्थाजपत की िाएगी,
अथाडत्: ―
“2क. लाइसेंसधारी ऐसे पररवतडन के एक मास के भीतर सिम व्यजि में दकसी भी पररवतडन की सूचना
लाइसेंससंग प्राजधकारी को िेगा।”;
(iii). प्ररूप 21ख में, "लाइसेंस की ितें" उप-िीषडक के अधीन, ितड 1 के पश्चात् जनम्नजलजखत ितड अंतःस्ट्थाजपत की
िाएगी, अथाडत्: ―
“1क. लाइसेंसधारी ऐसे पररवतडन के एक मास के भीतर सिम व्यजि में दकसी भी पररवतडन की सूचना
लाइसेंससंग प्राजधकारी को िेगा।”;
(ग) उि जनयम में, अनुसूची 'ि' में, पाि- रटप्पण में, प्रजवजि संख्या 5 के पश्चात् जनम्नजलजखत प्रजवजि
अंतःस्ट्थाजपत की िाएगी, अथाडत्: ―
“6. अनुसूची 'क' की क्रम संख्या 15 पर उजल्लजखत ओषजधयों का वगड इस अनुसूची के अंतगडत नहीं आएगा।”।

Notification
New Delhi, 16 February, 2026.
G.S.R. 135(E).― Whereas a draft of certain rules further to amend the Drugs Rules, 1945 was
published, as required under sub-section (1) of section 12 and sub-section (1) of section 33 of the Drugs and
Cosmetics Act, 1940 (23 of 1940) vide notification of the Government of India in the Ministry of Health
and Family Welfare (Department of Health and Family Welfare) number G.S.R. 345 (E), dated the 28th May
2025, in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and
suggestions from persons likely to be affected thereby, before the expiry of a period of thirty days from the
date on which the copies of the Gazette containing the said notification were made available to the public;
And whereas, copies of the said Gazette were made available to the public on the 28th May 2025;
And whereas, objections and suggestions received from the public on the said draft rules have been
considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 12 and section 33 of the said Act, the
Central Government, after consultation with the Drugs Technical Advisory Board, hereby makes the
following rules further to amend the Drugs Rules, 1945, namely: —
(i) These rules may be called the Drugs (Amendment) Rules, 2026.
(ii) These rules shall come into force on the date of their publication in the Official Gazette.

In the Drugs Rules, 1945 (hereinafter to as the said rules), ―
(a)
for rule 121A, the following rule shall be substituted, namely: ―
“121A. Test for Bacterial endotoxins-Pyrogens. ― Solution of substances intended for parenteral
administration (as well as water or any other aqueous solvent supplied along with such substance) shall
comply with a test for bacterial endotoxins or, where justified and authorised, with the test for pyrogens and
the test for Bacterial endotoxins-Pyrogens shall be carried out as per current edition of Indian Pharmacopeia
(I.P).”;
(b)
in the said rules, in Schedule A, ―
(i).
in Form 20B, ―
(A)
after paragraph 2, the following paragraph shall be inserted, namely: ―
“3. The sale shall be under the personal supervision of a competent person.
(Name of the competent person) ……………………………………….”;
(B)
under the sub-heading “Conditions of License”, after condition 2, the following condition
shall be inserted, namely: ―
“2A. The licensee shall report to the licensing authority any change in competent person within one
month of such change.”;

(ii).
in Form 20G, ―
(A)
after paragraph 3, the following paragraph shall be inserted, namely: ―
“3A. The sale shall be under the personal supervision of a competent person.
(Name of the competent person) …………………………………………”;
(B)
under the sub-heading “Conditions of Licence”, after condition 2, the following condition
shall be inserted, namely: ―
“2A. The licensee shall report to the licensing authority any change in competent person within one
month of such change.”;
(iii).
in Form 21B, under the sub-heading “Conditions of Licence”, after condition 1, the
following condition shall be inserted, namely: ―
“1A. The licensee shall report to the licensing authority any change in competent person within one
month of such change.’’;
(c)
in the said rule, in Schedule H, in the foot note, after entry number 5, the following entry
shall be inserted, namely: ―
“6. Class of drugs mentioned at serial number 15 of Schedule K shall not be covered under this
Schedule.”.
