सा.का.जन. 889(अ).—केन्द्रीय सरकार, स्वापक ओषजध और मन:प्रभावी पदार्थ अधिधनयम, 1985
(1985 का 61) की िारा 4 और िारा 76 के सार् पठित िारा 9 द्वारा प्रदत्त शधियों का प्रयोग करते हुए, स्वापक
ओषजध और मन:प्रभावी पदार्थ धनयम, 1985 को और संशोधित करने के धिए धनम्नधिधित धनयम बनाती है,
अर्ाथत:-
(1) इन धनयमों का संजिप्त नाम स्ट्िापक ओषजध और मन:प्रभावी पदार्थ (संशोिन) धनयम, 2025 है ।
(2)
ये राजपत्र में प्रकाशन की तारीख को प्रिृत्त होंगे।

स्वापक ओषजध और मन:प्रभावी पदार्थ धनयम, 1985 के अधीन आयात प्रमाणपत्र िारी करने के जलए सिक्त करते
हुए...........(जनगगमन प्राजधकारी) स्ट्िापक ओषजधयों के जनम्नजलजखत आधानों के भारत में आयात को अनुमोदित करते है :

आयात प्रमाणपत्र की ितें
(i)
ओषजधयों से युक्त आधान को ………………. से पहले ………………. तक (तारीख/ दिन/महीना/िषग
के रूप जिधान में) (आयात प्रमाणपत्र िारी करने की तारीख से 180 दिन के रूप में गणना की िाएगी) भारत में
(जिमान पत्तन/समुर पत्तन) पर आयात दकया िाएगा ।
(ii)
यदि आयात जनयागत हेतु जिजनर्मगजत के जिजनमागण के जलए है, तो जिजनमागता,-
(क)
यह सुजनजित करेगा दक इस प्रमाणपत्र के अधीन आयाजतत ओषजध का कोई भी भाग घरेलू जिक्रय
के जलए जिजनर्मगजत के जिजनमागण के जलए जिक्रीत या प्रयुक्त नहीं दकया िाएगा ;
(ख) यह सुजनजित करेगा दक इस प्रमाणपत्र के अधीन आयाजतत ओषजध से जिजनर्मगत जिजनर्मगजत को
घरेलू जिक्रय के जलए नहीं भेिा िाएगा ;

(ग)
जनयागत पूरा होने पर िस्ट्तािेिी साक्ष्य िैसे पोत पठरिहन जबल, जबल ऑफ लैडडंग और बीिक के
साथ ओषजधयों के जनयागत का ब्यौरा स्ट्िापक आयुक्त तथा भारत के ओषजध महाजनयंत्रक को प्रस्ट्तुत
करेेगा;
(घ)
अपने राज्य उत्पाि िुल्क प्राजधकरण या राज्य खाद्य एिं ओषजध प्रिासन से पठरिहन अनुज्ञा प्राप्त
करेगा, जिसमें प्रिेि पत्तन से कारखाना पठरसर तक उनके आधान के पठरिहन की अनुज्ञा हो ;
(ङ)
आयाजतत स्ट्िापक ओषजध की िास्ट्तजिक मात्रा, उत्पादित जिजनर्मगजत, भेिे गए आधान तथा
अजतिेष मात्रा का पृथक-पृथक लेखा रखेगा ;
(च)
स्ट्िापक ओषजध की प्राजप्त या आयात, उपभोग और जनयागत की माजसक जििरणी स्ट्िापक आयुक्त को
प्रस्ट्तुत करेगा;
(छ) इस प्रमाणपत्र के अधीन आयाजतत ओषजधयों से जिजनर्मगत जिजनर्मगजत की सुरिा व्यिस्ट्था, लेखाओं
के रखरखाि और जििरणी िमा करने, कब्िे, जिक्रय और संजितरण के जलए जनयम 42, जनयम 45,
जनयम 46 और जनयम 47 में जिजहत प्रदक्रयाओं का अनुपालन करेगा ;
(ि)
जनयम 54 के अन्द्तगगत समय-समय पर िारी अजधसूचना में जिजनर्िगष्ट अन्द्य ितों का अनुपालन
करना ।
(iii)
यदि आयात जिश्लेषणात्मक उद्देश्यों के जलए है, तो आयातक, -
(क) यह सुजनजित करेगा दक इस प्रमाणपत्र के अधीन आयाजतत ओषजध का कोई भी भाग जिश्लेषणात्मक
उद्देश्य से जभन्न दकसी अन्द्य उद्देश्य के जलए उपयोग नहीं दकया िाएगा ;
(ख) आयात की गई स्ट्िापक ओषजध के पूणग उपभोग के बारे में स्ट्िापक आयुक्त को िानकारी िेना ; और
(ग) जनयम 42, जनयम 45, जनयम 46 तथा जनयम 47 में जिजनर्िगष्ट प्रदक्रयाओं का अनुसरण करेंगे ।
(3) जनयागत के जलए मॉरफीन, कोडीन, थेबाइन और उनके लिणों या तैयार जिजनर्मगजत की कोई भी मात्रा, िो उपयोग में
नहीं आई है, उसे सरकारी अफीम और अल्कलॉइड कारखाने को सौंप दिया िाएगा और इस प्रयोिन का लेखा-िोखा इस
प्रमाणपत्र के अधीन आयात और बाि में फॉमूगलेिन और एल्कलॉइड का जनयागत के जलए अनुज्ञजप्तधारी को उपलब्ध कराई गई
अिजध के अंत में स्ट्िापक आयुक्त को प्रस्ट्तुत दकया िाएगा।
(4)
यह िस्ट्तािेज़ ................. के जलए है (जिस प्राजधकारी को और जिस उद्देश्य के जलए इसे भेिा िा रहा है, उसे
उपिर्िगत दकया िाए)
(5)
प्रमाणपत्र तब तक मान्द्य नहीं होगा िब तक दक उसके ऊपरी िाजहने कोने पर जनगगमन प्राजधकारी की िासकीय मुरा
न लगी हो। "

NOTIFICATION
New Delhi, the 10th December, 2025
G.S.R. 889(E).— In exercise of the powers conferred by section 9, read with sections 4 and 76 of the Narcotic
Drugs and Psychotropic Substances Act, 1985 (61 of 1985), the Central Government hereby makes the following rules
further to amend the Narcotic Drugs and Psychotropic Substances Rules, 1985, namely:-
(1)
These rules may be called the Narcotic Drugs and Psychotropic Substances (Amendment) Rules, 2025.
(2)
They shall come into force on the date of their publication in the Official Gazette.
2.
In the Narcotic Drugs and Psychotropic Substances Rules, 1985,
(a)
for Form No. 4A of the said rules, the following form shall be substituted namely:-

CERTIFICATE OF OFFICIAL APPROVAL OF IMPORT UNDER THE PROVISO TO RULE 54 of the Narcotic
Drugs and Psychotropic Substances Rules,1985
……………………………………………………, (The Issuing Authority) being empowered to issue Import
Certificate under the Narcotic Drugs and Psychotropic Substances Rules 1985, hereby, approves the importation into
India of the following consignments of narcotic drugs:

Conditions of import certificate
(i)
The consignment containing the drugs shall be imported before……. by…………………………
(date in format dd/mm/yyyy) (to be calculated as 180 days from the date of issue of import certificate)
to (airport/seaport) in India.

(ii)
If the import is for manufacture of formulations for export, the manufacturer shall,-
(a)
ensure that no part of the drug imported under this certificate shall be sold or used to
manufacture formulations for domestic sale;
(b)
ensure that the formulations manufactured out of the drug imported against this certificate shall
not be diverted for domestic sale;
(c)
furnish to the Narcotics Commissioner and the Drugs Controller General of India details of
export of drugs on completion of export along with documentary evidence such as shipping
bills, bills of lading and invoices;
(d)
obtain transport permit from their State Excise authority or State Food and Drugs
Administration permitting transport of their consignment from port of entry to the factory
premises;
(e)
maintain separate accounts of actual quantity of narcotic drug imported, formulations produced,
consignments dispatched and the quantity lying in balance;
(f)
submit a monthly return of receipt or import, consumption and export of the narcotic drug to
the Narcotics Commissioner;
(g)
follow the procedures prescribed in Rules 42, 45, 46 and 47 for security arrangements,
maintenance of accounts and submission of returns, possession, sale and distribution of
formulations manufactured from the drugs imported under this certificate;
(h)
comply with such other conditions as may be specified in the notification issued from time to
time under rule 54.
(iii)
If the import is for analytical purposes, the importer shall, -
(a)
ensure that no part of the drug imported under this certificate shall be used for any purpose other
than for analytical purpose;
(b)
inform the Narcotics Commissioner about the complete utilisation of the Narcotic Drug
imported; and
(c)
follow the procedures specified in rules 42, 45, 46 and 47.
(3)
Any quantity of morphine, codeine, thebaine and their salts or finished formulations for export that remain
unutilised shall be surrendered to the Government Opium and Alkaloids Works and accounting for this purpose shall
be submitted to the Narcotics Commissioner at the end of the period made available to the licensee for import under this
Certificate and subsequent export of the formulation and alkaloids.
(4)

The certificate is not valid unless it bears the Official Seal of the Issuing Authority on the top right-hand
corner.”
