और, उि अजधसूचना की प्रजतयां, 23 दिसंबर, 2025 को िनता को उपलब्ध करा िी गई थीं ; और, प्राि आिेपों एवं सुझावों पर केंद्रीय सरकार द्वारा जवचार दकया गया है ; अतः, अब, केंद्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 56 की उपधारा (1) और धारा 64 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंद्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अथागत् :-- सं. 315] नई दिल्ली, िुक्रवार, मई 08, 2026/वैिाख 18, 1948 No. 315] NEW DELHI, FRIDAY, MAY 8, 2026/VAISAKHA 18, 1948 सी.जी.-डी.एल.-अ.-12052026-272469 CG-DL-E-12052026-272469 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. संजिि नाम और प्रारंभ--(1) इन जनयमों का संजिि नाम केंद्रीय मोटर यान (छठा संिोधन) जनयम, 2026 है । (2) ये रािपत्र में उनके प्रकािन की तारीख से प्रवृत् त होंगे । 2. केंद्रीय मोटर यान जनयम, 1989 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया है) के जनयम 52 के उपजनयम (2) में,-- (क) “जवजनर्िगष्ट प्राजधकारी” िब्िों के पश्चात्, “या प्राजधकृत परीिण स्ट्टेिन” िब्ि अंतःस्ट्थाजपत दकए िाएंगे ; (ख) “उस प्राजधकारी से ठीक हालत में होने का प्रमाणपत्र” िब्िों के स्ट्थान पर, “उस प्राजधकारी या प्राजधकृत परीिण स्ट्टेिन से, प्ररूप 38 में, ठीक हालत में होने का प्रमाणपत्र” िब्ि रखे िाएंगे । 3. उि जनयम के जनयम 62 के उपजनयम (1) में,-- (क) “दकसी पररवहन यान की बाबत” िब्िों के स्ट्थान पर, “दकसी मोटर यान की बाबत” िब्ि रखे िाएंगे ; (ख) खंड (घ) के पश्चात्, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकए िाएंगे, अथागत् :-- (ङ) नया अपररवहन यान पंद्रह वर्ग (च) अपररवहन यानों के संबंध में ठीक हालत में होने के प्रमाणपत्र का नवीनीकरण पांच वर्ग : परंतु िहां जनयम 175 के अधीन रजिस्ट्रीकृत स्ट्वचाजलत परीिण स्ट्टेिन, दकसी रजिस्ट्रीकरण प्राजधकारी के अजधकार िेत्र में दक्रयात्मक है, वहां केंद्रीय मोटर यान (छठा संिोधन) जनयम, 2026 के प्रारंभ से, हल्के मोटर यान की श्रेणी में आने वाले यान के ठीक हालत में होने की िांच केवल ऐसे स्ट्वचाजलत परीिण स्ट्टेिन के माध्यम से की िाएगी । (ग) पहले परंतुक में, “ठीक होने का प्रमाण पत्र केवल तभी नवीकृत दकया िाएगा, िब जनरीिण आदिसर या अजधजनयम की धारा 56 की उपधारा (1) में यथा जनर्िगष्ट प्राजधकृत परीिण स्ट्टेिन नीचे िी गई सारणी में जवजनर्िगष्ट परीिण कर लेता है, अथागत् :--” िब्िों, अंकों और कोष्ठकों के स्ट्थान पर, “ठीक होने के प्रमाण पत्र का नवीनीकरण केवल,-- (i) धारा 56 की उपधारा (1) में यथाजनर्िगष्ट अजधकृत परीिण स्ट्टेिन द्वारा जनयम 189 के उपजनयम (1) में सारणी-घ में जवजनर्िगष्ट परीिण करने के पश्चात् ; या (ii) जनरीिण अजधकारी द्वारा नीचे िी गई सारणी में जनर्िगष्ट परीिण करने के पश्चात्, ठीक होने के परीिण के समय, केंद्रीय सरकार द्वारा जवकजसत मोबाइल एजललकेिन के माध्यम से, यान का कम से कम िस सेकंड का जियो-टैग वीजडयो कैलचर और अपलोड करने के पश्चात् ही दकया िाएगा, जिसमें रजिस्ट्रीकरण संखया ललेट, चेजसस नंबर और यान की जविेर्ताओं को स्ट्पष्ट िृश्यता सुजनजश्चत करते हुए सामने, पीछे, िाईं तरि और बाईं तरि से यान की िृश्यता को िर्िगत दकया गया हो, अथागत् :--” िब्ि, कोष्ठक, अंक और अिर रखे िाएंगे ; (घ) पहले परंतुक की सारणी में, क्रम संखया 20 और उससे संबंजधत प्रजवजष्टयों के पश्चात्, जनम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा, अथागत्, :- “(21) स्पीड गवर्नर ह ां ह ां ह ां (दृश्य) ह ां र्हीं नर्यम 118 क अर्ुप लर् सुनर्नित करर् दृश्य नर्रीक्षण म र्दांड : [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (i) सुरनक्षत रूप से निट नकय गय ; (ii) स्पीड गवर्नर को सील नकय ज एग । (iii) स्पीड गवर्नर की नवद्युत त रों को हट य र्हीं ज एग । (22) य र् स्थ र् ट्रैनकांग (वीएलटी) उपकरण ह ां ह ां (दृश्य) ह ां (दृश्य) ह ां ह ां नर्यम 90/नर्यम 125ज/ नर्यम 129 क अर्ुप लर् सुनर्नित करर् दृश्य नर्रीक्षण म र्दांड: (i) य र् स्थ र् ट्रैनकांग सांस्थ नपत की ज एगी ; (ii) आप तक लीर् अल मन बटर् क यन करेग । क य नत्मक नर्रीक्षण म र्दांड : (i) एआईएस 140 के अर्ुस र य र् डेट बेस में य र् स्थ र् ट्रैनकांग उपकरण सनिय होग ; (ii) ई-नसम की वैधत अवनध उस त रीख तक होगी, नजस नदर् य र् के पि त्वती ठीक ह लत में होर्े क परीक्षण देय होत है । (23) उच्च सुरक्ष व ले रनजस्ट्रीकरण प्लेट (एचएसआरपी) ह ां ह ां (दृश्य) ह ां (दृश्य) र्हीं र्हीं नर्यम 50 क अर्ुप लर् सुनर्नित करर् । दृश्य नर्रीक्षण म र्दांड : (i) य र् के स मर्े और पीछे उच्च सुरक्ष रनजस्ट्रीकरण प्लेट सांस्थ नपत हो, नजसमें नवांडशील्ड पर तृतीय नचह्न सनममनलत हो ; (ii) सुरनक्षत रूप से लग य गय । (24) रेट्रो-ररफ्लेक्टर और ररफ्लेनक्टव टेप ह ां ह ां ह ां (दृश्य) र्हीं र्हीं दृश्य नर्रीक्षण म र्दांड : (क) पर वतनक (i) स्वच्छ पर वतनक की नवद्यम र्त सुनर्नित करर् ; (ii) ररफ्लेक्टरों क सुरनक्षत निटमेंट ; 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) पर वतनक क्षनतग्रस्त अवस्थ में र्हीं होंगे ; (iv) सुनर्नित करर् नक पर वतनक क रांग नर्यम 104 के अर्ुस र होग , अथ नत, पीछे की ओर ल ल रांग य स मर्े की ओर सिेद । (ख) ररफ्लेनक्टव टेप (i) स्वच्छ पर वतनक टेपों की नवद्यम र्त सुनर्नित करर् ; (ii) य र् पर सुरनक्षत रूप से नचपक य गय हो ; (iii) सुनर्नित करर् नक ररफ्लेनक्टव टेप क आक र, रांग और स्थ र् नर्यम 104 के अर्ुस र होग ; (iv) ररफ्लेनक्टव टेप क्षनतग्रस्त र्हीं हों ; (v) नचन्ह अांनकत स मग्री के ब हर स्पष्ट रूप से सुप ठ्य नदख ई देंगे और अनमट होंगे । (25) सुरक्ष बेल्ट (सीट बेल्ट) ह ां र्हीं ह ां (दृश्य) र्हीं र्हीं नर्यम 125 य 125क क अर्ुप लर् सुनर्नित करर् । दृश्य नर्रीक्षण म र्दांड : (i) अनर्व यन सुरक्ष बेल्ट उपलब्ध और सुरनक्षत रूप से निट नकए ज एांगे ; (ii) सुरक्ष बेल्ट क्षनतग्रस्त र्हीं हों ; (iii) सुरक्ष बेल्ट एांकरेज ढील र्हीं हो; (iv) सीटबेल्ट ररम इांडर प्रण ली, यनद उपलब्ध हो, सुच रू नस्थनत में होर्ी च नहए ; (v) सीटबेल्ट क जी-लॉक सुच रू नस्थनत में होर् च नहए। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ङ) िूसरे परंतुक में, “ठीक होने का प्रमाण पत्र का नवीकरण केवल नीचे िी गई सारणी में जवजनर्िगष्ट परीिण करने के पश्चात् दकया िाएगा” िब्िों के स्ट्थान पर, “ठीक होने के प्रमाण पत्र का नवीनीकरण, केवल नीचे िी गई सारणी में जवजनर्िगष्ट परीिण करने के पश्चात्, ठीक होने के परीिण के समय, केंद्रीय सरकार द्वारा जवकजसत मोबाइल एजललकेिन के माध्यम से, यान का कम से कम िस सेकंड का जियो-टैग वीजडयो कैलचर और अपलोड करने के पश्चात् ही दकया िाएगा, जिसमें रजिस्ट्रीकरण संखया ललेट, चेजसस नंबर और यान की जविेर्ताओं की स्ट्पष्ट िृश्यता सुजनजश्चत करते हुए सामने, पीछे, िाईं तरि और बाईं तरि से यान की िृश्यता को िर्िगत दकया गया हो,” िब्ि रखे िाएंगे ; (च) तीसरे परंतुक और चौथे परंतुक का लोप दकया िाएगा ; (छ) पांचवें परंतुक के स्ट्थान पर, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत् :-- “परंतु यह और दक पूणग रूप से जनर्मगत यान के रूप में जवक्रय दकए िाने वाले नए गैर-पररवहन यान के रजिस्ट्रीकरण के समय ठीक हालत में होने के दकसी प्रमाण पत्र की अपेिा नहीं होगी और ऐसे यान को रजिस्ट्रीकरण की तारीख से पंद्रह वर्ों की अवजध के जलए ठीक हालत में होने का प्रमाण पत्र प्राि माना िाएगा ।”। 4. उि जनयम के जनयम 174 में, उपजनयम (1) के खंड (iii) में, “पररवहन यान के जलए प्ररूप 38 में और गैर-पररवहन यान के जलए प्ररूप 25 में िारी दकया गया प्रमाण पत्र अजभप्रेत है, िैसा भी मामला हो,” िब्िों और अंकों के स्ट्थान पर, “पररवहन यान और गैर-पररवहन यान के जलए प्ररूप 38 में िारी दकया गया प्रमाण पत्र अजभप्रेत है,” िब्ि और अंक रखे िाएंगे । 5. उि जनयम के जनयम 176 के उपजनयम (1) में,-- (क) पहले परंतुक के स्ट्थान पर, जनम्नजलजखत परंतुक रखा िाएगा, अथागत् :-- “परंतु यान के सुधार से संबंजधत कोई सेवा केंद्र या कोई व्यजि, उसी जिले में, िहां इस तरह के संचालन दकए िाते हैं, प्रत्यित: दकसी स्ट्वचाजलत परीिण केंद्र का स्ट्वामी या प्रचालक नहीं बनेगा ।”; (ख) िूसरे परंतुक का लोप दकया िाएगा । 6. उि जनयम के जनयम 177 के उपजनयम (2) में, “या जवजनमागण या यानों के जवक्रय या मोटर गाड़ी के पूिों या यानों को स्ट्क्रैप करना” िब्िों का लोप दकया िाएगा । 7. उि जनयम के जनयम 181 में,-- (क) उपजनयम (2) को लोप दकया िाएगा ; (ख) उपजनयम (3) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथागत् :-- “(3) स्ट्वचाजलत परीिण केंद्र पर ठीक हालत में होने के परीिण के जलए स्ट्लॉट बुक करते समय यान पहचान और यान के स्ट्वामी की पहचान के जलए जनम्नजलजखत िानकारी ििग की िाएगी, अथागत् :-- (i) दकसी यान की रजिस्ट्रीकरण संखया ; (ii) रजिस्ट्रीकृत स्ट्वामी या प्राजधकृत हस्ट्तािरकताग का मोबाइल नंबर ; (ग) उपजनयम (4) में,-- (i) खंड (viii) में, “जवजनमागण का महीना और वर्ग ; और” िब्िों के स्ट्थान पर, “जवजनमागण का मास और वर्ग ;” िब्ि रखे िाएंगे ; 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) खंड (ix) के पश् चात्, जनम्नजलजखत खंड अंतः स्ट्थाजपत दकए िाएंगे, अथागत् :-- “(x) बीमे की वैधता ; (xi) परजमट की वैधता, िहां कहीं लागू हो ; (xii) प्रिूर्ण जनयंत्रण प्रमाणपत्र की वैधता ।”; (घ) उपजनयम (6) में,-- (i) खंड (v) का लोप दकया िाएगा ; (ii) खंड (vi) के स्ट्थान पर, जनम्नजलजखत खंड रखा िाएगा, अथागत् :-- “िृश्य िांच डेटा, जिसमें जियो-टैग की गई तस्ट्वीरें और यान का कम से कम िस सेकंड का जियो- टैग वीजडयो सजममजलत है, को केंद्रीय सरकार द्वारा जवकजसत मोबाइल एजललकेिन के माध्यम से, कैलचर और अपलोड दकया िाएगा, जिसमें यान के आगे, पीछे, िाजहनी तथा बाईं तरि से रजिस्ट्रीकरण नंबर ललेट, चेजसस नंबर, यान की जविेर्ताओं और स्ट्वचाजलत परीिण स्ट्टेिन में यान की उपजस्ट्थजत को स्ट्पष्ट रूप से दिखाया िाएगा ।”; (ङ) उपजनयम (7) में,-- (i) “यथाजस्ट्थजत, प्ररूप 25 या” िब्िों का लोप दकया िाएगा ; (ii) खंड (iv) में, “के ब्यौरे” िब्िों के पश्चात्, “और िोटो” िब्ि अंतःस्ट्थाजपत दकए िाएंगे । 8. उि जनयम के जनयम 182 में,-- (क) उपजनयम (1) में, “त्रुरटयों को ठीक करवाने के पश्चात्” िब्िों के स्ट्थान पर, “जनयम 81 में यथा जवजनर्िगष्ट िीस का संिाय करने के पश् चात्” िब्ि रखे िाएंगे ; (ख) उपजनयम (1क) का लोप दकया िाएगा; (ग) उपजनयम (2) में, “प्राजधकृत हस्ट्तािरकताग को” िब्िों के पश्चात्, “जनयम 81 में यथा जवजनर्िगष्ट िीस का संिाय करने के पश् चात्” िब्ि अंतःस्ट्थाजपत दकए िाएंगे । 9. उि जनयम के जनयम 189 में,-- (क) उपजनयम (1) में,-- (i) सारणी घ में, क्र.सं. 23 के सामने,-- (अ) स्ट्तंभ 5 में, “िृश्यमान” िब्ि के स्ट्थान पर, “िृश्यमान और कायागत्मक” िब्ि रखे िाएंगे ; (आ) स्ट्तंभ 7 में क्र.सं. (ii) के पश्चात् जनम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा, अथागत् :-- “कायागत्मक जनरीिण मानिंड : (i) यान अवजस्ट्थजत खोि उपकरण एआईएस 140 के अनुसार वाहन डेटाबेस में सदक्रय होगा ; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (ii) ई-जसम की वैधता अवजध उस तारीख तक होगी, जिस दिन यान के पश्चात्वती ठीक हालत में होने का परीिण िेय होता है ; (iii) ठीक हालत में होने का परीिण के िौरान यान की अवजस्ट्थजत, यान अवजस्ट्थजत खोि उपकरण के माध्यम से सत्याजपत की िाएगी । (ii) रटलपण (क) में, “और जवजहत उपयुिता परीिण िुल्क का संिाय करने के बाि बहु पुनः परीिणों के जलए आवेिन करने के जलए अनुज्ञात दकया िाएगा” िब्ि का लोप दकया िाएगा ; (iii) रटलपण (ख) के स्ट्थान पर, जनम्नजलजखत रटलपण रखा िाएगा, अथागत् :-- “(ख) यदि कोई यान उपरोि (क) में सूचीबद्ध दकसी भी परीिण में असिल होने के पश्चात्, उसको पहली बार ‘अनदिट’ घोजर्त दकए िाने की तारीख से 180 दिनों के भीतर (परीिण के दिन के जसवाय) या उपयुिता प्रमाण पत्र के अवसान की तारीख से, िो भी पश्चात्वती हो, ‘दिट’ घोजर्त नहीं दकया िाता है, तो उस यान को ‘समयावजध पूणग हो चुके यान’ (ईएलवी) के रूप में वगीकृत दकया िाएगा और वाहन में ‘ईएलवी’ के रूप में जचजननत दकया िाएगा : परंतु राज्य या संघ राज्य िेत्र का रजिस्ट्रीकरण प्राजधकारी, आपवादिक पररजस्ट्थजतयों के अधीन, 180 दिनों से अजधक का जवस्ट्तार प्रिान कर सकेगा ।”; (iii) रटलपण (ग) में, “जवजहत उपयुिता परीिण िुल्क का संिाय करने के बाि ऐसे यान के बहु पुनः परीिण दकए िा सकेंगे ।” िब्िों का लोप दकया िाएगा । (ख) उपजनयम (5) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथागत् :-- “(5) जनयम 181 के उपजनयम (6) के अनुसार कैलचर दकए गए, सभी परीिण डेटा और िृश्यता जनरीिण डेटा, जिसमें िोटो और वीजडयो सजममजलत हैं, संपरीिा और जनधागरण प्रयोिनों के जलए, कम से कम 6 मास के जलए परररजित रखे िाएंगे ।”। 10. उि जनयमों के प्ररूप 38 में, “(केवल पररवहन यानों की ििा में ही लागू है)” कोष्ठकों और िब्िों का लोप दकया िाएगा । 11. उि जनयमों के प्ररूप 38क का लोप दकया िाएगा । [िा. सं. आरटी-16011/3/2023-टी-भाग(1)] महमूि अहमि, अपर सजचव रटल पण : मूल जनयम, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अजधसूचना संख या सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थे और अजधसूचना संख या सा.का.जन. 298(अ), तारीख 21 अप्रैल, 2026 द्वारा अंजतम बार संिोजधत दकए गए थे । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 8th May, 2026 G.S.R. 349(E).— WHEREAS the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India, in the Ministry of Road Transport and Highways number G.S.R. 916 (E), dated the 23rd December, 2025 published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), dated the 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 23rd December, 2025, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the said Gazette notification were made available to the public on the 23rd December, 2025; AND WHEREAS, the objections and suggestions received have been considered by the Central Government; NOW, THEREFORE, in exercise of powers conferred by Sub-section (1) of section 56 and section 64 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement. – (1) These rules may be called the Central Motor Vehicles (Sixth Amendment) Rules, 2026. (2) They shall come into force from the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), in rule 52, in sub-rule (2), (a) after the words "shall refer the vehicle to the authority", the words "or authorised testing station" shall be inserted; (b) for the words "certificate of fitness from that authority", the words "certificate of fitness, in Form 38 from that authority or authorised testing station" shall be inserted; 3. In the said rules, in rule 62, in sub-rule (1), (a) for the words “in respect of a transport vehicle”, the words “in respect of a motor vehicle” shall be substituted; (b) after clause (d), the following clauses shall be inserted, namely: - (e) new non-transport vehicle fifteen years (f) renewal of certificate of fitness in respect of non- transport vehicles five years: Provided that where the automated testing station registered under rule 175 is operational in the jurisdiction of a registering authority, the fitness of the vehicle of the category of light motor vehicle shall be done only through such automated testing station with effect from the commencement of the Central Motor Vehicles (Sixth Amendment) Rules, 2026. (c) in the first proviso, for the words “the renewal of a fitness certificate shall be made only after an Inspecting Officer or authorised testing stations as referred to in sub-section (1) of section 56 of the Act has carried the tests specified in the Table given below, namely: -”, the words “the renewal of a certificate of fitness shall be made only after capturing and uploading at least a ten seconds geo-tagged video of the vehicle at the time of fitness test through a mobile application developed by the Central Government, covering the vehicle from front, rear, right side and left side ensuring clear visibility of the registration number plate, chassis number and features of the vehicle by an, (i) authorised testing station as referred to in sub-section (1) of section 56 after carrying out the tests specified in the Table-D in sub-rule (1) of rule 189; or (ii) inspecting Officer after carrying out the tests specified in the Table given below, namely:-” shall be substituted. (d) in the first proviso, in TABLE, after serial number 20 and the entries relating thereto, the following serial number and entries shall be inserted, namely: - [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 “(21) Speed governor Yes Yes Yes (Visual) Yes No Ensure compliance with rule 118. (e) in the second proviso, for the words “the renewal of fitness certificate shall be made only after carrying out tests specified in the Table given below”, the words “the renewal of a certificate of fitness shall be made only after capturing and uploading at least a ten seconds geo-tagged video of the vehicle at the time of fitness test through a mobile application, developed by the Central Government, covering the vehicle from front, rear, right side and left side ensuring clear visibility of the registration number plate, chassis number and features of the vehicle after carrying out the tests specified in the Table given below” shall be substituted. (f) the third proviso and the fourth proviso shall be omitted; (g) after the fifth proviso, the following shall be inserted, namely: - “Provided also that no fitness certification shall be required at the time of registration for new non-transport vehicle sold as fully built vehicle and such vehicle shall be deemed to be having certificate of fitness for a period of fifteen years from the date of registration.” 4. In the said rules, in rule 174, in sub-rule (1), in clause (iii), the words “in Form 25 for” shall be omitted. 5. In the said rules, in rule 176, in sub-rule (1), - (a) for the first proviso, the following proviso shall be substituted, namely: - “Provided that a service station or any person related to repair of vehicle shall not become the owner or operator of an automated testing station directly in the same district where such operations are conducted:”; (b) the second proviso, shall be omitted; 6. In the said rules, in rule 177, in sub-rule (2), the words “or manufacturing or sale of vehicles or automobile spares or scrapping of vehicles” shall be omitted. 7. In the said rules, rule 181,- (a) sub-rule (2) shall be omitted; (b) for sub-rule (3), the following sub-rule shall be substituted, namely: - “(3) The following information for vehicle identification and vehicle owner identification shall be entered at the time of booking a slot for fitness test at an automated testing station, namely: - (i) Registration number of a vehicle; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (ii) Mobile number of the registered owner or authorised signatory,”; (c) in sub-rule (4),- (i) in clause (viii), after the words "Month and Year of Manufacture; ", the word “and” shall be omitted ; (ii) after clause (ix), the following clauses shall be inserted, namely: - “(x) insurance validity; (xi) permit validity, wherever applicable; (xii) Pollution under Control Certificate validity.”; (d) in sub-rule (6),- (i) clause (v) shall be omitted; (ii) for clause (vi), the following clause shall be substituted, namely, - “(vi) the visual checks data, including geo-tagged photographs and at least a ten seconds geo-tagged video of the vehicle shall be captured and uploaded through a mobile application developed by the Central Government, covering the vehicle from front, rear, right side and left side ensuring clear visibility of the registration number plate, chassis number, features of the vehicle and presence of the vehicle in the automated testing station.”; (e) in sub-rule (7), - (i) the words “Form 25 or” and the words “, as the case may be,” shall be omitted. ; (ii) in clause (iv), after the word “details”, the words “and photographs” shall be inserted. 8. In the said rules, in rule 182, - (a) in sub-rule (1), for the words “after getting the defects rectified”, the words “after paying fees as specified in rule 81” shall be substituted; (b) sub-rule (1A) shall be omitted; (c) in sub-rule (2), after the words “multiple re-tests”, the words “after paying fees as specified in rule 81” shall be inserted. 9. In the said rules, in rule 189, - (a) in sub-rule (1), - (i) In Table-D, against serial number 23, - (A) in column 5, for the word “Visual” the words “Visual and Functional” shall be substituted; (B) in column 7, after item number (ii), the following shall be inserted, namely: - "Functional inspection parameters: (i) vehicle location tracking device shall be active in VAHAN database as per AIS 140; (ii) e-SIM shall have a validity period up to the date on which the subsequent fitness test of the vehicle falls due; (iii) location of the vehicle during the fitness test shall be validated through vehicle location tracking device." (ii) in Note (a), the words “and shall be allowed to apply for multiple re-tests after paying prescribed fitness testing fee” shall be omitted; (iii) for Note (b), the following Note shall be substituted, namely: - “(b) if a vehicle is not declared as ‘fit’ within 180 days from the first date of vehicle being declared as ‘unfit’ (excluding the day of test), after failing any of the tests listed in Note (a) above or from the date of expiry of fitness certificate, whichever is later, the vehicle shall be categorized as ‘End of Life Vehicle’ (ELV) and flagged in the VAHAN as ‘ELV’: Provided that the registering authority of the State or Union territory, may allow extension beyond 180 days, under exceptional circumstances.”; 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iv) in Note (c), the words “Such vehicle may undergo multiple re-tests, after paying the prescribed fitness testing fee” shall be omitted. (b) for sub-rule (5), the following sub-rule shall be substituted, namely- “(5) All test data and visual checks data, including photographs and videos, captured as per sub-rule (6) of rule 181, shall be preserved for atleast 6 months for audit and assessment purpose.”. 10. In the said rules, in Form 38 in the heading, the words “(APPLICABLE IN THE CASE OF TRANSPORT VEHICLES ONLY)” shall be omitted. 11. In the said rules, Form 38A shall be omitted. [F.
