व्याख्यात्मक ज्ञापन
भारतीय दूरसंचार नियामक प्राधिकरण ने 15 जून 2007 को दूरसंचार उपभोक्ता शिक्षा एवं संरक्षण निधि विनियम, 2007 (2007 के 6) [इसके बाद प्रमुख विनियमों के रूप में संदर्भित] को अधिसूचित किया था। इन विनियमों के अनुसार, "दूरसंचार उपभोक्ता शिक्षा और संरक्षण निधि" (टीसीईपीएफ) नामक एक कोष बनाया गया है। निधि से होने वाली आय का उपयोग उपभोक्ता शिक्षा और संरक्षण से संबंधित कार्यक्रमों और गतिविधियों को शुरू करने के लिए किया जाता है।
वर्तमान ढांचे के अनुसार बिलिंग ऑडिट में पता चले कोई भी अतिरिक्त शुल्क उपभोक्ताओं को वापस किया जाना चाहिए। हालांकि, यदि कोई सेवा प्रदाता विनियमों द्वारा अनुमत समयावधि के भीतर अपने प्रयास के बावजूद राशि वापस नहीं कर पाता है, तो सेवा प्रदाता को अदावाकृत/अप्रतिदाय योग्य राशि टीसीईपीएफ में जमा करनी होगी।
प्राधिकरण ने देखा कि जिस आधार पर सेवा प्रदाताओं द्वारा धन जमा किया जा रहा है, उसमें कुछ असंगतियां हैं। सेवा प्रदाताओं के साथ हुई बातचीत और जमा की गई राशि के विश्लेषण से पता चला है कि जहां कुछ सेवा प्रदाता ऑडिट में उजागर अतिरिक्त बिलिंग के कारण ही धन जमा कर रहे हैं, वहीं कुछ अन्य सेवा प्रदाता अदावाकृत धन जैसे धरोहर राशि और असफल सक्रियण के प्लॉन प्रभार जमा कर रहे हैं, जिसे वे उपभोक्ताओं के पता न चल पाने के कारण उपभोक्ताओं को वापस करने में असमर्थ हैं। उपभोक्ताओं से संबंधित ऐसी किसी भी अदावाकृत/अप्रतिदाय योग्य राशि को टीसीईपीएफ फंड में जमा करना विवेकसम्मत है क्योंकि इसका उपयोग उपभोक्ताओं के कल्याणकारी उपायों के लिए किया जाएगा। तदनुसार यह महसूस किया गया कि किसी भी प्रकार की अस्पष्टता को दूर करने और उपभोक्ता के किसी भी अदावाकृत धन जैसे अधि-शुल्क, धरोहर राशि और असफल सक्रियण के प्लॉन प्रभार आदि को जमा करने में सुविधा प्रदान करने के लिए टीसीईपीएफ विनियम में संशोधन किया जाना चाहिए।
उपरोक्त को ध्यान में रखते हुए, हितधारकों की टिप्पणियों के लिए 18.10.2019 को ट्राई की वेबसाइट पर नियमन में संशोधन का मसौदा रखा गया था जिसमें 18.11.2019 तक का समय दिया गया था तथा हितधारकों से प्राप्त प्रतिक्रियाओं को ट्राई की वेबसाइट पर अपलोड किया गया। लगभग सभी हितधारकों ने प्रस्तावित संशोधनों के साथ सहमति जताई। कुछ हितधारकों ने इस संबंध में अपने सुझाव भेजे। संबंधित सुझावों का विश्लेषण अगले पैराग्राफों में किया गया है।
एक सेवा प्रदाता ने सुझाव दिया कि प्राधिकरण को उन सभी खातों/शीर्षों को स्पष्ट एवं सूचीबद्ध किया जाना चाहिए जिनके तहत उपभोक्ताओं को नहीं किए जा सके भुगतानों को निधि में प्रेषित किया जाना हो। इस संबंध में यह बताया जाता है कि पिछले अनुभव और टीसीईपीएफ खाते में जमा की गई राशियों के आधार पर, प्रमुख खाता/शीर्षों को इस व्याख्यात्मक ज्ञापन के पैरा 3 में उल्लेखित किया गया है। तथापि, यदि किसी सेवा प्रदाता के पास कोई ऐसी राशि हो, जो इन खातों/शीर्षों के तहत नहीं आती है तो वे इसका उल्लेख करते हुए उसे भी टीसीईपीएफ खाते में जमा करें। अतः संशोधित विनियम इस संबंध में सेवा प्रदाताओं को पर्याप्त सुविधा प्रदान करता है।
एक सेवा प्रदाता ने सुझाव दिया कि प्राधिकरण को उस प्रक्रिया को निर्धारित करना चाहिए जब उपभोक्ता, जिसकी देय राशि निधि में जमा कर दी गई हो, ऐसा भुगतान वापस प्राप्त करने हेतु सेवा प्रदाताओं से संपर्क करता है। इस संबंध में, यह बताया जाता है कि विगत में जमा की गई राशियों के आधार पर यह निष्कर्ष निकाला जा सकता है कि प्रति उपभोक्ता की वापसी योग्य राशि बहुत अधिक नहीं है। सेवा-गुणवत्ता विनियमों में पहले ही धरोहर राशि अथवा अतिरिक्त धनराशि की वापसी हेतु अनिवार्य समय सीमा निर्धारित की गई है। सेवा प्रदाता को इन समय सीमा के भीतर उपभोक्ता को वापसी योग्य किसी भी शुल्क/राशि/जमा को वापस करने के लिए अपने समुचित प्रयास करने चाहिए। इसके अलावा, टीसीईपीएफ विनियमों में यह प्रावधान है कि सेवा प्रदाता बारह महीने की समाप्ति अथवा तत्समय प्रवृत किसी अन्य विधि के अंतर्गत निर्दिष्ट सीमा की अवधि, जो भी बाद में हो, तक अदावाकृत/अप्रतिदेय राशि को टीसीईपीएफ को हस्तांतरित करेंगे। तथापि, यदि कोई भी व्यक्ति टीसीईपीएफ को ऐसी राशि के हस्तांतरण के बाद, किसी भी राशि की वापसी का हकदार बन जाता है, तो उपभोक्ता संरक्षण अधिनियम के तहत या किसी अदालत या न्यायाधिकरण द्वारा उपभोक्ता फोरम द्वारा किए गए आदेश के अनुपालन में मूल विनियमों के विनियमन 16 के प्रावधानों के अनुसार इसका दावा किया जा सकता है।
TELECOM REGULATORY AUTHORITY OF INDIA NOTIFICATION

No. 324-5/2018-CA ---In exercise of the powers conferred upon it under section 36 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997), the Telecom Regulatory Authority of India hereby makes the following regulations further to amend the Telecommunication Consumers Education and Protection Fund Regulations, 2007 (6 of 2007), namely :-
TELECOMMUNICATION CONSUMERS EDUCATION AND PROTECTION FUND (FIFTH AMENDMENT) REGULATIONS, 2020 (3 of 2020)
(1) These regulations may be called the Telecommunication Consumers Education and Protection Fund (Fifth Amendment) Regulations, 2020. (2) They shall come into force from the date of their publication in the Official Gazette.
In regulation 3 of the Telecommunication Consumers Education and Protection Fund Regulations, 2007 (6 of 2007), - (a) in sub-regulation (1), - (i) the words “in excess of” shall be omitted; (ii) for sub-clause (i), the following sub-clause shall be substituted, namely: - “(i) in excess of the rates of telecommunication service determined under any regulation or order or direction made under the Act, in a case where the rates have been determined and notified under sub-section (2) of section 11 of the Act; or”; (iii) for sub-clause (ii), the following sub-clause shall be substituted, namely: - “(ii) in excess of the rates announced by the service providers, in a case where the rates have been notified as rates under market forbearance under sub-section (2) of section 11 of the Act; or”; (iv) after the sub-clause (ii) and before the words “which has not been refunded”, the following sub-clause shall be inserted, namely: - “(iii) which has become refundable to the consumer,”; (b) in sub-regulation (2), the words and numbers “sub-clauses (i) and (ii) of ” appearing after the words “Any amount referred to in” and the words and numbers “sub-clause (i) or sub-clause (ii) of” appearing in the proviso shall be omitted.

EXPLANATORY MEMORANDUM
The Telecom Regulatory Authority of India had notified the Telecommunication Consumers Education and Protection Fund Regulations, 2007 [(6 of 2007) [hereinafter referred to as the principal regulations] on 15th June 2007. In terms of these regulations, a fund called “Telecommunication Consumers Education and Protection Fund” (TCEPF) has been created. The income from the fund is utilized to undertake programmes and activities relating to consumer education and protection.
As per the current framework any excess charges revealed in the billing audit should be refunded to consumers. However, if a service provider is not able to refund the amount despite its attempt within the time period permitted by the regulations, the service provider has to deposit the unclaimed/unrefunded amount into the TCEPF.
The Authority noticed that there is some inconsistency on the grounds on which money is being deposited by service providers. Interactions held with service providers and analysis of the amount deposited, have revealed that while some service providers are depositing money only on account of excess billing revealed in the audit, some other service providers are depositing unclaimed money such as security deposits and plan charges of failed activations which they are unable to refund to the consumers because of non-traceability of the consumers. It is prudent to deposit any such unclaimed/un refundable amount belonging to consumers in the TCEP fund as it will be utilized for the welfare measures of the consumers. Accordingly it was felt that an amendment in the TCEPF regulation may be carried out to remove any kind of ambiguity and facilitate deposit of any unclaimed money of the consumer such as excess charges, security deposit, plan charges of failed activations etc.
In the view of above, a draft amendment to the regulation was placed on the TRAI website on 18.10.2019 for the comments of stakeholders by 18.11.2019. The responses received from the stakeholders were uploaded on TRAI website. Almost all the stakeholders concurred with the proposed amendments. Some of the stakeholders sent their suggestions in this regard. The relevant suggestions are analysed in the following paragraphs.
One service provider suggested that the Authority should list and clarify all the heads under which payments remained unpaid to the consumers that can be remitted to the fund. In this regard it is mentioned that based on the past experience and the amounts deposited in the TCEPF account, the major heads have been mentioned in para 3 of this explanatory memorandum. However, in case service provider find any amount that is not covered in the above list can also deposit in the TCEPF. As such the amended regulation provide this flexibility to the service providers.
One service provider suggested that the Authority should prescribe the process to be followed when consumer, whose refund due has been deposited with the fund, approaches the service providers for such payment. In this reference it is mention that based on the amount deposited in the past it can be concluded that the refundable amount per subscriber is not very significant. Quality of Service regulations have already mandated timelines for refund of excess charges and security deposit etc. The service provider should make all efforts to refund any charges/amount/deposit refundable to consumer within given timelines. Further, the TCEPF regulations have provision of twelve months or period of limitation under law for the time being in force, whichever is later for service provider to transfer the unclaimed /un-refundable amounts to the TCEPF. However, if any person becoming entitled to refund of any amount, subsequent to the transfer of such amount to the TCEPF, the same may be claimed as per the provisions under regulation 16 of the principal regulations in pursuance of an order made by a Consumer Forum under the Consumer Protection Act or by any court or tribunal.
