सा.का.जन. 673(अ).––कजतपय जनयमों का जनम्नजलजखत मसौिा, जिसे, केंद्रीय सरकार जिमान िस्ट्तुओं में
जितों का संरक्षण अजधजनयम, 2025 (2025 का 17) की धारा 10 सपठित धारा 4, धारा 5 की उपधारा (1)
और उपधारा (2) द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताि करती िै, जिसे उि अजधजनयम की
धारा 10 की उपधारा (3) की अपेक्षानुसार, इससे प्रभाजित िोने िाले सभी व्यजियों के सूचनार्थ एतद्दिारा
प्रकाजित दकया िाता िै; और एतद्दिारा यि सूचना प्रिान की िाती िै दक भारत के रािपत्र, जिसमें यि
अजधसूचना प्रकाजित की गई िै, की प्रजतयााँ िनता के जलए उपलब्ध िोने की तारीख से तीस दिनों की अिजध के
पश्चात उि मसौिा जनयमों पर जिचार दकया िाएगा;
आपजत्त या सुझाि यदि कोई िों, उन्िें जनिेिक, भारत सरकार, 'बी' ब्लॉक, रािीि गांधी भिन, नई
दिल्ली - 110003 को संबोजधत दकया िा सकता िै; अर्िा rohit.raj@gov.in पर मेल दकया िा सकता िै;
उपयुथि जिजनर्िथष्ट अिजध की समाजि से पूिथ उि मसौिा जनयमों के संबंध में दकसी व्यजि से प्राि दकसी
आपजत्त या सुझाि पर केंद्रीय सरकार द्वारा जिचार दकया िाएगा।

1. संजक्षि िीर्थक, प्रारंभ और जिस्ट्तार. – (1) इन जनयमों को जिमान िस्ट्तुओं में जितों का संरक्षण जनयम, 2025 किा
िाए।

(2) ये आजधकाठरक रािपत्र में इनके प्रकािन की जतजर् से प्रिृत्त िोंगे।
2. पठरभार्ाएं. – (1) इन जनयमों में, िब तक दक संिभथ से अन्यर्ा अपेजक्षत न िो:
(क) "अजधजनयम" से तात्पयथ जिमान िस्ट्तुओं में जितों का संरक्षण अजधजनयम, 2025 (2025 का 17) से िै;
(ख) "अजभसमय" से तात्पयथ 16 निंबर, 2001 को केप टाउन में िस्ट्ताक्षठरत मोबाइल उपकरणों में अंतराथष्ट्रीय जितों
पर अजभसमय से िै;
(ग) "सीटीसी रजिस्ट्टर" से तात्पयथ इन जनयमों के अंतगथत बनाए गए रजिस्ट्टर से िै;
(घ) "आिेिन" से तात्पयथ इन जनयमों के अंतगथत प्रस्ट्तुत दकसी भी आिेिन, नोठटस या िस्ट्तािेि से िै;
(ङ) "प्रपत्र" से तात्पयथ इन जनयमों के पठरजिष्ट 'ग' में संलग्न प्रपत्र से िै;
(च) "आईडीईआरए" से तात्पयथ सम्मेलन के प्रोटोकॉल में जनधाथठरत प्रारूप में अपठरितथनीय पंिीकरण रद्द करना और
जनयाथत अनुरोध प्राजधकरण से िै;
(छ) "अंतराथष्ट्रीय रजिस्ट्री" से तात्पयथ समझौते के अनुच्छेि 16 के तित स्ट्र्ाजपत अंतराथष्ट्रीय रजिस्ट्री से िै;
(ि) "रजिस्ट्री प्राजधकरण" से तात्पयथ भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) की धारा 3 के तित
गठित नागर जिमानन मिाजनिेिालय से िै;
(झ) "स्ट्टेकधारक" से तात्पयथ इन जनयमों के पठरजिष्ट 'ख' में सूचीबद्ध स्ट्टेकधारक से िै;;
(2) इन जनयमों में प्रयुि और पठरभाजर्त निीं दकए गए दकन्तु अजधजनयम में पठरभाजर्त दकए गए अन्य सभी िब्िों और
अजभव्यजियों के ििी अर्थ िोंगे िो अजधजनयम में उन्िें दिए गए िैं।
3. रजिस्ट्री प्राजधकरण द्वारा जनिेि.— (1) रजिस्ट्री प्राजधकरण अजभसमय और प्रोटोकॉल के कायाथन्ियन के उद्देश्य से जनिेि
िारी करेगा।
(2) नागर जिमानन मिाजनिेिालय की िेबसाइट पर मसौिा प्रकाजित करने के पश्चात चौिि दिनों की अिजध के जलए
जनिेि िारी दकए िाएंगे तादक इससे प्रभाजित िोने िाले सभी व्यजियों से आपजत्तयां और सुझाि आमंजत्रत दकए िा सकें।
बिते दक मिाजनिेिक, िनजित में और जलजखत आिेि द्वारा ऐसी आपजत्तयां और सुझाि आमंजत्रत करने की
आिश्यकता को समाि कर सकते िैं या ऐसी आपजत्तयां और सुझाि प्रस्ट्तुत करने की अिजध को कम कर सकते िैं।
(3) उप-जनयम (1) के अंतगथत िारी दकए गए प्रत्येक जनिेि का अनुपालन, उस व्यजि(व्यजियों) अर्िा संस्ट्र्ा(संस्ट्र्ाओं)
द्वारा दकया िाएगा, जिन्िें ऐसा जनिेि िारी दकया गया िै।
4. रजिस्ट्री प्राजधकरण के कायथ. — रजिस्ट्री प्राजधकरण जनम्नजलजखत के जलए उत्तरिायी िोगा:
(i) सीटीसी रजिस्ट्टर की स्ट्र्ापना एिं रखरखाि; और
(ii) और उपयुथि से उत्पन्न िोने िाले दकसी भी मामले िेतु।
5. रजिस्ट्री प्राजधकरण में दकसी जिमान िस्ट्तु पर जित का पंिीकरण.- (1) दकसी जिमान िस्ट्तु का पठरचालन करने िाले
दकसी भी िेनिार को, ििााँ ऐसी जिमान िस्ट्तु दकसी अंतराथष्ट्रीय जित के अध्यधीन िै, भारत में ऐसी जिमान िस्ट्तु के
पंिीकरण के तीस (30) दिनों के भीतर रजिस्ट्री प्राजधकरण में ऐसी जिमान िस्ट्तु में जित पंिीकृत कराना िोगा;
बिते दक दकसी भी जिमान िस्ट्तु के संबंध में िो, इन जनयमों के प्रारंभ िोने की तारीख तक, भारत में पिले से िी
पंिीकृत िै अर्िा भारत में पठरचाजलत की िा रिी िै और दकसी अंतराथष्ट्रीय जित के अध्यधीन िै, िेनिार इन जनयमों के
लागू िोने की तारीख से नब्बे (90) दिनों के भीतर रजिस्ट्री प्राजधकरण में ऐसे अंतराथष्ट्रीय जित को पंिीकृत करेगा।
(2) उप-जनयम (1) के तित पंिीकरण के जलए आिेिन प्रपत्र - I में दकया िाएगा और रजिस्ट्री प्राजधकरण द्वारा सीटीसी
रजिस्ट्टर में इस बात से संतुष्ट िोने पर पंिीकृत दकया िाएगा दक आिेिन सभी प्रकार से पूणथ िै और इन जनयमों का
अनुपालन करता िै।

(3) उप-जनयम (1) के तित पंिीकरण िोने पर, रजिस्ट्री प्राजधकरण अपने पंिीकरण प्रमाणपत्र में जिमान को सौंपे गए
भारतीय राष्ट्रीयता पंिीकरण जचह्न के माध्यम से ऐसी जिमान िस्ट्तु की पिचान करता िै।
6. दकसी जिमान िस्ट्तु पर बकाया राजि के ठरकोडों का अनुरक्षण. – (1) जनयम 5 के उपजनयम (3) के तित पंिीकरण के
पश्चात, िेनिार जिमान िस्ट्तु के स्ट्िामी या प्रचालक द्वारा स्ट्िाजमत्ि या उपयोग के संबंध में उत्पन्न, उससे संबंजधत या
बकाया राजि के ठरकॉडथ को अनुरजक्षत रखेगा और रजिस्ट्री प्राजधकरण को प्रस्ट्तुत करेगा।
(2) ऐसा िेनिार इन जनयमों के पठरजिष्ट 'क' के तित सूचीबद्ध िेय राजियों को रजिस्ट्री प्राजधकरण को प्रस्ट्तुत करेगा और
समय-समय पर इन्िें अनुरजक्षत रखेगा।
(3) िेनिार द्वारा प्रस्ट्तुतीकरण और अनुरक्षण प्रत्येक जतमािी की समाजि के पश्चात् कैलेंडर माि के 5िें दिन से पिले निीं
दकया िाएगा, तर्ा िब तक जिमान िस्ट्तु पर जित भारत में सीटीसी रजिस्ट्टर पर पंिीकृत रिेगा, तब तक प्रस्ट्तुतीकरण
और अनुरक्षण िारी रिेगा।
(4) ऐसा प्रस्ट्तुतीकरण नागर जिमानन मिाजनिेिालय द्वारा संचाजलत पोटथल पर इन जनयमों के सार् संलग्न इलेक्ट्रॉजनक
प्रारूप में फामथ II में दकया िाएगा।
(5) उप-जनयम (3) के तित प्रस्ट्तुत दकए िाने की अिजध के बाििूि, िेनिार जनम्नजलजखत जस्ट्र्जत में रजिस्ट्री प्राजधकरण को
प्रस्ट्तुत करेगा और सूजचत करेगा:-
(क) रजिस्ट्री प्राजधकरण द्वारा कोई जिजिष्ट जनिेि; या
(ख) लेनिार को भुगतान में चूक ।
7. सीटीसी रजिस्ट्टर तक पहुंच. – सीटीसी रजिस्ट्टर जिजिष्ट जिमान िस्ट्तु के संबंध में स्ट्टेकधारक और लेनिार की श्रेणी के
जलए इलेक्ट्रॉजनक रूप से सुलभ िोगा।
8. चूक िोने पर रजिस्ट्री प्राजधकरण को सूजचत करना. – (1) कोई भी लेनिार अजभसमय या प्रोटोकॉल के अंतगथत कोई भी
उपाय करने से पूिथ प्रपत्र III में घोजर्त चूक की सूचना रजिस्ट्री प्राजधकरण को िेगा।
(2) उपजनयम (1) के अंतगथत प्ररूप 3 में ऐसे आिेिन की प्राजि पर रजिस्ट्री प्राजधकरण इस प्राजि की सूचना िेगा।
9. स्ट्टेकधारकों के सार् समन्िय.– (1) जनयम-8 के उप-जनयम (2) के अंतगथत प्राजि की पािती पर, अगले कायथ दििस की
समाजि से पूिथ, रजिस्ट्री प्राजधकरण:-
(क) सभी श्रेणी के स्ट्टेकधारकों को सूजचत करेगा;
(ख) अपनी िेबसाइट पर जिमान िस्ट्तु जििरण सजित एक नोठटस प्रकाजित करेगा;
(ग) तीन कायथ दििसों के भीतर बकाया राजि िमा करने का अनुरोध करेगा;
(2) ऐसे जिमान िस्ट्तु पर बकाया राजि का िािा करने िाले स्ट्टेकधारक की श्रेणी को प्रपत्र-IV में जिस्ट्तृत जििरण प्रस्ट्तुत
करना िोगा।
10. जिमान का पंिीकरण रद्द करना और जनयाथत करना. — यदि लेनिार प्रोटोकॉल के अनुच्छेि XIII के तित उपाय का
प्रयोग करने की इच्छा रखता िै, रजिस्ट्री प्राजधकरण द्वारा भारतीय िायुयान अजधजनयम, 2024 या उसके अधीन बनाए
गए दकसी जनयम के अनुसार कारथिाई की िाएगी।
11. चूक के बाि उत्पन्न िोने िाली िेय राजि. — जनयम 8 के तित रजिस्ट्री प्राजधकरण को सूजचत करने के बाि उत्पन्न िोने
िाले पठरजिष्ट 'क' में सूचीबद्ध दकसी भी बकाया को प्रार्जमकता िी िाएगी और भारतीय िायुयान अजधजनयम, 2024 या
उसके तित बनाए गए दकसी भी जनयम के प्रािधानों के अनुसार भारत से जिमान के जनयाथत से पूिथ आईडीईआरए धारक
द्वारा (i) से (iv) और (vi) में सूचीबद्ध स्ट्टेकधारकों को इसका भुगतान करना िोगा।
12. अजभसमय के अनुच्छेि 40 के तित अजधकारों या जितों का पंिीकरण. — अजभसमय के अनुच्छेि 40 के तित पठरजिष्ट
'ख' में सूचीबद्ध स्ट्टेकधारक की श्रेणी के अजधकार या जित को स्ट्टेकधारक द्वारा अंतराथष्ट्रीय रजिस्ट्री के सार् ऐसे जिमान िस्ट्तु
पर पंिीकरण योग्य गैर-सिमत अजधकार या जित (आरएनसीआरआई) के रूप में पंिीकृत दकया िाएगा।

13. पठरजिष्टों में संिोधन. — रजिस्ट्री प्राजधकरण इन जनयमों के अंतगथत पठरजिष्टों में संिोधन कर सकता िै।

exercise of the powers conferred by Section 4, sub-section (1) and sub-section (2) of Section 5 read with Section 10 of
the Protection of Interests in Aircraft Objects Act, 2025 (17 of 2025), is hereby published as required by sub-section
(3) of Section 10 of the said Act, for information to all persons likely to be affected thereby; and notice is hereby
given that the said draft rules will be taken into consideration after a period of thirty days from the date on which
copies of the Gazette of India, in which this notification is published, are made available to the public;
Objections or suggestions, if any, may be addressed to Director to the Government of India, ‘B’ Block, Rajiv
Gandhi Bhawan, New Delhi – 110003; or mailed to rohit.raj@gov.in;
Any objection or suggestion which may be received from any person with respect to the said draft rules
before the expiry of the period specified above will be considered by the Central Government.
Draft Rules
1. Short Title, Commencement and Extent. – (1) These rules may be called the Protection of Interests in Aircraft
Objects Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. – (1) In these rules, unless the context otherwise requires:
(a) "Act" means The Protection of Interests in Aircraft Objects Act, 2025 (17 of 2025);
(b) “Convention” means the Convention on International Interests in Mobile Equipment, signed at Cape Town
on 16 November, 2001;
(c) "CTC Register" means the register as maintained under these rules;
(d) "Application" means any application, notice, or document submitted under these rules;
(e) "Form" means a form appended in the Appendix ‘C’ to these rules;
(f) "IDERA" means an Irrevocable De-registration and Export Request Authorization substantially in the form
set forth in the Protocol to the Convention;
(g) "International Registry" means the International Registry established under Article 16 of the Convention;
(h) "Registry Authority" means the Directorate General of Civil Aviation constituted under section 3 of the
Bharatiya Vayuyana Adhiniyam, 2024 (16 of 2024);
(i) “stakeholder” means the stakeholder as listed in Appendix ‘B’ to these rules;
(2) All other words and expressions used and not defined in these rules but defined in the Act shall have the same
meanings assigned to them in the Act.
3. Directions by Registry Authority.— (1) The Registry Authority shall issue directions with the objective of
implementation of the Convention and Protocol.
(2) The directions shall be issued after placing the draft on the website of the Directorate General of Civil Aviation for
a period of fourteen days for inviting objections and suggestions from all persons likely to be affected thereby.
Provided that the Director General may, in the public interest and by order in writing, dispense with the requirement
of inviting such objection and suggestions or reduce the period for submitting such objections and suggestions.
(3) Every direction issued under sub-rule (1) shall be complied with by the person(s) or entity(ies) to whom such
direction is issued.
4. Functions of the Registry Authority. — The Registry Authority shall be responsible for:
(i) establishing and maintaining the CTC Register; and
(ii) and for any matter arising out of the above.

5. Registration of interest on an aircraft object with Registry Authority.- (1) Any debtor operating an aircraft
object, where such aircraft object is subjected to an international interest, shall register the interest in such aircraft
object with the Registry Authority within thirty (30) days of registration of such aircraft object in India;
Provided that in respect of any aircraft object that, as on the date of commencement of these rules, is already
registered in India or is being operated in India and is subject to an international interest, the debtor shall register such
international interest with the Registry Authority within ninety (90) days from the date of these rules coming into
force.
(2) The application for registration under sub-rule (1) shall be made in Form I and shall be registered by the Registry
Authority in the CTC Register on being satisfied that the application is complete in all respects and complies with
these rules.
(3) Upon registration under sub-rule (1), the Registry Authority identifies such aircraft object through Indian
nationality registration mark assigned to the aircraft in its Certificate of Registration.
6. Maintenance of records of dues on an aircraft object. – (1) Upon registration under sub rule (3) of Rule 5, the
debtor shall maintain and submit to the Registry Authority, records of dues arising from, related to or owed in regard
to the ownership or use by the owner or operator of the aircraft object.
(2) Such debtor shall submit and periodically maintain with the Registry Authority, the dues listed under Appendix A
of these Rules.
(3) The submission and maintenance shall be made by the debtor, not later than the 5th day of the calendar month
following the end of each quarter, and shall continue to be submitted and maintained for as long as the interest on the
aircraft object remains registered on the CTC Register in India.
(4) Such submission shall be made in Form II appended to these Rules electronic format on the portal hosted by the
Directorate General of Civil Aviation.
(5) Notwithstanding the period of submission to be made under sub-rule (3), the debtor shall submit and inform the
Registry Authority, in the event of :-
(a) a specific direction by the Registry Authority; or
(b) default in payment to the creditor.
7. Access to the CTC Register. – The CTC register shall be electronically accessible in respect of the specific aircraft
object to the category of stakeholder and the creditor.
8. Notifying the Registry Authority for occurrence of default. – (1) A creditor before exercising any remedy under
the Convention or Protocol shall notify the Registry Authority of declared default in Form III.
(2) Upon receipt of such application in Form III under sub-rule (1), the Registry Authority shall acknowledge the
receipt.
9. Co-ordination with Stakeholders.– (1) Upon acknowledgement of receipt under sub-rule (2) of Rule 8, before the
end of the next working day, the Registry Authority shall:-
(a) Notify all the category of stakeholders;
(b) Publish a notice on its website with aircraft object details;
(c) Request submission of outstanding dues within three working days;
(2) The category of stakeholder claiming outstanding dues on such aircraft object shall submit detailed statements in
Form IV.
10. De-registration and export of aircraft. — If the creditor intends to exercise remedy under Article XIII of the
Protocol, the Registry Authority shall take actions in accordance with the Bharatiya Vayuyana Adhiniyam, 2024 or
any rules made thereunder.

11. Dues arising after default. — Any dues listed in Appendix ‘A’ arising after notifying the Registry Authority
under Rule 8 shall have priority and would need to be cleared by the IDERA Holder to the stakeholders listed at (i) to
(iv) and (vi) before the aircraft is exported from India as per the provisions of Bharatiya Vayuyana Adhiniyam, 2024
or any rules made thereunder.
12. Registration of Rights or interests under Article 40 of the Convention. — The right or interest under Article
40 of the Convention of the category of stakeholder listed in Appendix ‘B’, shall be registered as Registrable Non
Consensual Rights or Interests (RNCRI) on such aircraft object by the stakeholder with the International Registry.
13. Amendment of Appendices. — The Registry Authority may amend the Appendices under these Rules.
