xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY कृजि और ककसान कल्याण मंत्रालय (कृजि और ककसान कल्याण जिभाग) अजधसूचना नई किल्ली, 17 िून, 2026 सा.का.जन. 493(अ).- कीटनािी जनयम, 1971 का और संिोधन करने के जलए प्रारूप जनयम, कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा यथा अपेजित, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में भारत सरकार के कृजि और ककसान कल्याण मंत्रालय, कृजि और ककसान कल्याण जिभाग की अजधसूचना सं0 सा.का.जन. 674(अ), तारीख 18 जसतंबर, 2025 द्वारा प्रकाजित ककए गए थे, जिसमें उससे प्रभाजित होने की संभािना िाले सभी व्यजियों से, उस तारीख से, जिसको भारत के उस रािपत्र की प्रजतयां, जिसमें उि अजधसूचना प्रकाजित की गई थी, िनता को उपलब्ध करा िी िाती है, तीस किन की अिजध की समाजि से पूिव आिेप और सुझाि मांगे गए थे ; और, उि रािपत्र की प्रजतयां िनता को 18 जसतंबर, 2025 को उपलब्ध करा िी गई थी ; और, उि प्रारूप जनयमों के संबंध में िनता से प्राि आिेपों और सुझािों पर केंद्रीय सरकार ने जिचार कर जलया है; अत:, अब, केंद्रीय सरकार, उि अजधजनयम की धारा 36 द्वारा प्रित्त िजियों का प्रयोग करते हुए, कीटनािी जनयम, 1971 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है,अथावत् :-

1. संजिि नाम और प्रारंभ.- (1) इन जनयमों का नाम कीटनािी (संिोधन) जनयम, 2026 है। (2) ये रािपत्र में इनके प्रकािन की तारीख से नब्बे किन की अिजध के पश्चात् प्रिृत्त होंगे। सं. 442] नई किल्ली, बृहस्ट् पजतिार, िून 18, 2026/ज् येष् ठ 28, 1948

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. कीटनािी जनयम, 1971 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया है) के जनयम 9 में, उपजनयम (1) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथावत् :-- “(1) ककसी कीटनािी के जिजनमावण के जलए अनुज्ञजि मंिूरी करने के जलए आिेिन, अनुज्ञापन अजधकारी को जडजिटल रूप में प्ररूप 2 में ककया िाएगा और उसके साथ प्रत्येक कीटनािी के जलए िो हिार रुपए और उन सभी कीटनाजियों के जलए, जिनके जलए अनुज्ञजि का आिेिन ककया गया है, अजधकतम बीस हिार रुपए की फीस होगी ।”। 3.उि जनयम के जनयम 10 में, उपजनयम (1) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथावत् :- “(1) कीटनाजियों के जिक्रय, जिक्रय के जलए स्ट्टॉक या प्रििवन या जितरण के जलए अनुज्ञजि की मंिूरी के जलए आिेिन, अनुज्ञापन अजधकारी को जडजिटल रूप में प्ररूप 2 में ककया िाएगा और उसके साथ उपजनयम (2) में जिजनर्िवष्ट फीस होगी ।”। 4.उि जनयम के जनयम 15 में,-- (क) उपजनयम (2) में, “कीटनािीिार प्ररूप 3 का पररजिष्ट ख में ककसी रजिस्ट्टर या तो भौजतक प्ररूप या अंकीय प्ररूप में प्रजिष्ट ककया िाना” िब्िों के स्ट्थान पर, “कीटनािीिार प्ररूप 3 के पररजिष्ट ख में अंकीय माध्यम से ककया िाना” िब्ि रखे िाएंगे ; (ख) उपजनयम (3) में, “या तो भौजतक प्ररूप या अंकीय प्ररूप” िब्िों के स्ट्थान पर, “अंकीय माध्यम” िब्ि रखे िाएंगे ; (ग) उपजनयम (4) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथावत् :-- “प्रत्येक जिजनमावणकताव या आयातकताव, तकनीकी श्रेणी के कीटनािी और जिजनर्मवत कीटनािी के ऐसे जिक्रय, जनमावण या आयात को अंकीय प्ररूप में बनाए रखेगा और अनुज्ञापन अजधकारी को माजसक जििरण या जििरणी, क्रमिः प्ररूप 3 के पररजिष्ट घ1 और प्ररूप 3 के पररजिष्ट घ2 में, मास की समाजि से पन्द्द्रह किनों के भीतर प्रस्ट्तुत करेगा।”। 5. उि जनयम के जनयम 24 में,-- (क) उपजनयम (3) में, “तीन प्रजतयों में” िब्िों का लोप ककया िाएगा ; (ख) उपजनयम (3) के पश्चात्, जनम्नजलजखत उपजनयम अंत:स्ट्थाजपत ककया िाएगा, अथावत् :-- “(4) उपजनयम (1) में यथा जिजनर्िवष्ट प्राजि और उपजनयम (3) में यथा जिजनर्िवष्ट आपूर्तव की ररपोटव जडजिटल रूप में बनाई िाएगी ।”। 6. उि जनयम के जनयम 25 में, पहले परंतुक के पश्चात्, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत ककया िाएगा, अथावत् :- “परंतु यह और कक फीस जडजिटल रूप में भी संित्त की िा सकेगी ।”। 7. उि जनयम के जनयम 27 में, खंड (6) के स्ट्थान पर, जनम्नजलजखत खंड रखा िाएगा, अथावत् :- “(6) अपने कतव्य ों का पालन करने में, जिसमें नमूने लेना और स्ट्टाक का अजभग्रहण करना सजममजलत है, उसके द्वारा ककए गए सभी जनरीिणों और की गई कारविाई का जडिीटल अजभलेख बनाए रखना और ऐसे अजभलेखों को अनुज्ञापन अजधकारी को प्रस्ट्तुत करना तथा जनयम 30, जनयम 32 और जनयम 33 के अधीन या अजधजनयम के अधीन या इन जनयमों के अधीन अपने कतव्य ों का पालन करने में, भौजतक प्ररूप का उपयोग करके, उसके द्वारा ककए गए ऐसे सभी जनरीिणों और की गई कारविाई के चौबीस घंटों के भीतर, जडिीटल अजभलेख बनाया िाएगा ।”। 8. उि जनयम के जनयम 30 में, “प्ररूप 5(क) में” िब्ि, अंक, कोष्ठक और अिर के पश्चात्,“, या तो भौजतक या जडजिटल माध्यम से” िब्ि अंत:स्ट्थाजपत ककए िाएंगे । 9. उि जनयम के जनयम 32 में, “प्ररूप 5(ख) में” िब्ि, अंक, कोष्ठक और अिर के पश्चात्,“, या तो भौजतक या जडजिटल माध्यम से” िब्ि अंत:स्ट्थाजपत ककए िाएंगे । 10. उि जनयम के जनयम 33 में, “उस व्यजि की जिससे िह नमूना लेता है ऐसा प्रयोिन” िब्िों के स्ट्थान पर, “उस व्यजि को, जिससे िह नमूना लेता है, ऐसा प्रयोिन, या तो भौजतक या जडजिटल माध्यम से,” िब्ि अंत:स्ट्थाजपत ककए िाएंगे ।

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 11. उि जनयम के जनयम 34 में, उपजनयम (1) के पश्चात्, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत ककया िाएगा, अथावत् :- “परंतु परीिण या जिश्लेिण के जलए सूचना का प्ररूप जडजिटल माध्यम में िारी ककया िाएगा ।”। 12. उि जनयम की प्रथम अनुसूची के प्ररूप 3 में, पररजिष् ट ख, पररजिष्ट ग1, पररजिष्ट ग2, पररजिष्ट घ1 और पररजिष्ट घ2 तथा उनसे संबंजधत प्रजिजष्टयों के स्ट्थान पर, जनम्नजलजखत रखा िाएगा, अथावत् :-

“पररजिष् ट ख कीटनाजियों के जिक्रय/जितरण हेतु रजिस्ट्टर [तकनीकी एिं सूत्रीकरण (जिसमें िाजणजज्यक कीट जनयंत्रण प्रचालनों में प्रयुि कीटनािी सजममजलत हैं)] (अजभलेख कीटनािी-िार रखा िाना है) [जनयम 15 का उपजनयम (2) िेखें] क्रम सं. कीटनाशी की प्राप्ति की िारीख विननमाािा का नाम, प्िससे प्राति हुआ आपूनिाकिाा/ वििरक का नाम, यदि कोई हो, प्िसके माध्यम से प्राति हुआ बैच संख्या विननमााण की िारीख अिसान की िारीख बीिक वििरण, संख्या, िारीख और प्राति आपूनिा की मात्रा (मीदिक टन) प्िसके माध्यम से आपूनिा प्राति हुई

MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 17th June, 2026 G.S.R. 493(E).– Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968), vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 674 (E), dated the 18th September, 2025, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i), inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public; And whereas, copies of the said notification were made available to the public on the 18th day of September, 2025; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:-

1. Short title and Commencement.- (1) These rules may be called the Insecticides (Amendment) Rules, 2026. (2) They shall come into force after a period of ninety days from the date of their publication in the Official Gazette.

2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 9, for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) The application for grant of a licence to manufacture any insecticide shall be made in digital mode in Form II to the licensing officer and shall be accompanied by a fee of rupees two thousand for every insecticide and a maximum of rupees twenty thousand for all insecticides for which the licence is applied.”.

3. In the said rules, in rule 10, for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) The application for grant of a licence to sell, stock or exhibit for sale or distribute insecticides shall be made in digital mode in Form II to the licensing officer and shall be accompanied by the fees specified in sub-rule (2).”

4. In the said rules, in rule 15,- (a) in sub-rule (2), for the words “entered insecticide wise, in a register either in physical form or digital form”, the words “made insecticide wise in digital mode” shall be substituted; (b) in sub-rule (3), for the words “either in physical form or digital form”, the words “in digital mode” shall be substituted; (c) for sub-rule (4), following sub-rule shall be substituted, namely :- “ Every manufacturer or importer shall maintain in digital form of such sale, manufacture or import of technical Grade Insecticide and formulated Insecticide and submit the monthly statement or return to the licensing officer, in Appendix D1 to Form III and Appendix D2 to Form III respectively within fifteen days from the closing of the month.”.

5. In the said rules, in rule 24,- (a) in sub-rule (3), the words “in triplicate” shall be omitted;

(b) after sub-rule (3), the following sub-rule shall be inserted, namely:-

“(4) The receipt as specified in sub-rule (1) and supply of report as specified in sub-rule (3) shall be made in digital form.”.

6. In the said rules, in rule 25, after the first proviso, the following proviso shall be inserted, namely:- “Provided further that the fee may also be paid in the digital mode.”.

7. In the said rules, in rule 27, for clause (6), following clause shall be substituted, namely:- “(6) to maintain a digital record of all inspections made and action taken by him in the performance of his duties including the taking of samples and seizure of stocks and to submit such record to the licensing officer and a digital record shall be maintained within twenty-four hours of all such

8. In the said rules, in rule 30, after the word, letters and brackets “Form V(A)”, the words “,either in physical or digital mode” shall be inserted.

9. In the said rules, in rule 32, after the word, letters and brackets “Form V(B)”, the words “,either in physical or digital mode” shall be inserted.

10. In the said rules, in rule 33, after the words “he takes it”, the words “,either in physical or digital mode” shall be inserted.

11. In the said rules, in rule 34, after sub-rule (1), the following proviso shall be inserted, namely:- “Provided that the form of intimation for test or analysis shall be issued in digital mode.”.

12. In the said rules, in the FIRST SCHEDULE, in FORM III, for APPENDIX B, APPENDIX C1, APPENDIX C2, APPENDIX D1 and APPENDIX D2 and their entries relating thereto, the following shall be substituted, namely:-
