सा.का.जन. 776(अ).—केंद्रीय सरकार, खान और खजनि (जिकास और जिजनयमन) अजधजनयम, 1957
(1957 का 67) की धारा 13 द्वारा प्रित्त िजियों का प्रयोग करते हुए, खजनि (नीलामी) जनयम, 2015 का और संिोधन
करने के जलए, जनम्नजलजखत जनयम बनाती है, अर्ाात्:—
1. संजिप्त नाम और प्रारंभ.— (1) इन जनयमों का संजिप्त नाम खजनि (नीलामी) तीसरा संिोधन जनयम, 2025 है।
(2) ये रािपत्र में इनके प्रकािन की तारीख को प्रिृत्त होंगे।
2. खजनि (नीलामी) जनयम, 2015 (जिसे इसमें इसके पश्चात् 'उि जनयम' कहा िाएगा) के जनयम 6 के उपजनयम (4) के
स्ट्र्ान पर जनज्ललजखत उपजनयम रखा िाएगा, अर्ाात:—
“(4) िहााँ राज्य सरकार ने दकसी खान की नीलामी दकसी जिजिष्ट जिजनर्िाष्ट अंजतम उपयोग के जलए कैजटिि खान के रूप में
की है, िहां ऐसे पट्टे का पट्टाधारक ऐसी खान से उत्पादित खजनि का खान के सार् संयोजित अंजतम उपयोग संयंत्र की
अपेिा को पूरा करने के पश्चात और अजधजनयम की छठी अनुसूची में यर्ा जिजनर्िाष्ट ऐसी अजतररि रकम के संिाय पर,
जिक्रय कर सकेगा।”।
3. उि जनयमों के जनयम 8 के उपजनयम (5) में, "तो सफल बोली लगाने िाले द्वारा उपजनयम (2) के अधीन यर्ा उद्धररत
प्रेजित खजनि मूल्य की प्रजतितता ऐसे प्रत्येक खजनि के संबंध मे राज्य सरकार को संिाय करने के प्रयोिन के जलए लागू
होगी" िब्िों, कोष्ठकों और अंकों के स्ट्र्ान पर "तो ऐसे खजनिों को धारा 15ख के उपबंधों के अनुसार खनन पट्टे में सज्मजलत
दकया िा सकेगा" िब्ि, अंक और अिर रखे िायेंगे।

4. उि जनयमों के जनयम 10 में, —
(i) उपजनयम 7 के परंतुक में, "के जलए" िब्िों के पश्चात्, "धारा 15ख और" िब्ि और अंक अंत:स्ट्र्ाजपत दकए
िाएंगे;
(ii) उपजनयम 8 में, "ऐसे जनयमों" िब्िों के स्ट्र्ान पर "धारा 15ख और जनयमों" िब्ि, अंक और अिर रखे िाएंगे।
5. उि जनयमों के जनयम 16 के उपजनयम (1) में, परंतुक का लोप दकया िाएगा।
6. उि जनयमों के जनयम 18 में,—
(i) उपजनयम 11 के परंतुक में, "के जलए" िब्िों के पश्चात्, "धारा 15ख और" िब्ि और अंक अंत:स्ट्र्ाजपत दकए
िाएंगे;
(ii) उपजनयम 12 में, “ऐसे जनयमों” िब्िों के स्ट्र्ान पर “धारा 15ख और जनयमों” िब्ि, अंक और अिर रखे
िाएंगे।
7. उि जनयमों के जनयम 21 के उपजनयम (1) में, खंड (ख) के स्ट्र्ान पर जनम्नजलजखत खंड रखा िाएगा, अर्ाात्:—
"(ख) पहली अनुसूची के भाग ख में यर्ाजिजनर्िाष्ट दकसी भी परमाणु खजनि को, िहां परमाणु खजनि की श्रेणी
अजधसूजचत अिसीमा मूल्य के समतुल्य है या उससे अजधक है, ऐसे परमाणु खजनिों से जभन्न अलय खजनिों के संबंध
में अनुित्त खनन पट्टे में सज्मजलत नहीं दकया िाएगा;"।

द्वारा अंजतम बार संिोजधत दकए गए र्े।

NOTIFICATION
New Delhi, the 22nd October, 2025.
G.S.R. 776(E).—In exercise of the powers conferred by section 13 of the Mines and Minerals (Development
and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend
the Mineral (Auction) Rules, 2015, namely:—
1. Short title and commencement.— (1) These rules may be called the Mineral (Auction) Third Amendment
Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Mineral (Auction) Rules, 2015 (hereinafter referred to as the said rules), in rule 6, in sub-rule (4), for the
words, brackets and figures “before the commencement of the Mineral (Auction) Second Amendment Rules, 2021, up
to fifty per cent. of total mineral produced in such captive mine in a financial year may be sold in market while
ensuring that not less than fifty per cent. of total mineral produced in such captive mine shall be used during the
financial year for”, the words, “, lease holder of such lease may sell mineral produced from such mine after” shall be
substituted.
3. In the said rules, in rule 8, in sub-rule (5), for the words, brackets and figure “, the percentage of value of mineral
despatched as quoted by the successful bidder under sub-rule (3) shall be applicable for the purpose of payment to the
State Government in respect of each such mineral”, the words, figures and letter “then such minerals may be included
in the mining lease in accordance with the provisions of section 15B” shall be substituted.
4. In the said rules, in rule 10,—
(i) in sub-rule (7), in the proviso, after the words “provisions of”, the words, figure and letter “section 15B and”
shall be inserted;
(ii) in sub-rule (8), for the words “such rules”, the words, figure and letter “section 15B and the rules” shall be
substituted.

5. In the said rules, in rule 16, in sub-rule (1), the proviso shall be omitted.
6. In the said rules, in rule 18,—
(i) in sub-rule (11), in the proviso, after the words “provisions of”, the words, figure and letter “section 15B
and” shall be inserted;
(ii) in sub-rule (12), for the words “such rules”, the words, figure and letter “section 15B and the rules” shall be
substituted.
7. In the said rules, in rule 21, in sub-rule (1), for clause (b), the following clause shall be substituted, namely:—
“(b) no atomic mineral as specified in Part B of the First Schedule where the grade of atomic mineral is equal
to or above the notified threshold value shall be included in the mining lease granted in respect of minerals
other than such atomic minerals;”.
