सा.का.जन. 767(अ)- केन्द रीय सरकार, बॉयलर अजधजनयम, 2025 (2025 का 12) की धारा 39 की
उप-धारा (2) के खंड (ट) और (ठ) द्वारा प्रित्त िजियों का प्रयोग करते हुए तथा बॉयलर (िांच, न्द यायजनणधयन और
अपील) जनयमावली, 2024 को, उन बातों के जसवाय अजधक्ांत करते हुए, जिन्द हें ऐसे अजधक्मण से पूवध दकया गया
है, या करने का लोप दकया गया है, जनम्नजलजखत जनयम बनाती है, अथाधत् –

संजिप् त नाम और आरंभ - (1) इन जनयमों का संजिप् त नाम बॉयलर (न्द यायजनणधयन और अपील) जनयम,
2025 है।
(2) ये इनके रािपत्र में प्रकािन की तारीख को प्रवृत् त होंगे।

(क) ‘अजधजनयम’ से बॉयलर अजधजनयम, 2025 (2025 का 12) अजभप्रेत है;
(ख) "न्दयायजनणधयन अजधकारी" से अजधजनयम की धारा 35 की उप-धारा (1) के अधीन प्राजधकृत जिला मजिस्ट् रेट
अथवा अजतररक् त जिला मजिस्ट् रेट अजभप्रेत है;
(ग) "अपील प्राजधकारी" से अजधजनयम की धारा 36 की उप-धारा (1) के अधीन प्राजधकृत अजधकारी अजभप्रेत है;
(घ) “प्ररूप” से इन जनयमों में संलग् न प्ररूप अजभप्रेत है।
(2) उन िब् िों और पिों के, िो इसमें प्रयुक् त हैं और पररभाजषत नहीं है, वही अथध होंगे, िो उनके इस अजधजनयम
में है।

लागू होना – ये जनयम सभी संघ राज् य िेत्रों में लागू होंगे।

जिकायत —जनरीिक सजहत कोई भी व्यजि अजधजनयम की धारा 27, 28, धारा 30 की उप-धारा (1)
और धारा 31 के अधीन दकए गए दकसी उल्लंघन के संबंध में न्दयायजनणधयन अजधकारी को इलेक्रॉजनक माध् यम
अथवा स्ट् पीड पोस्ट् ट अथवा व् यजिगत रूप से प्ररूप-1 में जिकायत अजभजलजखत करा सकता है।

न्दयायजनणधयन के जलए िांच करना – (1) अजधजनयम की धारा 35 के अधीन न्दयायजनणधयन के प्रयोिन
के जलए, यदि न्दयायजनणधयन अजधकारी के पास यह जवश् वास का कारण है दक दकसी व्यजि ने उस धारा में जवजनर्िधष्ट
उपबंधों का उल्लंघन दकया है, तो वह ऐसे व्यजि को प्ररूप-II में नोरटस िारी करेगा, जिसमें उसे नोरटस में
जवजनर्िधष्ट अवजध के भीतर, िो दक तामील की तारीख से सात दिन की अवजध से कम न हो, कारण बताना
अपेजित होगा दक उसके जवरुद्ध िांच क्यों नहीं की िानी चाजहए।
(2) उप-जनयम (1) के अधीन प्रत्येक नोरटस, दकए गए कजथत उल्लंघन की प्रकृजत को इंजगत करेगा।
(3) ऐसे व्यजि द्वारा प्रस्ट्तुत दकए गए कारण, यदि कोई हों, पर जवचार करने के पश् चात्, यदि न्दयायजनणधयन
अजधकारी की राय है दक िांच की िानी चाजहए, तो वह उस व्यजि को नोरटस में यथाजनधाधररत तारीख को
व्यजिगत रूप से उपजस्ट्थत होने के जलए या उसके द्वारा सम् यक् रूप से प्राजधकृत प्रजतजनजध के िररए उपजस्ट्थत
होने के जलए एक नोरटस िारी करेगा।
(4) उपजस्ट्थत होने की जनयत तारीख को, न्दयायजनणधयन अजधकारी, उस व्यजि या उसके प्राजधकृत प्रजतजनजध को,
जिसके जवरूद्ध कायधवाही प्रारंभ की गई है, यह समझाएगा दक ऐसे व्यजि द्वारा कजथत तौर पर कौन-सा उल्लंघन
दकया गया है।
(5)
तत्पश्चात, न्दयायजनणधयन अजधकारी द्वारा, उस व्यजि को प्ररूप-III के अधीन ऐसे िस्ट्तावेि या साक्ष्य
प्रस्ट्तुत करने का अवसर दिया िाएगा, जिन्दहें वह िांच के जलए सुसंगत समझे और यदि आवश्यक हो, तो सुनवाई
को दकसी आगामी तारीख तक स्ट्थजगत दकया िा सकता है।
(6)
इस जनयम के अधीन िांच करते समय न्दयायजनणधयन अजधकारी, मामले के तथ्यों और पररजस्ट्थजतयों से
पररजचत दकसी भी ऐसे व्यजि से साक्ष्य िेने या कोई िस्ट्तावेि प्रस्ट्तुत करने की अपेिा कर सकता है तथा उसे
बुला सकता है, िो न्दयायजनणधयन अजधकारी की राय में िांच की जवषय-वस्ट्तु के जलए उपयोगी या संगत हो
सकता है।

यदि कोई व्यजि उप जनयम (3) के अधीन िारी नोरटस के संिभध में न्दयायजनणधयन अजधकारी के समि
उपजस्ट्थत होने में जवफल रहता है, उपेिा करता है या उपजस्ट्थत होने से इनकार करता है, तो न्दयायजनणधयन
अजधकारी ऐसे व्यजि की अनुपजस्ट्थजत में, ऐसा करने के कारणों को अजभजलजखत करने के पश् चात्, िांच को आगे
बढा सकता है।
(8)
यदि, न्दयायजनणधयन अजधकारी के समि प्रस्ट्तुत दकए गए साक्ष्य पर जवचार करने पर, न्दयायजनणधयन
अजधकारी संतुष्ट हो िाता है दक व्यजि ने उल्लंघन दकया है, तो वह तकधसंगत तथा जलजखत आिेि द्वारा अजधजनयम
के अधीन, ऐसी िाजस्ट्त लगा सकता है िो वह उजचत समझे।
(9)
उप-जनयम (8) के अधीन दकए गए प्रत्येक आिेि में इस अजधजनयम के उन उपबंधों को जनर्िधष्ट दकया
िाएगा, जिनके संबंध में उल्लंघन दकया गया है और उसमें िाजस्ट्त लगाने के कारणों को िाजमल दकया िाएगा।
(10) इस जनयम के अधीन दिए गए आिेि की एक प्रजत और कायधवाही की अन्दय सभी प्रजतयां जिकायतकताध तथा
उस व्यजि को जबना दकसी फीस के िी िाएंगी, जिसके जवरुद्ध िांच की गई थी तथा आिेि की एक प्रजत मुख् य
जनरीिक को भी अग्रेजषत की िाएगी।
(11) न्दयायजनणधयन अजधकारी, उप जनयम (1) के अधीन नोरटस िारी करने के छह माह के भीतर कायधवाही
पूरी करेगा।
6.
अपीलः- (1) कोई व्यजि, िो इन जनयमों के अधीन न्दयायजनणधयन अजधकारी के आिेि से असंतुष्ट है, वह
ऐसे आिेि की प्राजि की तारीख से साठ दिनों के भीतर अपील प्राजधकारी के समि समि प्ररूप IV में अपील
िायर कर सकता है।
(2) िहां कोई अपील उप-जनयम (1) में जवजनर्िधष्ट अवजध की समाजि के पश्चात प्रस्ट्तुत की िाती है, वहां आवेिन
पत्र के साथ िपथ पत्र संलग्न दकया िाएगा, जिसमें अपीलकताध द्वारा उन संगत तथ्यों का उल्लेख दकया िाएगा
तादक वह अपील प्राजधकारी को संतुष्ट कर सके दक जनधाधररत अवजध के भीतर अपील प्रस्ट्तुत न करने के उसके
पास पयाधि कारण जवद्यमान थे।
(3) उप-जनयम (1) के अधीन िायर अपील के साथ जनम्नजलजखत िस्ट्तावेि संलग्न दकए िाएंगे -
(क) जनयम 5 के उप-जनयम (8) के अधीन िारी न्दयायजनणधयन अजधकारी के आिेि की प्रजत;
(ख) जिन तथ्यों के जवरुद्ध अपील की गई है उनका स्ट्पष्ट जववरण;
(ग) अपील का आधार; और
(घ) अजधजनयम की संबंजधत धारा का उल्लेख।
(4) अपील तीन प्रजतयों में िायर की िाएगी-
(क) अपीलकताध द्वारा स्ट् वयं; अथवा
(ख) उसके जवजधवत रूप से प्राजधकृत प्रजतजनजध द्वारा; अथवा
(ग) उसकी ओर से जवजधवत रूप से जनयुक् त वकील द्वारा

(5) डाक से भेिी गई अपील, अपील प्राजधकारी के समि उस तारीख को िायर मानी िाएगी जिस तारीख को वह
प्राप् त हुई है।
(6) िांच के पश् चात् यदि अपील सही पाई गई, तो उसे अपील प्राजधकारी की फाइल पर जलया िाएगा।
(7) िांच के उपरांत,-
(क) िहां अपील त्रुरटपूणध पाई गई है और पाई गई त्रुरट औपचाररक प्रकृजत की है, वहां अपील प्राजधकारी अपीलकताध
को स्ट्वयं की उपजस्ट्थजत में उसे सुधार करने की अनुमजत िे सकता है;
(ख) िहां त्रुरट औपचाररक प्रकृजत की नहीं है, वहां अपील प्राजधकारी, अपीलकताध को त्रुरट को सुधारने के जलए
उतना समय िे सकता है, जितना वह उजचत समझे;
(ग) िहां ऐसी अपील डाक द्वारा भेिी गई हो और उसमें त्रुरट पाई गई हो, वहां अपील प्राजधकारी अपीलकताध को
त्रुरट की सूचना िे सकेगा और अपीलकताध को त्रुरट को ठीक करने के जलए उतना समय िे सकेगा, जितना वह उजचत
समझे।
(8) िहां अपीलकताध उप जनयम (8) के अधीन अनुमत समय के भीतर त्रुरट को िूर करने में असफल रहता है, वहां
अपील प्राजधकारी आिेि द्वारा, तथा जलजखत रूप में अजभजलजखत दकए िाने वाले कारणों से, अपील को रजिस्ट् रीकृत
करने से इनकार कर सकता है और ऐसा आिेि अपीलकताध को उसके सात दिन के भीतर संसूजचत कर सकता है।
7. फीस – (i) प्रत्येक अपील के साथ 1000/- रुपए (एक हिार रुपए मात्र) की फीस आहरण एवं संजवतरण
अजधकारी, उद्योग संवधधन और आंतररक व्यापार जवभाग, के पि में नई दिल्ली को िेय दकसी भी राष्ट्रीयकृत बैंक के
क्ॉस्ट्ड जडमांड ड्राफ्ट, अथवा भारत कोष पोटधल www.bharatkosh.gov.in के माध्यम से िमा करना होगा।
(2) भुगतान पावती पची अपील के साथ संलग्न करनी होगी।
8. प्रजतवािी को अपील की सूचना- अपील की एक प्रजत अपील प्राजधकारी द्वारा प्रजतवािी को, व्यजिगत रूप से
या स्ट्पीड पोस्ट्ट द्वारा या इलेक्रॉजनक माध्यम से िी िाएगी।
9. प्रजतवािी द्वारा अपील का प्रत् युत्तर िायर करना- (1) प्रजतवािी, अपील का नोरटस दिए िाने के तीस दिनों के
भीतर अपील प्राजधकारी के समि प्रत् युत्तर िायर करेगा।
(2) प्रजतवािी द्वारा िायर प्रत्येक आवेिन, प्रत् युत्तर, िस्ट्तावेि या जलजखत सामग्री की एक प्रजत, अपील प्राजधकारी
द्वारा अपीलकताध को तत्काल तामील की िाएगी।
10. सुनवाई की तारीख- अपील प्राजधकारी अपील की सुनवाई के जलए जनयत तारीख की सूचना पिकारों को िेगा।
11. अपील का जनपटान- (1) सुनवाई के जलए जनयत तारीख को या दकसी अन्दय तारीख को, जिसके जलए सुनवाई
स्ट्थजगत की िा सकती है, -
(क) अपील के संिभध में अपीलकताध का पि सुना िाएगा;
(ख) अपील प्राजधकारी, यदि आवश्यक हो, प्रजतवािी या उसके प्राजधकृत प्रजतजनजध का पि सुनेगा;
(ग) अपीलकताध िबाव िेने का हकिार होगा; और

(घ) जलजखत तकों के साथ मौजखक बहस भी की िा सकेंगी, िो अपील प्राजधकारी द्वारा जनर्िधष्ट समय-सीमा के
अध्यधीन होंगी।
(2) अपील प्राजधकारी संबंजधत न्दयायजनणधयन अजधकारी से कायधवाही के अजभलेख मांग सकेगा।
(3) िहां अपीलकताध उपजस्ट्थत होने में असफल रहता है, वहां अपील प्राजधकारी अपने जववेकानुसार-
(i) अपील को खाररि कर सकता है; या
(ii) अपील के गुण-िोष के आधार पर एकपिीय जनणधय कर सकता है।
(4) अपील प्राजधकारी अपील िायर करने की तारीख से साठ दिनों के भीतर अपील का जनपटान कर िेगा।
(5) इस जनयम के अधीन प्रत्येक आिेि पर तारीख अंदकत होगी, हस्ट्तािर दकए िाएंगे तथा सभी पिों को सूजचत
दकया िाएगा।
12.
आिेि और िाजस्ट्त - (1) इन जनयमों के अधीन पाररत प्रत्येक आिेि पर तारीख अंदकत होगी, हस्ट् तािर
दकए िाएंगे तथा सभी पिों को सूजचत दकया िाएगा।
(2)
इन जनयमों के अधीन िाजस्ट्त के िररए वसूली गई समस्ट् त राजि भारत की समेदकत जनजध में िमा की
िाएगी।

NOTIFICATION
New Delhi, the 17th October, 2025
G.S.R. 767 (E). ––– In exercise of the powers conferred by clauses (k) and (l) of sub-section (2) of
section 39 of the Boilers Act, 2025 (12 of 2025) and in supersession of the Boiler (Inquiry, Adjudication and
Appeal) Rules, 2024, except as respects things done or omitted to be done before such supersession, the
Central Government hereby makes the following rules, namely:-
1.
Short title and commencement. – (1) These rules may be called the Boilers (Adjudication and
Appeal) Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.
Definitions.–(1) In these rules, unless the context otherwise requires, –––
(a) “Act” means the Boilers Act, 2025 (12 of 2025);
(b) “adjudicating officer” means the District Magistrate or the Additional District Magistrate
authorised under sub-section (1) of section 35 of the Act;
(c) “appellate authority” means an officer authorised under sub- section (1) of section 36 of the Act;
(d) “form” means the forms appended to these rules.
(2) Words and expressions used herein and not defined but defined in the Act shall have the meanings
assigned to them in the Act

Application.––– These rules shall apply to all Union territories.
4.
Complaint. — Any person including an inspector may file a complaint in Form-I through
electronic means or speed post or by hand to the adjudicating officer regarding any violation of the
provisions of sections 27, 28, sub-section (1) of section 30 and 31 of the Act.
5.
Holding of inquiry for adjudication. — (1) For the purpose of adjudication under section 35 of
the Act, if the adjudicating officer has reason to believe that any person has violated the provisions
specified in that section, shall issue a notice in Form-II to such person, requiring him to show cause within

a period as may be specified therein, not being less than seven days from the date of service thereof, as to
why an inquiry should not be held against him.
(2) Every notice under sub-rule (1) shall indicate the nature of contravention alleged to have been
committed.
(3) Where after considering the cause shown, if any, the adjudicating officer is of the opinion that an
inquiry ought to be held, he shall issue a notice requiring the person to appear, either personally or through
a duly authorised representative, on such date as may be specified therein.
(4) On the date fixed for appearance, the adjudicating officer shall explain to the person proceeded against,
or to his authorised representative, the contravention alleged to have been committed.
(5) The adjudicating officer shall give the person, an opportunity to produce such documents or evidence
in Form-III as he may consider relevant to the inquiry, for the purpose of adjudication, and if necessary,
the hearing may be adjourned to a future date.
(6) The adjudicating officer may, require and enforce the attendance of any person well conversant with
the facts and circumstances of the case to give evidence or to produce any document which, in his opinion,
may be useful for or relevant to the subject matter of the adjudication.
(7) If any person fails, neglects or refuses to appear in response to a notice issued under sub-rule (3), the
adjudicating officer may proceed in the absence of such person, after recording the reasons thereof.
(8) If, upon consideration of the evidence adduced, the adjudicating officer is satisfied that the person has
committed the contravention, he may, by a reasoned order in writing, impose such penalty under the Act
as he considers appropriate.
(9) Every order made under sub-rule (8) shall specify the provisions of the Act contravened and shall
contain the reasons for imposition of the penalty.
(10) A copy of the order made under this rule, along with copies of all proceedings shall be supplied free
of cost to the complainant and to the person against whom the inquiry was held and a copy forwarded to
the Chief Inspector.
(11) The adjudicating officer shall complete the proceeding within six months from the issuance of the
notice under sub-rule (1).

Appeal.— (1) Any person aggrieved by an order of the adjudicating officer may, within a period of
sixty days from the receipt of such order, prefer an appeal to the appellate authority in Form -IV.
(2) Where an appeal is presented after the expiry of the period specified in sub-rule (1), it shall be
accompanied by an application supported by an affidavit setting forth the facts relied upon by the appellant

to satisfy the appellate authority that he had sufficient cause for not preferring the appeal within the prescribed
period.
(3) An appeal filed under sub-rule (1) shall be accompanied by —
(a) a copy of order of the adjudicating officer issued under sub-rule (8) of rule 5;
(b) a clear statement of facts appealed against;
(c) the grounds for appeal; and
(d) reference to the relevant section of the Act.
(4) The appeal shall be filed in triplicate —
(a) by the appellant in person; or
(b) by his duly authorised representative; or
(c) through an advocate duly appointed in this behalf.
(5) The appeal sent by post shall be deemed to have been presented to the appellate authority on the date of
its actual receipt.
(6) Upon scrutiny, if the appeal is found to be in order, it shall be taken on file of the appellate authority.
(7) Upon scrutiny,–
(a) Where if appeal is found to be defective and the defect noticed is formal in nature, the appellate authority
may allow the appellant to rectify the same in his presence;
(b) Where the defect is not formal in nature, the appellate authority may allow the appellant such time to
rectify the defect as he may deem fit;
(c) Where such appeal has been sent by post and found to be defective, the appellate authority may
communicate the defects to the appellant and allow the appellant such time to rectify the defect as he may
deem fit.
(8) Where the appellant fails to rectify the defect within the time allowed under sub-rule (8), the appellate
authority may, by order, and for reasons to be recorded in writing, decline to register the appeal and
communicate such order to the appellant within seven days thereof.
7.
Fee.- (i) Every appeal shall be accompanied by fee of ₹ 1000/- (Rupees One thousand only) in the
form of crossed demand draft drawn on any nationalised Bank in favour of Drawing and Disbursing Officer,
Department for Promotion of Industry and Internal Trade, payable at New Delhi or through Bharat Kosh
portal www.bharatkosh.gov.in:
(2) The payment acknowledgement slip shall be attached to the appeal.
8.
Notice of appeal to respondent.- A copy of the appeal shall be served by the appellate authority on
the respondent, by hand or by speed post or through electronic means.
9.
Filing of reply to appeal by respondent. – (1) The respondent may, within thirty days of service of
notice of appeal, file reply before the appellate authority.

(2) A copy of every application, reply, document or written material filed by the respondent, shall be forthwith
served on the appellant by the appellate authority.
10.
Date of hearing. -The appellate authority shall inform the parties of the date fixed for hearing of the
appeal.
11.
Disposal of appeal. — (1) On the date fixed for hearing or on any other date to which the hearing
may be adjourned, -
(a) the appellant shall be heard in support of the appeal;
(b) the appellate authority shall, if necessary, hear the respondent or his authorised representative;
(c) the appellant shall be entitled to reply; and
(d) the written arguments may be supplemented by oral arguments, subject to time limits as may be specified
by the appellate authority.
(2) The appellate authority may call for the records of the proceedings from the adjudicating officer
concerned.
(3) Where the appellant fails to appear, the appellate authority, may, in its discretion –
(i) dismiss the appeal; or
(ii) decide the appeal ex-parte on merits.
(4) The appellate authority may dispose of the appeal within sixty days from the date of filing of appeal.
(5) Every order under this rule, shall be dated, signed and communicated to all parties.
12.
Order and penalties. — (1) Every order under these rules, shall be dated, signed and communicated
to all the parties.
(2) All sums realised by way of penalties under these rules shall be credited to the Consolidated Fund of India
